Bellows, a Democrat,\u200b is currently engaged\u200d in a legally suspect attempt to kick former President Donald Trump off of Maine\u2019s 2024 presidential primary ballot.<\/p>\n<p>\u201c[W]hether \u2062voter \u2062registration rolls are accurate and current cannot be determined without inspecting the Voter File \u2026 In\u2063 other words, the evaluation of voter registration \u200crolls would be impossible if the results of Maine\u2019s voter\u2062 list registration and maintenance activities were not subject to public disclosure,\u201d Gelp\u00ed wrote. \u200d\u201cFor the above reasons, Maine\u2019s Voter\u2064 File is a \u2018record concerning the implementation of programs and activities conducted for the purpose of ensuring the accuracy and currency of official lists of eligible voters\u2019 \u200cand is thus subject to disclosure under \u200cSection 8 [of the NVRA].\u201d<\/p>\n<p>The entire saga began in October 2019 when PILF requested a copy \u2062of Maine\u2019s voter file and \u201cvoting histories.\u201d \u200bThe office of then-Secretary of State \u200cMatthew Dunlap, a Democrat, denied PILF\u2019s request, \u201cciting state law that limited access to preferred entities like political parties.\u201d This\u2064 prompted the conservative \u200clegal group to sue Dunlap\u2019s office in February 2020.<\/p>\n<p>According to PILF, Maine altered its laws in 2021 \u200bto prevent watchdog groups\u200c \u201cfrom using the [voter] file to perform research not pre-approved by the legislature.\u201d These prohibited research activities included comparing Maine\u2019s voter roll data to another state\u2019s to identify potentially invalid registrations. \u201cAnything other than \u2018evaluating\u2019 Maine\u2019s own compliance with voter list maintenance obligations would \u200brisk \u2062severe fines for unauthorized use,\u201d a PILF press \u200drelease noted.<\/p>\n<p>PILF amended its complaint in response, alleging\u200d that these fines constituted a violation of the NVRA. The U.S. District Court for the District of Maine ultimately agreed, ruling in March 2023 that the NVRA\u2063 \u201cpreempts\u201d Maine\u2019s \u201cimpermissible\u201d restrictions and fines regarding \u2062the use of the state\u2019s voter file. This prompted Bellows to appeal the ruling.<\/p>\n<p>In \u2062addition to granting PILF access to Maine\u2019s voter rolls, Gelp\u00ed similarly determined \u200cthat the provisions\u2062 of the NVRA preempt the fines enacted by the state. He \u2062wrote, \u201cthe restrictions imposed by the \u2062Use Ban erect an impenetrable barrier for those seeking to use the Voter File to \u2063evaluate \u200cand enforce compliance with \u2063the NVRA nationwide.\u201d<\/p>\n<p>PILF President J.
