Democrats have recently expanded these tactics to lawyers who cross Democrats on <em>any<\/em> \u200dpolicy area.<\/p>\n<p>\u201cTheir\u200b most sweeping goal is to discourage \u200cand chill lawyers from representing Republicans and conservatives, particularly \u200din \u2062election law cases. They want to\u200d apply a much higher standard to them \u200cin order to punish them,\u201d says attorney Jim Bopp Jr.,\u2064 who <a href=\"https:\/\/courtapps.in.gov\/rollofattorneys\/attorney\/10b3f693-fbb6-e011-9d34-02215e942453?FirstName=james&#038;LastName=bopp&#038;OrderBy=0&#038;Page=1\">defeated<\/a> a politically motivated ethics <a href=\"https:\/\/the65project.com\/ethics-complaint-against-james-bopp-2\/\">complaint<\/a> after \u2062representing Wisconsin Special Counsel Michael Gableman over\u2063 his 2020 investigation that unearthed \u201c<a href=\"https:\/\/thefederalist.com\/2022\/03\/03\/wisconsin-special-counsel-finds-widespread-election-fraud-in-2020-nursing-homes\/\">widespread election fraud<\/a>.\u201d<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-16441349\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-a7afefaf3dc268216fec0c1235208671 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-a7afefaf3dc268216fec0c1235208671\"><\/div>\n<p>Disciplining conservative, or simply neutral, lawyers strips Democrats\u2019 opponents of high-quality legal defense, erasing justice by skewing the legal playing \u2064field. Most notorious, of course, is former President Donald Trump\u2019s difficulties securing \u200bcounsel to defend \u2064against the multiple lawsuits attempting \u200cto bankrupt him\u2064 and ban voters from selecting him on the ballot.<\/p>\n<h2 class=\"wp-block-heading\">What They\u200d Do to Trump, They\u2019re Doing\u200d to\u200b Everyone<\/h2>\n<p>Democrats are not\u200d just seeking to eliminate competent legal defense from Trump.\u2062 They\u2019re pursuing lawyers who oppose their policies in any domain, from former Attorney\u2063 General William Barr to his former deputy Jeff Clark to Trump election adviser\u2063 John\u2062 Eastman and local lawyers with no national profile such as <a href=\"https:\/\/thefederalist.com\/2024\/01\/31\/judge-throws-out-green-bays-retaliatory-disorderly-conduct-citation-against-election-observer\/\" target=\"_blank\" rel=\"noreferrer noopener\">Janet Angus in Wisconsin<\/a> and an <a href=\"https:\/\/arizonasuntimes.com\/news\/bar-disciplinary-trial-wraps-up-against-former-maricopa-county-prosecutor-who-charged-antifa-demonstrators-at-violent-protest-in-phoenix\/ralexander\/2023\/11\/03\/\" target=\"_blank\" rel=\"noreferrer noopener\">Arizona prosecutor<\/a> who\u2064 wouldn\u2019t\u2063 let rioters off \u200bthe hook.<\/p>\n<p>Justice Clarence Thomas has been unrelentingly defamed\u2062 since the day he \u2062was nominated to the Supreme Court. Most recently, the\u2064 war against his rock-solid constitutional jurisprudence has materialized in <a href=\"https:\/\/thefederalist.com\/2024\/01\/17\/where-was-neutral-propublica-on-ketanji-brown-jacksons-ethics-violations\/\" target=\"_blank\" rel=\"noreferrer noopener\">multiple politicized\u2063 ethics complaints<\/a>.<\/p>\n<p>The Texas Bar Association has\u200c been waging war on Attorney General Ken Paxton <a href=\"https:\/\/thefederalist.com\/2023\/02\/13\/democrats-unconstitutional-crusade-to-disbar-texas-ag-ken-paxton-shows-how-far-theyll-go-to-win-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">using ethics complaints<\/a>. Three Arizona lawyers who contested chaotic election procedures in 2020 and did work for \u2064gubernatorial candidate Kari Lake now \u2062 <a href=\"https:\/\/www.azfamily.com\/2023\/12\/12\/committee-probable-cause-exists-complaints-against-3-kari-lake-attorneys\/\" target=\"_blank\" rel=\"noreferrer noopener\">face discipline\u2062 complaints<\/a> before the state supreme court.<\/p>\n<div class=\"fdrlst__b89e9-adf24f4c6f7a85f7e2845c7b819b7b10 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-adf24f4c6f7a85f7e2845c7b819b7b10\"><\/div>\n<p>Many of\u2062 the\u200b 1,265 Americans charged for their\u2064 presence at the Jan. 6, 2021 riot have been unable to get \u200bcompetent counsel, partly due to lawyers\u2019 fears \u200bof retaliation \u2064for assisting unpopular defendants. This is a far cry\u2062 from the entire legal profession\u2019s\u2062 former support for \u200dproviding competent counsel to even the worst of criminals to \u2063ensure constitutional due process and fairness in court, Bopp noted.<\/p>\n<p>\u201cThe ACLU could defend the Nazis \u200dmarching through Skokie in front of Holocaust survivors,\u201d he said. \u201cAnd there \u2063couldn\u2019t be a more despicable bunch.\u201d<\/p>\n<p>Clark\u2019s home was <a href=\"https:\/\/www.npr.org\/2022\/06\/23\/1107089638\/federal-authorities-searched-former-justice-official-jeff-clarks-home\" target=\"_blank\" rel=\"noreferrer noopener\">raided<\/a> by federal agents. Eastman\u2019s legal\u200d defense in \u200dthree separate lawfare cases will <a href=\"https:\/\/thefederalist.com\/2023\/11\/27\/constitution-scholar-lawfare-punishing-me-for-advising-trump-will-cost-me-3-million\/\" target=\"_blank\" rel=\"noreferrer noopener\">cost him $3 million<\/a>, threatening his wife\u2019s retirement savings. Half of current Republican attorneys\u200d general and many of their predecessors <a href=\"https:\/\/thefederalist.com\/?p=310042&#038;preview=true\" target=\"_blank\" rel=\"noreferrer noopener\">have faced discipline complaints<\/a>, most relating to 2020 election litigation.<\/p>\n<p>Such\u2064 complaints not only threaten a lawyer\u2019s license \u2062to practice, but also impose legal fees and\u2063 paperwork\u2063 burdens. Lengthy\u200b complaints\u2064 can take \u201can enormous \u2064psychological toll on people,\u201d \u200csays Shalom Stone, a well-known New Jersey lawyer\u2064 whose specialties \u2063include legal ethics.<\/p>\n<div class=\"fdrlst__b89e9-e3a3214f74805f3bb06fc6d446f179ab fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-e3a3214f74805f3bb06fc6d446f179ab\"><\/div>\n<h2 class=\"wp-block-heading\">Disagree with Democrats, Face a Tornado<\/h2>\n<p>Complaints and retaliatory litigation are only two \u200bof many\u200b tools Democrats are deploying to eliminate competent legal opposition to their policies. U.S. Supreme Court \u200cjustices who are more likely to uphold the Constitution have been threatened with assassination and mob violence. A \u200cman with a pistol\u2063 and other weapons was\u200b arrested in 2022\u200c outside Justice Brett Kavanaugh\u2019s home after he confessed to \u200ban assassination attempt.<\/p>\n<p>More than 100 lawyers have been strung up with ethics complaints from \u200cThe 65 \u200bProject for opposing Democrats in election litigation. Media Matters founder David Brock, \u200can adviser for The 65\u2062 Project, <a href=\"https:\/\/www.vanityfair.com\/news\/2022\/03\/legal-group-disbar-lawyers-who-helped-trump\" target=\"_blank\" rel=\"noreferrer noopener\">told Axios<\/a> the outfit is working not only to strip law licenses from any lawyer \u200bwho opposes \u2062Democrats but also to \u201cshame them and make them toxic\u2063 in their communities and in their firms. \u2026 You\u2019re \u2064threatening their livelihood.\u201d<\/p>\n<p>A similar organization called Lawyers Defending Democracy <a href=\"https:\/\/ldad.org\/wp-content\/uploads\/2024\/01\/Keller-Memo-Updated-Jan-2024.docx.pdf\">published a memo in January<\/a> urging \u2063state bar \u2063associations \u200cto initiate ethics \u2064investigations and disciplinary complaints to \u201cregulate[] the legal profession\u201d and \u201cdefend democracy.\u201d The memo states outright that \u201cethics investigations of lawyers \u2062like John Eastman, Jeffrey Clark, and Kenneth Paxton \u200dare at the heart of what state bars can and should do.\u201d<\/p>\n<p>In 32 states \u200cand D.C., bar membership is mandatory to practice law. The American Bar Association <a href=\"https:\/\/www.fedbar.org\/blog\/efforts-toward-improved-diversity-and-inclusion-through-the-anti-bias-rule\/\">has \u200crecommended<\/a> \u201cdiversity and inclusion\u201d\u2062 provisions in\u2064 lawyers\u2019 ethics codes, effectively sanctioning \u200ccomplaints against those who \u200bnotice men and women are different and who <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-smears-opponents-as-nazis-while-democrat-voters-riot-for-jewish-genocide\/\" title=\"Biden accuses opponents of being Nazis as Democrat supporters protest for Jewish genocide\">oppose racial preferences<\/a>. Vermont, Pennsylvania, Connecticut, Maine, New York, New Jersey, and some federal courts have\u200b adopted such provisions.<\/p>\n<p>Stone says he\u2019s not seen politically motivated ethics complaints in New Jersey, but litigants will sometimes file ethics charges against opponents to gain leverage in court. That\u2019s why New Jersey\u2019s ethics board often won\u2019t consider complaints until litigation between the parties has concluded.<\/p>\n<p>Even\u2062 when \u200bthose targeted can defeat such complaints, Bopp\u200b noted, \u2062\u201cthe initial allegation has a lot longer legs than the eventual response\u200d or vindication.\u201d A lengthy \u200clegal defense is bankrupting to \u200danyone not independently wealthy.<\/p>\n<p>Even for the independently wealthy, lawsuits can aim to take everything. In the last two years, Trump <a href=\"https:\/\/apnews.com\/article\/trump-spent-millions-legal-fees-2024-presidential-campaign-3384cbfc2df69d3e97ba9e47c2384312\" target=\"_blank\" rel=\"noreferrer noopener\">has spent at least $76 million<\/a> \u2064 on legal \u2064fees, not to mention the potential loss of New York businesses worth <a href=\"https:\/\/www.bbc.com\/news\/world-us-canada-67939251\" target=\"_blank\" rel=\"noreferrer noopener\">hundreds of millions<\/a>, if <a href=\"https:\/\/fortune.com\/2024\/01\/29\/trump-cash-stockpile-risk-450-million-dual-verdicts-e-jean-carroll-new-york-business-fraud-cases\/\" target=\"_blank\" rel=\"noreferrer noopener\">not billions<\/a>, over a property estimate the\u200d legal system decided to\u200c challenge.<\/p>\n<p>\u201cThe chill factor is real,\u201d Bopp said. \u201cThese disciplinary commissions\u200b are controlled by the state supreme courts. And many state\u200b supreme courts have been taken over by hardcore leftists.\u200b What do you think they\u2019re doing with staffing and their appointments?\u201d<\/p>\n<h2 class=\"wp-block-heading\">\u2018People Are Taken Care of on the Left\u2019<\/h2>\n<p>Successful complaints against elected attorneys general would deny voters their choice of top attorney to represent state interests in court. A Marquette University professor\u2019s <a href=\"https:\/\/attorneysgeneral.org\/multistate-lawsuits-vs-the-federal-government\/list-of-lawsuits-1980-present\/\">database<\/a> shows Republican attorneys\u200d general have initiated \u206355 lawsuits against the \u200cBiden administration, versus Democrat AGs initiating 131 lawsuits\u2063 against the Trump administration.<\/p>\n<p>Similarly massive asymmetries appear throughout this domain, said Andrew Kloster, general counsel \u2062to Rep. \u200bMatt Gaetz, R-Fla., and a former Trump\u2062 administration\u2063 lawyer: \u200c\u201cThe left has a 10-1 nonprofit advantage,\u201d he said,\u2064 noting career opportunities are limited for openly \u200bconservative lawyers \u200ddue to far-left bias at \u200bmost <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/legal-nonprofit-helps-victims-of-human-trafficking-expunge-criminal-records\/\" title=\"Legal nonprofit aids trafficking victims in clearing criminal records.\">large law firms<\/a>. Democrats have developed a large legal infrastructure that funds policy work, fellowships for law students and young litigators, and free defense for criminals and agitators on the left \u2014 \u200boften with public bucks.<\/p>\n<p>\u201cPeople are\u2062 taken care of on the left. On the right, not so much. We don\u2019t have the defensive advantage, and we don\u2019t have the offensive appetite,\u201d Kloster said.<\/p>\n<p>In the 2020 election\u2064 cycle, <a href=\"https:\/\/www.opensecrets.org\/industries\/totals?cycle=2020&#038;ind=K01\" target=\"_blank\" rel=\"noreferrer noopener\">81 percent<\/a> of \u200bdonations from \u2062lawyers and legal associations went to Democrats, according to\u200b OpenSecrets.org. Kloster also recommended hiring lawyers and paying for insurance to indemnify employees and volunteers against complaints that could easily bankrupt the average person.
