The lawsuit challenged the requirements for ART procedures such as in \u200bvitro fertilization, egg and sperm retrieval, and \u200begg and sperm cryopreservation.<\/p>\n<p>Previously, DOD and VA rules limited the use of morally and ethically \u2062prohibited reproductive procedures\u200b funded by taxpayers\u200b to married service members and veterans of the opposite sex who could use their own gametes and had received an infertility diagnosis linked to injury, illness, or a\u200d service-connected disability.<\/p>\n<p>However, when the National Organization for Women&#8217;s \u200dNew York City Chapter (NOW-NYC) \u200cfiled a federal complaint in August 2023, the\u2064 Pentagon changed \u2063its stance. NOW-NYC \u200balleged that the DOD and VA policies were arbitrary, unconstitutional, and violated the Affordable Care Act by not covering the\u2064 costs of overcoming \u200dnatural biological limits for soldiers who are LGBT, unmarried, or seeking to purchase sperm or eggs.<\/p>\n<p>Last week, the DOD \u2064signaled to the court that it planned to keep the injury or illness infertility requirement but would revise its TRICARE policies to allow soldiers to access \u200dtaxpayer-funded IVF, sperm, and \u2063egg purchases regardless of marital status or sexual orientation. These modifications are expected to be finalized in a memorandum by\u2062 the end of February.<\/p>\n<p>While the \u200dVA has not yet indicated any changes to its ART \u200cpolicies, NOW-NYC celebrated the DOD&#8217;s shift as a &#8220;big win&#8221; and the first step towards expanding taxpayer-funded \u200cART even further through <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-dismisses-parents-lawsuit-against-attorney-general-for-memo-describing-them-as-threats\/\" title=\"Federal Judge Dismisses Parents\u2019 Lawsuit Against Attorney General for Memo Describing Them as \u2018Threats\u2019\">future legal action<\/a>.<\/p>\n<p>&#8220;We will continue to challenge DoD and VA to remove all discriminatory barriers so that each and every service member and veteran who needs this reproductive \u200dcare can \u2064access it,&#8221; warned NOW-NYC \u2064Executive Director Sonia Ossorio in a \u200dstatement.<\/p>\n<p>This is not the first time activists have used lawsuits \u200dto compel taxpayers to assist individuals in intentionally creating children who\u200d are intentionally separated from their biological parents.\u200b In 2022, a gay couple in New York sued the city government for not meeting the \u200bcity&#8217;s definition of infertility. \u200bDespite both plaintiffs being male and biologically incapable of natural procreation, they argued that they met the medical definition\u2064 of infertility and were entitled to insurance benefits to \u200dpurchase eggs and rent a womb to have children.<\/p>\n<hr>\n<p>Jordan Boyd is a staff writer at The \u2064Federalist and co-producer of\u200c The Federalist Radio Hour.
