However, upon closer examination, the bill \u2062lacks true toughness and contains loopholes that can be easily exploited by the\u2064 Biden administration and the\u200c influx of \u2062illegal aliens from the south.<\/p>\n<p>For \u200cexample, the bill grants the secretary of homeland security &#8220;emergency authority&#8221; to summarily\u200d remove \u2064aliens,\u2062 but this authority only applies under specific \u200dconditions. Furthermore, the\u200b bill exempts unaccompanied alien children from the border emergency authority, \u200callowing every illegal alien under 18 to enter the country. U.S. \u200dImmigration and Customs Enforcement can also \u200cexempt aliens based \u200con operational considerations and other reasons, while the\u200c president has the power to\u200c suspend the secretary&#8217;s border emergency authority\u200c at\u200b will.<\/p>\n<div class=\"fdrlst__b89e9-21c1e2b7e24baddf0cc8b0627f293794 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-21c1e2b7e24baddf0cc8b0627f293794\"><\/div>\n<p>Since the Biden administration replaced President Trump&#8217;s border policies, exceptions\u200c have\u200c consistently undermined the rule. It is unlikely that this trend will change after nearly four \u200cyears of an open border.<\/p>\n<h2 class=\"wp-block-heading\">Ineffective Asylum Reform<\/h2>\n<p>The\u2064 Senate \u2064bill&#8217;s\u2063 supposed toughening of \u2062asylum procedures\u2063 is\u2062 equally ineffective. The provision stating that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-plan-to-allow-immigration-benefits-for-terror-supporters-raises-a-lot-of-questions\/\" title=\"Biden Plan to Allow Immigration Benefits for Terror Supporters Raises a Lot of Questions\">individuals seeking asylum<\/a> will be &#8220;released from physical custody&#8221; undermines any\u200c meaningful \u2064improvement. \u2062While the bill aims to expedite asylum decisions within 90 days, \u2064the inclusion\u2064 of the phrase &#8220;to the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admin-charging-u-s-citizens-2000-for-evacuation-flights-out-of-afghanistan-report-says\/\" title=\"Biden Admin Charging U.S. Citizens ,000 For Evacuation Flights Out Of Afghanistan, Report Says\">maximum extent practicable<\/a>&#8220;\u2062 allows aliens to abscond. Additionally, the bill allows aliens to seek review of negative decisions, providing them with a second chance to flee \u200beven \u2062after the initial hearing.<\/p>\n<p>By releasing aliens pending a hearing, the Senate\u200d bill renders \u2063any \u200bother tightening \u200dof \u2062the asylum\u200c process meaningless. A clear message would have been for the\u200c Senate to specify that \u2063general violence, \u2064including gang violence,\u200d in a country of \u2064origin is not a valid basis for asylum.<\/p>\n<div class=\"fdrlst__b89e9-629011fb5cc9ab121c4109a72d5304d7 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-629011fb5cc9ab121c4109a72d5304d7\"><\/div>\n<p>Previously, Congress defined asylum grounds as limited to\u2063 persecution\u2063 based on race, religion, nationality, membership in\u200d a particular \u2064social group, or political opinion. However, the broad interpretation of &#8220;membership in a particular\u2063 social group&#8221; has allowed claims for asylum based \u200don spousal abuse, gang \u200dthreats, and occupation-based targeting.<\/p>\n<h2 class=\"wp-block-heading\">Efforts for Reform<\/h2>\n<p>During the Trump \u2064administration, Attorney General Jeff Sessions\u2064 aimed\u200c to bring clarity to\u200d the &#8220;membership in a particular social group&#8221; category, requiring applicants to \u200cdemonstrate specific\u2062 criteria. If so, \u200bCongress should \u200dexplicitly \u200cstate it. \u200bOtherwise, Congress \u2063should clarify that asylum is reserved for those persecuted by their government due to race, religion, sex, political \u200bviews,\u200b or\u2062 other specific classifications determined by elected officials.<\/p>\n<p>The\u2063 irony lies\u2062 in the\u200d fact \u2062that the Biden administration&#8217;s \u2064reversal of Trump&#8217;s policies\u200d has \u200cinadvertently strengthened cartels, gangs, and traffickers, allowing\u200d those flooding\u200b into\u200d the country \u200cto claim that their government cannot protect them. \u2062If &#8220;non-gang members&#8221; \u200bcan be considered a &#8220;social group,&#8221; then asylum will be granted to all.<\/p>\n<p>We\u2063 do not know Congress&#8217;s stance on this matter because they prefer\u2062 to leave it \u200cto the administrative state. This lack of clarity and \u200dspecificity creates a breeding ground for fraudulent claims\u2064 and delays in processing legitimate asylum cases.<\/p>\n<p>It is crucial for the\u2062 Senate\u2063 to recognize the urgency of addressing the border crisis and implementing effective asylum reforms. This requires a comprehensive approach that includes stricter eligibility criteria, expedited processing of cases, and cooperation with other countries to address \u2064the root causes of migration.
