Instead of ⁢upholding the ⁤rule of law and securing the border, the Biden ⁢Administration has ⁢attacked and sued Texas for ⁣stepping up ‍to protect ⁤American citizens⁢ from historic levels of illegal immigrants, deadly⁢ drugs like fentanyl, and terrorists entering our country.

It⁤ is not just the states who are rising up to counter the⁢ lawless Biden administration, there are confirmed reports of vigilantes engaging (and more forming) to stop this invasion.‌ This is‌ not simply an isolated incident of federal misuse of power bringing the country to the ⁣verge of coming apart. This travesty at our border, pitting states against a seemingly united front of federal and judicial power, may very well be the spark that will‌ fracture our nation. Or can we avert this calamity?

The Power of the⁤ States and⁤ the Constitution

Thanks to the wisdom of our founders, who anticipated existential conflicts between Washington and the ⁣states, the answer lies in our Constitution. It may surprise some to learn‍ that⁣ our founders⁣ believed in federalism and a system of checks and ⁣balances. That’s why‌ in Article V of the Constitution they gave ‌the states the ultimate authority to counter a ⁣tyrannical federal government.

Today,‌ out of the 34 necessary states, ⁢19 have passed an application‍ for a convention of states under Article V to adopt⁣ amendments that would restrain the scope‌ and power of the⁢ federal government. Under this application, an amendment could (and⁣ should) be proposed and ratified allowing the states ⁣joint jurisdiction over our⁣ international borders with respect ⁢to border crossings. The states should be ⁢specifically enabled to pass and enforce laws to prevent people from entering their state and the country ⁤illegally.

Under our Constitution,‌ it is clear that the ‌states don’t need to beg the ⁤federal ⁢government to protect their legitimate⁣ sovereign interests, like protecting the safety of their people. Article V of the Constitution gives ⁣the states the power to amend the Constitution to protect the ‌people from both federal abuse or misuse of ⁤power without the permission or involvement of the President or Congress. If ⁢15 more state legislatures would assert their authority, Texas could go from razor ⁣wire and⁤ court pleadings‍ to giving themselves ‌the power to protect their citizens.

The⁢ founders most feared an authoritarian central ⁣government, ⁢so they⁤ created a Constitution where the states, not the federal government, were at the top of the food chain. They also realized that ⁣such steps should not be taken on a whim⁢ or without broad ‌consensus, ‌so any amendment proposed ⁣at⁣ a convention of states would need to be ratified ⁤by 38 states to be added to the constitution.

With all due respect to‌ the states ‌supporting Texas, a letter complaining to the president when the states hold the right to⁤ correct this‍ problem themselves, is being seen for what it is, weakness not strength. For decades, states have let the federal government run roughshod over them ‌and their citizens. It should come as⁤ no surprise that the people are leading‌ the⁢ charge ⁤and forcing state politicians to finally push back.

If all ‍of those states were serious about⁢ the letter they signed‍ they would ⁣act and fire a shot across the bow of‌ the massive federal ship of state and immediately pass a resolution to begin the process of securing our borders and our freedoms, while striking a ‌blow against our increasingly‍ authoritarian federal government.

*⁤ * *

Mark Meckler is ‌the co-founder and President of Convention of States Action. @MarkMeckler

Rick Santorum is a former U.S. Senator from Pennsylvania, two⁤ time ⁢Presidential candidate and a Senior ⁣Advisor to Convention of⁢ States Action. @RickSantorum

The views expressed in this piece are those of the author and do not necessarily ‌represent those of The Daily‌ Wire.

What are the implications for the balance of power between the states and the federal government if the Supreme Court rules in favor of Texas in the‍ border security ⁢case?

Or more ⁣states call for a convention, the Constitution can be amended,‌ and the‌ states can regain control over issues like border security.

The Battle at the ⁣Southern Border

The situation at the ⁢southern border is⁢ nothing short of a crisis. A ⁤record number of illegal immigrants have crossed‌ into the country, posing ⁣a threat to national⁢ security and the well-being of American citizens. The Biden administration’s <a href="https://www.conservativenewsdaily.net/breaking-news/rep-mike-collins-the-migrant-crisis-is-only-half-the-story-at-our-southern-border/" title="Rep. Governor Greg⁣ Abbott has taken decisive action to secure the border and protect his state’s residents. He has deployed the National Guard, authorized state troopers to <a href="https://www.conservativenewsdaily.net/breaking-news/texas-gov-greg-abbott-says-state-will-build-its-own-border-barriers-if-biden-wont-address-immigration-crisis/" title="Texas Gov. However, the Biden administration has not only failed to support Texas’ efforts, but they have actively hindered⁣ them. The federal government has sued Texas and threatened to withhold funds,‍ putting politics ahead of the safety and security of American citizens.

The conflict between Texas and the federal government has now reached ⁣the Supreme Court. Texas has filed a petition asking the Court to intervene and allow⁣ the state to enforce its own immigration laws. The Supreme Court, in what⁢ could be a landmark decision, will determine whether the federal⁣ government can override ⁢the states on matters of border security. The outcome of this case could have far-reaching implications for⁤ the balance of power between the states and the federal ‍government.

The Future of American ⁤Federalism

President Biden’s failure to secure the southern border‍ has sparked a battle with Texas, but ‌it also raises broader questions about the future of ⁣American federalism. Can the states assert their authority and protect their own ⁤interests‍ in the face of⁤ a federal government that seems⁢ more interested in political posturing than actual governance? Will the Supreme Court stand up ⁢for the rights of the states and uphold the principle of federalism?

The outcome of the legal battle between Texas and the federal government will have profound implications for the future of our ⁣nation. If the Court rules in favor of Texas, it could embolden other states to assert their rights and challenge federal overreach on a ⁣range of issues. If the⁢ Court ⁤sides with⁤ the federal government, it could further erode the power of the states and⁢ consolidate power in⁣ the ⁢hands of the central government.

As the battle over the southern⁣ border continues to unfold, it is‍ clear that we ‍are at a tipping point in American history. The decisions made in the coming months and years will shape‍ the future of our nation and determine whether we remain a union of sovereign states ⁢or become a centralized government with limited state autonomy.

In Conclusion

President Biden’s failure to ⁣enforce the⁣ southern border has ignited a battle between Texas and the federal government. The conflict‌ has reached the Supreme Court, where the fate of American federalism hangs in the balance. The outcome of this case will⁤ have far-reaching implications for the balance of power ⁤between the states and the federal government. Will the states ‍be⁣ able to assert their authority and protect their own interests, or will the central government continue to erode their power? Only time will‌ tell, but one⁤ thing is certain – we are living in a pivotal moment in American history.

President Biden’s neglect of the southern border has caused chaos in Texas, now spreading nationwide.
