They\u2019ve been doing this for \u2062a while. Yet the federal government has objected to \u2063the\u200c fencing they\u200c put in the middle of the Rio Grande barriers.<\/p>\n<p>So Abbott issued \u200da \u200chistoric letter in the face of a constitutional crisis \u2063that \u2064has\u2064 been created entirely \u2063by Joe \u200bBiden and his evil activities \u2064on the border.<\/p>\n<p>It is evil not to enforce the\u200c border of\u2062 your country, to purposefully leave the border \u200bwide open, which is what \u200bBiden has done.<\/p>\n<p>I\u2019ve \u2063been down to the border. \u2063It is, indeed, wide open, \u200cand that facilitates the\u2064 incentivization of drug cartels\u2064 to pour millions of people into the United \u2062States and move \u200ctons of fentanyl across the\u2063 southern border, <strong>the cause of over 100,000 American deaths a year<\/strong>.<\/p>\n<p>This is Biden abandoning his constitutional \u2064duties and abdicating the\u2064 presidency of the United States.\u2062 It\u200b is \u2062evil\u200c for\u2062 the president of \u200cthe United\u2062 States to do such. The\u2063 equivalent would be if\u200c a mayor of a large city simply announced they\u2063 are \u2064not going to police \u2062crime anymore. \u2063The\u2063 fundamental duty of\u200c the federal government is to protect the \u2062people and the borders of \u200cthe United States of \u200cAmerica.<\/p>\n<p>It \u200bis a \u200dfederally mandated duty for the government of the United States to do that. It is a federal issue \u2014 not a\u2062 state issue. Biden has not only signally failed, but he\u200d has also done \u2062the opposite of good. He has <i>facilitated<\/i> all of this \u2014 with terrible border policy. It is wrong. It should be against\u200b the law. The federal \u200bgovernment has one job and one job only in \u200dthe end: to protect \u2064you,\u200c to protect your rights.<\/p>\n<h3><strong><a href=\"https:\/\/www.dailywire.com\/episode\/ep-1891-border-standoff-texas-fights-back-member-exclusive\" target=\"_blank\" rel=\"noopener\">WATCH: The\u2063 Ben Shapiro \u200cShow<\/a><\/strong><\/h3>\n<p>Laws preventing illegal immigration have been in place for\u2062 decades in the\u200d United \u2062States. It is \u200cup to the president of the United States to enforce those laws. Again, it is worth noting \u200dthat\u2063 leaving the border wide open is not\u2062 just incentivizing\u2062 Mexican drug cartels to move millions of people across the southern border, but it is \u2063also \u200dincentivizing them to \u200cmove tons of fentanyl across the southern border, \u200bwhich is effectively\u2063 killing 100,000 Americans a year.<\/p>\n<p>Biden has\u2062 turned \u200bBorder Patrol into a ferry service\u2062 for \u2064illegal immigration. Members of Border Patrol will\u200b openly say that is what they \u2062are now. Their job used to be to track down people who were\u200c illegally crossing \u200dthe border so they could be \u200cdetained and then \u200bdeported. \u200dNow, their job\u2062 is to act as a facilitation\u2064 service\u200b for illegal \u2062entry into the\u200d country.<\/p>\n<p>The\u2062 first part \u200dof Greg Abbott\u2019s letter <a href=\"https:\/\/gov.texas.gov\/uploads\/files\/press\/Border_Statement_1.24.2024.pdf\" target=\"_blank\" rel=\"noopener\">reads<\/a>:<\/p>\n<blockquote>\n<p><i>The federal government\u2064 has \u2063broken the compact between the United States and \u2062the States. \u200cThe\u200d Executive\u2063 Branch of the\u2062 United States \u2064has \u200ca \u2064constitutional duty\u200b to \u200cenforce federal laws protecting States, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/550-active-duty-troops-arrive-at-southern-border-but-arent-allowed-to-help-in-apprehending-illegals\/\" title=\"550 troops arrive at southern border but can't assist in catching illegal immigrants.\">including immigration laws<\/a> on the books right now. President Biden has refused to enforce those\u200d laws and has even violated\u2063 them. The result is\u200b that he has smashed\u200c records \u200cfor illegal immigration.<\/i><\/p>\n<p><i>Despite having been \u200bput on notice in a \u200bseries of letters\u2014one of \u2062which I\u2063 delivered to him by hand\u2014President Biden has ignored Texas\u2019s demand that he perform his\u2062 constitutional\u200b duties.<\/i><\/p>\n<ul>\n<li><i>President Biden has violated his oath\u200b to\u200c faithfully execute immigration laws enacted by Congress. Instead of prosecuting immigrants for the federal crime of\u200b illegal entry, President Biden has sent his\u200b lawyers into federal \u200bcourts to\u200c sue Texas\u200b for \u200btaking \u2064action to secure the border.<\/i><\/li>\n<li><i>President Biden has instructed\u200b his agencies to ignore \u200bfederal\u200c statutes \u200bthat\u200b mandate the detention\u2063 of\u2064 illegal immigrants. \u200dThe effect is to illegally allow \u200dtheir <strong>en masse<\/strong> parole\u2064 into the United\u200c States.<\/i><\/li>\n<li><i>By <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sounds-like-a-woke-political-agenda-bidens-new-office-of-environmental-justice-blasted-for-wasting-taxpayer-money\/\" title=\"\u2018Sounds Like A Woke Political Agenda\u2019: Biden\u2019s New \u2018Office Of Environmental Justice\u2019  Blasted For Wasting Taxpayer Money\">wasting taxpayer dollars<\/a> to tear open Texas\u2019s border \u200dsecurity infrastructure, President Biden has enticed illegal\u2062 immigrants away from the 28 legal entry points along this\u200b State\u2019s southern\u200d border\u2014bridges where nobody drowns\u2014and into the dangerous \u2064waters of the Rio Grande.<\/i><\/li>\n<\/ul>\n<\/blockquote>\n<p>That \u200bis true. Drug\u2063 cartels don\u2019t actually want illegal immigrants processed at these stations.\u200d Rather,\u200c they \u2062want\u200c to \u200bflood certain border\u200b points\u200c so as to\u2062 draw \u2064the Border Patrol to \u2062those areas where it \u2064is their\u200c duty to care for the illegal immigrants entering the country and claiming asylum.<\/p>\n<p>If \u200cyou take all the \u2062people spaced along the border, with\u2064 very few border patrol\u2062 agents trying to\u200d maintain eyes on miles \u2064of the border, and then\u200b you\u200c suddenly centralize \u200cthe \u2062agents at one point \u200bwhere the illegal immigrants are rushing across, that leaves the\u200b rest of\u2062 the\u2062 border wide open. And that\u2019s where\u2062 you get drug smugglers \u2062being shifted across by the\u2063 drug cartels.<\/p>\n<p>Abbott continues:<\/p>\n<blockquote>\n<p><i>This illegal refusal to protect the States has inflicted unprecedented harm on the People \u2064all across the\u2064 United States. James Madison,\u2063 Alexander Hamilton, and the other visionaries who \u2062wrote the U.S. Constitution foresaw \u200dthat States should \u200dnot be left to the mercy of a lawless\u2063 president who does nothing to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/abbott-texas-has-a-constitutional-right-to-defend-its-sovereignty\/\" title=\"Abbott: Texas has the right to protect its sovereignty\">stop external threats<\/a>\u2062 like cartels smuggling millions of illegal immigrants \u200cacross the border.<\/i><\/p>\n<p><i>That is\u200d why the Framers included both \u200dArticle IV, \u00a7 4, which promises that\u200c the \u200bfederal government \u201cshall protect\u200c each [State] \u200bagainst invasion,\u201d and Article I, \u00a7 10, Clause 3, which acknowledges \u201cthe States\u2019 sovereign\u2062 interest in protecting \u2064their borders.\u201d \u2026<\/i><\/p>\n<p><i>The failure of the Biden Administration to fulfill the\u2063 duties imposed by Article \u2063IV, \u00a7 4 has triggered Article I,\u2063 \u00a7 \u206410, Clause 3, which reserves \u200cto\u200c this\u200c State the right of self-defense. For these reasons, I\u200d have already declared\u200c an\u2063 invasion under Article I, \u00a7\u200b 10, Clause 3 to invoke Texas\u2019s constitutional authority to defend and protect \u200bitself. That authority is the supreme law \u2062of the \u200dland \u2064and supersedes any federal\u200b statutes to the contrary.<\/i><\/p>\n<\/blockquote>\n<p>Abbott has \u2064done nothing to violate the\u200b law\u200b thus far. Nothing. He has <i>not<\/i> violated federal law.<\/p>\n<p>People are accusing him of having done so because he had Texas state troopers put \u200bout razor wire in state parks; those people don\u2019t know \u2063what \u2064they\u2019re \u200ctalking about. The\u2063 Supreme Court \u200cruled recently that the federal government has \u2062the \u2063capacity to withdraw the razor wire,\u200d but \u200dthey said \u2062nothing about whether the state of Texas is allowed to\u2062 put\u200c up the razor wire. The Supreme\u200b Court did not rule\u2062 that it was\u2063 illegal for the state of Texas to, for example, put barriers in the Rio Grande. They\u2064 just ruled that\u2062 the federal government is allowed \u200cto \u2064remove those \u2063barriers.<\/p>\n<p>Anyone who says Texas is doing something illegal is incorrect.<\/p>\n<p>Here\u2019s the deeper issue: whether the state of \u2062Texas\u200d can unilaterally enforce immigration law,\u2064 even if \u200dthe \u2062federal\u2064 government wants them not to.<\/p>\n<p>In 2010, the \u2062state\u200c of Arizona passed a \u2062law called SB 1070. The law contained four provisions.<\/p>\n<ul>\n<li>The \u200cfirst\u2063 provision was that it created a state level crime for being unlawfully\u2064 present in the\u2062 United States.\u200c You\u2064 would be prosecuted by the \u2064federal government and \u2064deported. It would be a state law crime.<\/li>\n<li>Second, it \u2062created a state law crime for working\u2064 or seeking to work when you weren\u2019t \u2062authorized\u200c to do so. It\u2019s\u2062 a federal\u200c crime for \u2062people to use a false Social Security number, for example,\u200b to \u2063work illegally in \u200bthe United States.\u2062 This created a comparative \u2063state law crime\u200d based \u2062on that.<\/li>\n<li>Third, it required state and local officers to verify\u2062 the citizenship or \u200dalien\u2062 status of anyone who was lawfully arrested\u200b or detained, an anti-sanctuary \u2064city policy. If\u200d you were a \u2064cop\u2062 and \u200byou pulled somebody\u200b over, you\u200c would\u2062 have to\u200d check whether they were legally here or not.<\/li>\n<li>And fourth, the law authorized\u200b warrantless arrests\u200d of aliens believed to be removable\u200b from the United States. So you could\u200d just arrest \u2063people and then presumably \u2064you would turn \u200dthem over to the federal \u2064government.<\/li>\n<\/ul>\n<p>The question on\u200d the\u2063 table was whether federal preemption prevented those \u200claws from taking effect. When \u200ca state law \u200bcomes\u200c into conflict with\u200b the federal law, the state \u2063law loses. The \u2063federal \u2064law \u2014 federal preemption \u2014 is \u200bactually a little bit broader in that it says a\u200b federal\u2064 law takes\u200c up \u200ca certain portion\u2064 of the law. If it occupies that \u200bportion of the law, the state laws cannot come into \u200dconflict with it.<\/p>\n<p>So the court in\u2064 the Arizona case\u2063 found items one, two, and four \u200bwere in violation of the \u2062Constitution. Justice Scalia\u200d dissented, <a href=\"https:\/\/www.nationalreview.com\/2012\/06\/defining-characteristic-sovereignty-antonin-scalia\/\" target=\"_blank\" rel=\"noopener\">saying<\/a>, \u201cToday\u2019s opinion, approving virtually all of the Ninth \u2062Circuit\u2019s injunction against enforcement of the \u2063four challenged provisions of Arizona\u2019s law,\u2063 deprives States of\u200b what most would consider\u2064 the \u200cdefining characteristic\u2063 of\u2062 sovereignty: the power to exclude from the sovereign\u2019s territory people who \u2064have no \u2062right to be there. \u2026 The naturalization power was given to Congress not to abrogate States\u2019 power to exclude those they did not want, \u200bbut to vindicate it.\u201d<\/p>\n<p>He was referring\u200c to the original reason \u200cimmigration law was given\u2064 to\u200b the federal government: Everybody at the beginning\u2064 of the Republic was very much afraid \u2064of what has happened in the EU \u2014\u200b where one country has open immigration policies, another says they don\u2019t want all these \u200dimmigrants coming \u200dinto their country, but the EU says they must accept them.<\/p>\n<h3><strong><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener\">CLICK HERE \u200bTO GET THE \u2062DAILY WIRE APP<\/a><\/strong><\/h3>\n<p>So \u200cthe federal\u200b government \u200btook control of\u2062 this to\u2064 make homogenous\u200c immigration law around the United States, where there would be freedom \u2063of travel and freedom of \u2063residency. But in order for that\u200c bargain to be upheld, \u2064the federal government actually <i>does have to police \u2064the border<\/i>.<\/p>\n<p>That\u2019s particularly\u2064 true\u200d when \u200dlaws on the books say\u2064 the border must be \u2063policed. It would be one thing if the federal government had\u200c passed laws saying\u2062 we basically have open immigration at this time, because presumably those federal laws would have been part of \u200da Constitution that was signed on to by the states. \u2063But it is another \u2063thing for the federal \u200bgovernment to have laws on\u2063 the books \u200brequiring policing the\u200d border and \u2063removing illegal\u2064 immigrants, but the executive branch says, \u201cNo, we\u2019re not going to do it because now you\u2019ve abrogated the compact.\u201d<\/p>\n<p>Scalia said \u200bin that case, in the dissent, the \u2064reason the \u2064entire issue was federalized was \u200cto prevent open migration to one state from affecting all the \u2064states.<\/p>\n<p>That\u2019s basically what Greg Abbott is \u2064arguing in this letter. \u200bAnd he\u2019s right.<\/p>\n<p> <\/p>\n<h2> What is \u2064the court&#8217;s ruling on the Arizona statute and \u200dthe state&#8217;s ability to enforce its own immigration\u200c laws?<\/h2>\n<p><span>  The Arizona statute, deprives States of\u2063 what\u200c most would consider the defining characteristic \u2064of sovereignty: the power\u2064 to exclude from the sovereign&#8217;s territory people who \u200bhave no right\u2064 to be there.&#8221;\u2063 The court held that \u2063the federal government has exclusive authority over immigration laws and\u2062 that the state of Arizona \u200bcannot enforce its \u2062own immigration\u200d laws.<\/p>\n<p>But\u2063 does \u200dthat \u2063mean that states cannot take \u2062any action on immigration issues? The court did acknowledge in its decision that states have a role \u2063to play in addressing immigration \u2063concerns and\u200d that\u200b they can cooperate with federal authorities. As Justice Kennedy\u2063 wrote in\u200c the majority \u2063opinion, &#8220;The National Government has \u200bsignificant power to regulate immigration&#8230;The States have the power to supplement the federal law, and if necessary, to challenge it in court.&#8221; This means that while states cannot create their own \u200cimmigration\u2062 laws \u200bthat \u2063conflict\u2063 with federal\u2062 law, they still have the \u200bability to support and assist in the\u200b enforcement of federal immigration laws.<\/p>\n<p>This brings us back to Governor Abbott and his letter. \u200bAbbott is not\u200d creating new immigration laws or policies for the\u2063 state of Texas. He is simply\u200d stating\u2063 that \u200dthe state will\u200c start enforcing the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/congresswoman-lauren-boebert-conservatives-are-ready-to-govern\/\" title=\"Congresswoman Lauren Boebert: Conservatives Are Ready to Govern\">existing federal immigration laws<\/a> that the Biden administration has neglected. And he is well within his rights to do so.<\/p>\n<p>Abbott&#8217;s letter is not \u2062just a political move. It is a response to a crisis that is happening at the\u200b border. The\u2064 influx of illegal \u200cimmigrants and the smuggling of drugs \u2063across the border have serious consequences and pose a threat to the \u2064safety and security of the American people. It is the responsibility \u200dof \u2062the federal government to address these issues and protect the American people, but they have failed to do so.<\/p>\n<p>Governor Abbott is\u2063 taking a stand against Biden&#8217;s border policies\u200d because he believes that it is his duty to protect the people of Texas and uphold the law.\u2063 He \u200bunderstands that \u2063the federal government&#8217;s failure to enforce \u2064immigration laws \u200chas led to\u2062 a\u2062 constitutional crisis \u200cand\u2063 put the \u2064American people at risk. And\u200d he is willing to take action to address \u200bthis crisis.<\/p>\n<p>In conclusion, Governor Abbott&#8217;s letter \u200cis a bold and necessary response to the \u200cnegligence\u200b of the\u2064 Biden administration in enforcing immigration\u2063 laws. He\u200c is not\u200d creating new laws or policies, but\u2062 simply stating that Texas will start enforcing the existing federal laws that have been \u2063ignored. And he is well within his rights to\u200c do so, as states have the ability to support and assist in the enforcement of federal immigration laws.
