His [sentencing] range would be the same today if he had leaked only a \u2064single return.\u201d<\/p>\n<p>But instead of\u2064 seeking \u200bprison time for each of his offenses \u2014 or even for the two separate mass thefts he committed, one in \u200d2019 and another in 2020 \u2014 the DOJ\u2064 is asking a federal judge to sentence Littlejohn to just 60 months, the maximum for a single offense under the statute.\u2064 Some political leaders angry over the plea deal say he should get 60 years, not months, for his crime \u2014 \u2063the biggest heist of IRS taxpayer \u2064data in history.<\/p>\n<p>Attorneys for Littlejohn, 38, argue he\u00a0actually deserves an even lower sentence, closer to the presentencing report\u2019s range of\u200c four to 10 months, in part because he leaked the reams of stolen private income-tax data to \u201c<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ken-paxtons-impeachment-trial-attorney-tony-buzbee-complains-about-facial-tan\/\" title=\"Tony Buzbee, attorney for Ken Paxton's impeachment trial, criticizes facial tan.\">reputable news organizations<\/a> \u2014 The New York Times and ProPublica \u2014 that\u2062 he knew would handle the information\u2063 responsibly.\u201d They say a 60-month term is \u201cequivalent to a 15-level upward departure\u201d from the range prosecutors originally agreed to\u200b in the plea deal, and such a wide departure would be unprecedented.<\/p>\n<p>The D.C. judge deciding\u2063 Littlejohn\u2019s fate \u201cdoes \u2064not have unfettered \u200cdiscretion to depart from the applicable sentencing guidelines,\u201d Littlejohn\u2019s attorney Lisa Manning advised \u2064the court in papers\u2064 filed\u200c last\u2064 week.<\/p>\n<div class=\"fdrlst__b89e9-d838fe4930c73efd6536ff60b3d5665b fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-d838fe4930c73efd6536ff60b3d5665b\"><\/div>\n<p>U.S. District Judge Ana Reyes, a Biden appointee who has a\u2062 record of meting out\u2062 lenient \u200bsentences, will decide his punishment on Jan. 29.<\/p>\n<p>The Times \u2064and ProPublica published dozens of stories \u200bbased on the personal\u2063 tax files the <a href=\"https:\/\/www.realclearinvestigations.com\/articles\/2023\/10\/18\/leaker_of_trump_taxes_worked_for_biden_beltway_donor_that_just_won_a_big_new_irs_contract_986770.html\" target=\"_blank\" rel=\"noreferrer noopener\">former\u2063 Booz Allen Hamilton contractor<\/a> electronically smuggled out of the IRS.\u200c Those articles largely advanced Democratic calls for further investigations into \u200cTrump and the need to raise taxes on the wealthy.<\/p>\n<p>Against the\u200c backdrop of prosecutions of\u200c Donald Trump in an election year and the collapse of Hunter Biden\u2019s earlier no-jail plea deal,\u2064 which a Delaware\u2064 judge rejected \u200bbecause \u2063it was \u201cnot \u200bstraightforward\u201d and contained \u201catypical provisions,\u201d Littlejohn\u2019s plea agreement is raising new questions \u2062about the\u200b politicization \u200dof \u200djustice.<\/p>\n<p>Trump lawyer Alina Habba said Littlejohn\u2019s admission of guilt \u200clooks \u201cmore\u2063 like a Hunter Biden plea deal.\u201d House\u2062 Ways and Means Committee Chairman Jason Smith agreed, complaining he\u2019s getting off \u201cwith \u2064just a \u2062slap on the wrist.\u201d<\/p>\n<div class=\"fdrlst__b89e9-70dda652e2bb13fccd2d3fe67d57f372 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-70dda652e2bb13fccd2d3fe67d57f372\"><\/div>\n<p>At a minimum, the Missouri Republican argues, Littlejohn, a Democrat donor \u2063who sought to damage Trump soon after his 2016 election, should have been charged with \u200dtwo \u201cseparate and distinct\u201d unauthorized disclosures \u2063\u2014 one of Trump\u2019s returns to the Times in 2019 \u200dand the separate tranche of thousands of returns he delivered to\u2063 ProPublica in 2020.<\/p>\n<p>\u201cWhile\u2064 some argue that he should have been charged \u200dwith one count per\u200c taxpayer, it is clear to us\u200c that at a \u2063minimum he\u2064 should have been charged\u2063 with two counts of unauthorized\u200b disclosure and potentially with at least\u200d one \u200ccount of obstruction of justice,\u201d Smith wrote the DOJ\u200c in a recent letter, noting that\u200d Littlejohn took a number\u2063 of measures to foil investigators.<\/p>\n<p>Prosecutors say his victims total \u201cover 1,000.\u201d\u2063 But the number of taxpayers whose privacy he violated \u2063could run in the several \u200bthousand.<\/p>\n<p>According to recent court papers, Littlejohn rejoined Booz Allen in 2017\u200d with \u200cthe express purpose of getting assigned to \u2064the IRS and\u2063 stealing \u2064Trump\u2019s tax returns, which he downloaded in 2018. Then in June 2020, he began conducting searches of the IRS database to pull historic tax data on the wealthiest taxpayers in the country. Specifically, he constructed a query designed\u2063 to call up the \u200btop 500 taxpayers by income by\u2062 year for the previous 15 years. After running the \u200dquery, he stole the entire data \u200dset, \u200dput\u2062 it on a flash drive, and gave it to reporters at\u200c ProPublica, a left-leaning nonprofit funded \u2062by\u200c George Soros and other wealthy liberal donors. ProPublica, in turn, published\u200b nearly 50\u200c articles using the purloined tax returns to \u200cshow how the rich use loopholes in the tax code to avoid paying taxes. Congressional Democrats cited the series in \u200btheir \u200bpush for higher taxes on \u2063the wealthy.<\/p>\n<p>There are so many victims \u200dof Littlejohn\u2019s breach of \u2063protected taxpayer information \u2014 the largest in history \u2014 that DOJ has asked a federal \u200bjudge in \u200cWashington for permission to create a public website to notify victims without reaching out to each person\u2062 individually. Taxpayers will have to \u2063proactively search the site\u2063 to discover if their most <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ambush-trump-spox-taylor-budowich-sues-january-6-committee-and-pelosi\/\" title=\"'Ambush': Trump Spox Taylor Budowich Sues January 6 Committee -- and Pelosi\">private financial records<\/a> have \u2064been \u200ccompromised.<\/p>\n<p>\u201c[The] number of potential\u200b victims in \u2063this case makes it impracticable to provide all of the victims\u200c the rights provided under the Crime Victims\u2019\u2064 Rights Act,\u201d the\u200c department said.<\/p>\n<p>DOJ has notified only 152 victims of Littlejohn\u2019s crime. Thousands more high-net-worth \u200ctaxpayers remain in the dark\u2064 about whether the \u200crogue Booz Allen contractor shared their most <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-build-back-better-bill-includes-600-irs-reporting-provision\/\" title=\"House Build Back Better Bill Includes 0 IRS Reporting Provision\u00a0\">private financial data<\/a> with the media, which still\u200c possess the confidential \u200cinformation and continue to publish \u2063stories based on it.<\/p>\n<p>Littlejohn, who goes by \u201cChaz,\u201d did not just disclose income and tax data. He also leaked charitable donations, investments, stock trades, gambling winnings and losses, as well as the results of IRS\u200b audits \u2014 all with the hope\u200d that\u200b journalists would \u2063expose \u201csalacious details\u201d about Trump and other \u2064wealthy taxpayers, many of them Trump donors, according to the new \u200bcourt filings. This egregious \u200cinvasion of privacy was \u201ca core purpose\u201d of his steal-and-leak scheme.<\/p>\n<p>And the \u2064illegal invasions\u200b of privacy are ongoing. Neither the Times nor ProPublica \u2064has returned what Littlejohn stole from the IRS, despite requests from victims like billionaire hedge-fund manager Kenneth Griffin, \u200dwho is suing the IRS over the leak of\u200c his tax returns to\u2062 ProPublica.<\/p>\n<p>\u201cVictims have no assurance that their personal information will not \u200cbe\u200d the subject of a news article tomorrow, next week, next month or even next year,\u201d prosecutors told\u2062 the court\u2064 in their latest filing. \u201cThe harm\u200c arising \u2062from defendant\u2019s crime is accordingly so extensive and \u2062ongoing that it is impossible to quantify.\u201d<\/p>\n<p>Critics \u2064say \u2063such admissions only deepen their suspicion that Littlejohn was undercharged\u200d for political reasons.<\/p>\n<p>In the wake of other\u200d large thefts of confidential government \u2063information by politically inspired figures \u2014 including former Treasury official Natalie Mayflower Sours Edwards, who got a\u2062 plea negotiated six months after\u2063 leaking Trump-related bank\u2062 data to BuzzFeed \u2014 the Littlejohn case raises fresh\u2064 questions about the message the\u2063 government is sending to bureaucrats and others \u200bwho\u200c politically weaponize private financial information.<\/p>\n<p>\u201cWhen\u200d the criminal leaker was finally caught, we expected that he would face severe consequences for \u200chis actions that would both\u200c punish him\u2062 while also\u200b serving to deter future, similar misconduct,\u201d Smith wrote DOJ. A sentence of four to \u200c10 months \u2062\u201ccomes nowhere close to having a deterrent effect on government employees who might be thinking about breaking the law.\u201d<\/p>\n<p>Smith said the case only adds \u201cmore fuel to the fire\u201d to growing perceptions of a two-tiered system of\u200c justice in Washington where criminals who seek\u2064 to damage Trump get off easy, while those\u2062 who break the law supporting Trump \u2014 such as trespassing on restricted government\u2064 grounds \u2014 \u2063get the\u2064 book \u2064thrown at them.<\/p>\n<p>In 2021, for example, former FBI\u200b attorney Kevin \u2063Clinesmith received a sentence of 12 months <a href=\"https:\/\/www.realclearinvestigations.com\/articles\/2021\/12\/16\/dc_bar_lets_convicted_fbi_russiagate_lawyer_back_in_good_standing_as_court_cuts_him_more_slack_807964.html\" target=\"_blank\" rel=\"noreferrer noopener\">probation<\/a> for doctoring evidence so a Trump adviser could be spied \u200bon under the false\u2064 premise he was an agent for Russia. An Obama-appointed judge in D.C. sympathized with Clinesmith, a liberal Democrat \u2062who, internal FBI messages revealed, hated Trump.<\/p>\n<p>Echoing those \u2063on the\u200c left who hail Littlejohn as a \u201cwhistleblower\u201d and a \u201chero,\u201d his defense\u2019s lawyers are now\u2064 appealing to another Democrat judge in D.C. to give their client \u2064a pass because he acted\u2062 out of \u201cdeep, moral belief\u201d to expose Trump whom he viewed\u2063 as \u200d\u201cdangerous and a threat to democracy.\u201d In other words, the \u201cmoral\u201d end justified his criminal means.<\/p>\n<p>His lawyers further suggested he was influenced in his views and motivated to act by The New York Times, \u200dwhich\u200b ran articles demanding Trump release his tax returns \u200cbecause it suspected he could be hiding nefarious financial ties to Russia. The\u2064 paper\u2019s reporting had long pushed \u2064the \u2064false notion that Trump had financial ties\u200b to\u200c the \u2062Kremlin. <\/p>\n<p>Littlejohn\u2019s lawyer Manning noted in a motion asking the \u200bjudge for leniency that her client had\u200c been faithfully \u200dreading the paper and \u201cmade up his mind\u200d to act\u201d in\u200b response to the steady stream of anti-Trump articles it \u2062published. (Manning is a partner in \u200dthe Washington law firm that\u2062 represented\u200b Trump-Russia\u200c dossier fabricator Igor Danchenko.)<\/p>\n<p>Between May 2019 \u2063and\u2063 August 2019, Littlejohn huddled multiple\u2063 times with Times reporters about how they would\u00a0publicize Trump\u2019s\u00a0stolen tax records.<\/p>\n<p>\u201cBased on his\u200b discussions with the reporters,\u201d Manning said, \u201cMr. \u2062Littlejohn\u200c felt\u2063 that \u2064the New York \u2063Times shared his belief that the\u2062 American public had a right to know the president\u2019s tax information.\u201d<\/p>\n<p>Following a\u2062 meeting in June, one of \u200cthe Times reporters (unnamed) wrote to Littlejohn: \u200d\u201c[I]t was great meeting\u200d you last night. That was a (really) big step, and we respect the courage it took. I hope we land on a good \u2062path forward.\u200d I completely respect your concerns and want you \u200bto feel right about any decision \/ decisions you \u200cmake\u2026 I can\u2019t help but reflect that it\u2019s\u200b something the three of us ended up together last night because a \u2064certain person\u200c won\u2019t disclose information that\u200b people absolutely\u200c need to see and have for decades. I appreciate you share this concern and recognize one person can make a difference.\u201d<\/p>\n<p>On \u200cSept. 27, 2020 \u2014 five weeks\u200d before the election \u2014 the Times published data from 15 years of Trump\u2019s tax records\u200c in a more than 10,000-word story headlined,\u2063 \u201cLong-concealed records show Trump\u2019s \u2063chronic losses \u2063and \u200dyears of tax avoidance.\u201d Times reporters Russ Buettner,\u200b Susanne Craig, and Mike McIntire shared \u2062a byline on \u2063the piece. The Times noted that \u2063none of the stolen IRS records revealed \u201cany previously unreported connections to Russia.\u201d<\/p>\n<p>Trump lawyer \u2064Habba\u200c said she suspects Littlejohn was an operative in a broader political conspiracy\u2062 to sabotage the former president before the 2020 election. \u201cWhat Mr.\u200c Littlejohn did, I do not believe he did \u200dalone,\u201d she said. Habba added that the leak probably \u201ccost\u200c my client thousands of votes \u200dand was all\u2064 by design.\u201d<\/p>\n<p>Court filings reveal Littlejohn\u200d didn\u2019t just steal Trump\u2019s tax filings but also those of \u201centities and\u2064 individuals\u201d related to him.\u2062 It\u2019s \u2063not clear if the tax returns of Trump\u2019s family members were also leaked.<\/p>\n<p>In mid-2017, \u200bLittlejohn reapplied for a job at Booz Allen,\u200c where he had worked previously,\u2062 \u201cwith the goal of getting \u2062access to\u201d Trump\u2019s tax returns\u200b so he could leak them to the press, according to DOJ\u2019s new\u2064 sentencing memo. (DOJ does not identify \u2062Booz Allen by name in the document, but instead refers to Littlejohn\u2019s employer as \u201cCompany\u200b A.\u201d However, in \u200ca separate <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.625155\/gov.uscourts.flsd.625155.89.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">filing<\/a> last week involving Griffin\u2019s civil case, the DOJ\u2019s tax division stated that Littlejohn was \u201ca contractor employed by Booz Allen Hamilton,\u201d \u200dconfirming RealClearInvestigations\u2019 <a href=\"https:\/\/www.realclearinvestigations.com\/articles\/2023\/10\/18\/leaker_of_trump_taxes_worked_for_biden_beltway_donor_that_just_won_a_big_new_irs_contract_986770.html\" target=\"_blank\" rel=\"noreferrer noopener\">reporting<\/a> last \u2063October.)<\/p>\n<p>Booz Allen rehired \u2063Littlejohn in September 2017, three months after former FBI \u2064Director Robert Mueller handed the\u2062 McLean, Virginia-based contractor a report into its weak security procedures \u2014 including lapses in\u2064 how it \u200cscreens employees for potential threats. \u201cWe are committed to doing our part to detect potential insider threats,\u201d the \u2063company stated at the time.<\/p>\n<p>The company \u200cin 2016 had retained Mueller\u200c \u2014 who\u2062 would go \u200bon to be the\u200b Russiagate special\u2063 counsel\u00a0\u2014 \u200cafter one \u2063of its computer analysts, Harold Martin III, \u2062was arrested for stealing data\u2062 from the National\u200c Security Agency. The breach occurred \u200dthree years after another Booz Allen analyst, Edward Snowden, fled the country with thousands\u200d of top-secret documents that he soon leaked\u200d to \u200bjournalists, exposing the NSA\u2019s worldwide anti-terror surveillance program.<\/p>\n<p>In\u200b February 2018, after Mueller\u2019s recommendations, the company granted Littlejohn access to unmasked taxpayer\u2064 data, whereupon he immediately began to develop a plan to secretly download Trump\u2019s tax returns from an internal IRS database.<\/p>\n<p>In an RCI\u200d interview,\u2063 Booz Allen spokeswoman Jessica \u2064Klenk declined to say what, if any, reforms it implemented after the Mueller review to safeguard such sensitive information. She also would not discuss any steps taken to vet\u200b and\u2064 monitor \u2062Littlejohn to determine whether he posed a security threat before and after assigning\u2063 him to work on IRS computers. But in a company\u200b statement, Booz Allen said it \u201cfully supported the U.S. government in its investigation into this matter.\u201d<\/p>\n<p>\u201cWe condemn in the strongest possible\u2063 terms the \u200dactions of\u200b this individual, who was active with the company years ago,\u201d\u2064 the statement\u2064 continued. \u201cWe have zero \u200ctolerance for violations of the law\u200d and operate under\u2064 the highest ethical and professional guidelines.\u201d<\/p>\n<p>Booz Allen employs more than 20,000 consultants with government security clearances handling some of the nation\u2019s most confidential data.<\/p>\n<p>The most profitable government contractor in the world, Booz Allen has been connected to a number of high-profile Democrats over the years, including former employee James Clapper, who served as\u200c President Obama\u2019s intelligence czar.  <\/p>\n<h2 class=\"wp-block-heading\">Activist Camouflaged as Bureaucrat<\/h2>\n<p>At least two Obama administration alumni sit\u200d on Booz Allen\u2019s board. President Clinton\u2019s IRS commissioner also holds a seat. In the 2020 election cycle, federal records show Booz Allen \u200ccontributed a total of $238,776 to Joe Biden versus $85,657 to Trump. The company also gave \u200balmost four times more money \u2063to the Democratic National Committee than to the Republican National Committee.<\/p>\n<p>Despite Booz Allen\u2019s track\u200b record of security breaches, the Biden administration has trusted it to help modernize\u2063 the\u2063 entire IRS computer system. Even as federal investigators were closing in on Littlejohn this summer, the Biden administration\u2019s IRS decided to rehire his employer to update its databases. The seven-year contract, with a ceiling value \u200cof $2.6 billion, involves\u200c consolidating roughly 400 different systems into a new, cloud-based architecture. That means Booz Allen employees will have access to IRS data through 2030.<\/p>\n<p>The massive new IRS contract may explain why DOJ has been reluctant to identify Littlejohn\u2019s employer by name in court papers and press\u200d releases\u200b about the case. The\u2063 Washington media have largely\u200c gone along with the blackout, describing Littlejohn only as an \u201cIRS contractor\u201d\u2062 while explaining to their audiences that his employer \u2063\u201cwasn\u2019t identified\u201d by the \u2062government.<\/p>\n<p>\u201cThat\u2019s troubling,\u201d said Susan Shelley, spokeswoman for Howard Jarvis Taxpayers Association, a taxpayer advocacy group. \u201cThe\u200c House Ways and Means\u2063 Committee should take a very close look at that contract.\u201d<\/p>\n<p>The tax-writing body is demanding more answers.
