Yet one of the most conspicuous parts \u200cof the \u2064 <a href=\"https:\/\/www.lankford.senate.gov\/wp-content\/uploads\/2024\/02\/MCC24166.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">new<\/a> \u2062 bipartisan border bill allows Joe Biden to do just that.<\/p>\n<p>Once there \u2062is a rolling\u200d average of 5,000 border encounters per day for a week, or 8,500\u200b encounters in a single day, the Department \u2064of Homeland Security \u2063(DHS) would be given \u201cemergency authority\u201d and compelled to turn\u2064 away anyone else who\u200c crosses \u200b(though \u200dthere are \u200cmany exemptions). Most conservatives believe this threshold is already too high. \u200bUnder 5,000 daily crossings can \u200cstill amount to nearly 2 million entries per year, which\u2063 is around \u2064double\u200b the <a href=\"https:\/\/immigrationforum.org\/article\/legal-immigration-to-the-united-states-national-quotas-americas-immigration-system\/#:~:text=There%20are%20roughly%20one%20million,21%20%E2%80%93%20are%20exempt%20from%20quotas.\">number<\/a> of Green Cards we hand out annually.<\/p>\n<p>Yet, on top of that, Biden has\u200b the power to unilaterally suspend \u200cthe\u2064 closure (for 45 days each \u200dyear) if he deems it \u201cin the national interest.\u201d<\/p>\n<p><strong>You \u2062know, the reason we have\u200b political debates in the first place is so we \u200dcan\u200c figure out how to\u2064 protect the \u201cnational interest.\u201d If we had a common understanding of the idea, we\u2019d be a one-party state. But\u2064 as with other political phrases these days \u2014 the\u2063 \u201ccommon good\u201d or \u201cdemocracy,\u201d come to mind \u2014 \u2064the term \u201cnational interest\u201d is meaningless. Democrats, for\u200d instance, believe it\u2019s in the national interest\u200b to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-war-on-cooks-president-moves-to-ban-gas-stoves\/\" title=\"Biden\u2019s War on Cooks: President Moves To Ban Gas Stoves\">regulate gas stoves<\/a> and \u201cmisinformation.\u201d I believe it\u2019s in the national interest for the \u200bexecutive branch\u2019s\u200b power to be limited to \u2063its constitutional \u200brole and mind its own business.<\/strong><\/p>\n<p>Indeed, the president can already declare national \u2062emergencies. Trump \u200bdid on the border in 2019 and was called \u200dan authoritarian\u2064 by Democrats. Congress \u200bcould stop\u2064 this from happening again by repealing the National Emergencies \u2062Act,\u200c not by \u200cdoubling down and handing the executive branch\u2064 even wider latitude to interpret laws whenever they find it convenient.<\/p>\n<p>Most of\u200d the provisions \u2064in the\u200c bill \u200dare \u2064so loophole-riddled they \u2063are worse than irrelevant. One provision\u200c allows administration officers\u200c to grant \u200dasylum without any oversight from judges, who (at\u2064 least, theoretically) use a set of criteria to \u2062adjudicate these cases. \u201cAsylum\u201d might have been stripped of any real meaning, as well, but it\u2019s a\u200b mystery why\u200d James Lankford wants to\u200c hand \u2064Alejandro Mayorkas more autonomy on \u200cthis front. Or any front. \u2064(Again, can you imagine Democrats signing\u200c onto a bill that handed \u200cChad Wolf more discretion over asylum \u2063cases?)<\/p>\n<p>Then \u2062again, if there are any\u200c legal fights over the implementation of the law, Democrats have \u2062cherry-picked the court that will adjudicate. No, not \u200cthe Fifth Circuit, which inconveniently sits on the border, but the left-wing D.C. District Court will have exclusive authority over \u201cwritten policy directive, written policy guideline, written \u2064procedure\u201d and their \u2062implementation.<\/p>\n<p>Meanwhile, Democrats are \u200dacting as if they\u2019ve made some giant, historic \u200dconcession \u200ceven\u200b deigning to address the \u2064crisis. But where is the compromise? They\u2019ve rigged the bill, making it \u200cso malleable \u2063that \u200cBiden can basically interpret and implement its provisions in\u2062 any fashion he chooses. (Only on the enforcement\u200c side, naturally. There is no \u200dopting out of Ukraine aid\u200b or\u2064 more\u2064 taxpayer-funded\u200d asylum lawyers.) Then, Democrats\u2063 ensured that the court\u2062 hearing any disputes over that implementation would almost \u200dsurely side with them.<\/p>\n<p>And \u200dlest anyone\u200d think I\u2019m \u200dsome kind of hardline closed-border type, I\u2019m \u200bfine with more\u2063 asylum-seekers\u200d and more immigration and more work visas. This provision in the bill opens up the\u2063 possibility of abuse, as administration officers \u200ccan now unilaterally grant asylum without any judicial oversight.<\/p>\n<p>Furthermore, the bill includes\u2063 a section that \u2063grants Biden the power to waive\u200c environmental laws within 100 miles of the border for the construction of physical barriers. While \u200cit is important \u200cto address border\u2062 security, sacrificing environmental protections for expediency \u200dis a dangerous precedent to set. \u200cIt undermines the importance of \u200denvironmental stewardship \u2062and disregards the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/congressional-hearing-combating-graphic-and-explicit-content-in-school-libraries-comes-amid-complaints-of-book-bans\/\" title=\"Congressional hearing addresses concerns over 'book bans' amidst efforts to combat explicit content in school libraries.\">potential \u200clong-term consequences<\/a> of such \u200bactions.<\/p>\n<p>This bill also fails to address the root \u200bcauses of illegal immigration. It focuses solely on enforcement measures at the border without considering the economic \u200band social factors that drive individuals to undertake the perilous journey. To truly address the issue, comprehensive \u200cimmigration reform that\u200b tackles the economic disparities, violence, and lack\u200b of opportunities in countries of origin is necessary. Simply increasing border security without addressing these underlying issues \u200cis a shortsighted \u2063approach that\u2063 will not yield lasting solutions.<\/p>\n<p>In addition, the bill does not provide \u2063meaningful solutions for the \u2062processing and asylum-seeking \u2064procedures at\u200c the border. It does not\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/man-pleads-not-guilty-to-assaulting-victims-lured-through-grindr\/\" title=\"Man denies assaulting victims lured via Grindr.\">allocate sufficient resources<\/a> to expedite the asylum process, resulting in prolonged detention \u2063and uncertainty for individuals seeking protection. This bill fails to prioritize the humane treatment of migrants and \u2063instead perpetuates a system that often leaves individuals\u200d in\u200b limbo.<\/p>\n<p>It\u200d is evident\u2063 that \u2064this border bill grants President Biden unprecedented power, allowing him to bypass provisions he deems contrary to \u2063the &#8220;national interest&#8221; and suspending\u2062 closures without adequate justification. This concentration of power\u2063 in the executive\u2062 branch undermines the checks and balances system that is fundamental to a healthy democracy.<\/p>\n<p>Rather than hastily passing\u200b legislation that expands executive authority and fails to address the underlying issues, Congress should take a step back\u200b and\u200b engage \u2062in\u2064 bipartisan discussions to develop comprehensive immigration reform. Such a reform should \u2064prioritize border \u200dsecurity while upholding fundamental human rights, address the root causes\u200b of \u200bmigration, and ensure a fair and efficient asylum process.<\/p>\n<p>Ultimately, the national interest should be safeguarded through a collaborative approach\u2062 that \u2063respects the principles of democracy, transparency, and accountability.
