For months, Willis wore the crown of the \u200ccountry, being \u200b <a href=\"https:\/\/theatlantavoice.com\/atlanta-business-league-honors-da-fani-willis-at-super-tuesday-conference\/\" target=\"_blank\" rel=\"noreferrer noopener\">honored<\/a> \u200b everywhere from the local Atlanta Business League to the Apollo Theater in Harlem, where she <a href=\"https:\/\/nypost.com\/2023\/12\/04\/news\/trump-prosecutor-fani-willis-to-host-nyc-campaign-fundraiser\/\" target=\"_blank\" rel=\"noreferrer noopener\">received<\/a> the title \u200bof 2023\u2019s Most Influential Black American. She was \u2063 <a href=\"https:\/\/www.11alive.com\/article\/news\/local\/fulton-county-da-time-person-of-the-year-nomination\/85-cfb6b530-a160-4ebe-bdac-d4a54bf556a1\">reportedly<\/a> even up for Time\u2019s\u200d Person of the Year.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1922478863\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-d0bfe598d9c1387ce2b4578f6d883b16 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-d0bfe598d9c1387ce2b4578f6d883b16\"><\/div>\n<h2 class=\"wp-block-heading\">What\u200d a Difference a Scandal Makes<\/h2>\n<p>But now The \u200bNew York Times has run an <a href=\"https:\/\/www.nytimes.com\/2024\/01\/24\/opinion\/fani-willis-trump-georgia.html\" target=\"_blank\" rel=\"noreferrer noopener\">op-ed <\/a>calling for\u2064 Willis to \u2064take a leave of absence\u200c from the Fulton County\u2063 district attorney\u2019s office.<\/p>\n<p>Wednesday\u2019s \u200copinion\u200b piece, \u201cWhy Fani Willis Should Step Aside \u2064in the Trump Case in Georgia,\u201d authored by \u2062Clark Cunningham, a professor of legal ethics \u2063at Georgia State University, follows \u2062from the growing scandal \u2063surrounding Willis\u2019 hiring of Nathan Wade as special prosecutor in\u200d her targeting of \u200cTrump and his co-defendants.<\/p>\n<p>According to a joint motion\u200d to \u2062dismiss\u2064 and motion to disqualify <a href=\"https:\/\/documentcloud.org\/documents\/24354598-010824-defendant-michael-romans-motion-to-dismiss-grand-jury-indictment-as-fatally-defective-and-motion-to-disqualify-the-district-attorney-her-office-and-the-special-prosecutor-from-further-prosecuting-this-matter-motion-6\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a> earlier this month \u200bby\u200b defendant Michael Roman \u2014 the Trump 2020 campaign\u2019s \u2062director of Election Day \u200doperations \u2014 Willis was having an affair with\u2064 the still-married Wade when she hired him as a special prosecutor. Roman\u2019s motion also charged that Willis personally benefitted from the money\u200c paid to her alleged lover because Wade then used those taxpayer \u200cfunds to pay for Willis \u2063to accompany \u2063him on vacations on both the Norwegian and Royal Caribbean cruise\u200c lines.<\/p>\n<p>Roman\u2019s\u200c motion\u200c alleged that Willis appointed \u2064Wade to serve as a\u200d special prosecutor without the approval of the Fulton County\u200c Board of Commissioners\u2064 and even though the district attorney\u2019s office had many more qualified attorneys already on staff. Yet from Nov. 1, 2021 to Oct. 31, 2022, Willis paid Wade nearly $300,000 \u2014 $100,000\u200b more than Willis\u2019 annual salary \u200cof $198,266.66.<\/p>\n<div class=\"fdrlst__b89e9-282ca45e86ee5857ba6badf080b0ee70 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-282ca45e86ee5857ba6badf080b0ee70\"><\/div>\n<p>Since Oct. 31, 2022, Willis\u2064 has entered additional successive contracts with Wade, setting a $250-per-hour \u200dbilling rate for her\u200c alleged lover. According to Roman\u2019s motion, \u200dto date, Willis has likely paid \u200bWade close to or\u200d more than $1 million. These facts establish a disqualifying\u200c conflict of interest, Roman posits, as they both have \u200da personal interest and \u200cstake in Roman\u2019s conviction. \u200cThat conflict, the defendant argues, deprives him of his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/group-our-vote-matters-is-suing-facebook-dominion-mark-zuckerberg-certain-state-officials-others-for-infringing-upon-right-to-vote-assemble-and-speak-freely-you-can-jo\/\" title=\"Group \u201cOur Vote Matters\u201d Is Suing Facebook, Dominion, Mark Zuckerberg, Certain State Officials, Others for Infringing Upon Right to Vote, Assemble and Speak Freely \u2013 You Can Join Too\">due process rights<\/a> to a fundamentally fair trial.<\/p>\n<h2 class=\"wp-block-heading\">The Left Claims No Conflict<\/h2>\n<p>After news of the alleged affair quieted somewhat, we saw the first effort \u200dto safeguard the prosecution of Trump and his co-defendants by the Fulton County \u200ddistrict attorney\u2019s \u2062office.\u200c The\u200d anti-Trump online forum Just Security led the effort with a veritable treatise\u2064 on Georgia\u2019s \u2064law on prosecutorial disqualifications.\u2063 The nearly\u2062 4,000-word article <a href=\"https:\/\/www.justsecurity.org\/91368\/why-fani-willis-is-not-disqualified-under-georgia-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">presented<\/a> the case for \u201cWhy Fani Willis \u2064Is Not Disqualified Under\u2063 Georgia Law.\u201d<\/p>\n<p>In \u2063it, \u2064the Just Security authors\u200b bemoaned\u200d the\u2062 consequences\u2063 of an \u201cunfounded disqualification of Willis.\u201d Willis\u2019 disqualification,\u200c they argued, would \u201cunjustifiably threaten to delay the \u200ccase unnecessarily\u2063 \u2026 because when the \u2063District Attorney herself \u200bis disqualified, the matter is transferred to the\u00a0Prosecuting \u200cAttorneys\u2019 Council \u200dof\u2064 the State of Georgia for reassignment.\u201d<\/p>\n<p>On\u2062 the\u2064 other hand, \u201cif Willis were otherwise\u200c sanctioned \u2063by ethics or county government authorities as a result of \u200dany separate inquiries (e.g. \u200cinto her \u2063hiring decision\u200d involving Wade), it would not have this\u2063 effect,\u201d\u200d the article noted, in\u200b a \u200dnot-so-subtle suggestion\u200c on how the \u200bcourt can split the \u2063baby here. Then the case can remain in the Fulton County\u2062 district attorney\u2019s office, the article concluded.<\/p>\n<div class=\"fdrlst__b89e9-ef0ee1ebc299542e3a4ef508cc934a79 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-ef0ee1ebc299542e3a4ef508cc934a79\"><\/div>\n<p>But why would that matter? The authors tell us:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>A likely delay \u2062in the prosecution of Trump\u200b and his co-conspirators occasioned by moving the case is inconsistent with the public\u2064 interest. There is a paramount\u200c need to resolve the\u2063 question as soon as possible of \u200dwhether Trump\u2064 previously\u2064 criminally abused the \u200coffice he \u2062is seeking \u2063to recover.<\/p>\n<\/blockquote>\n<p>In \u2063other words, \u200bto ensure Trump is \u200bconvicted before the\u200c November 2024 election, Roman\u2019s motion to disqualify\u200d the Fulton County DA\u2019s office must be \u200ddenied.\u2064 But to placate the public, Wade should voluntarily resign, \u200bthe\u2064 article suggested in compromise.<\/p>\n<p>Wednesday\u2019s op-ed in \u200bThe New York Times similarly stakes out the position that the \u2063prosecution of Roman and his co-defendants, particularly Trump, \u200dmust \u200ccontinue in Fulton\u200d County \u2014 so much \u2062so that to\u2064 avoid the \u2062risk of an independent prosecutor being appointed by the\u00a0Prosecuting Attorneys\u2019\u200d Council of the State of Georgia, the author entreats Willis \u201cto\u200d take a\u200d personal leave of absence and \u200cturn over \u200ccontrol of\u2063 the district attorney\u2019s office, and the case against Mr. Trump, to a career deputy district attorney.\u201d<\/p>\n<p>The author,\u2063 Clark Cunningham, explains this\u2063 recommendation\u2062 flows from his\u200c study of \u201cthe\u200d legal consequences that might come if\u200c Ms. Willis and Mr.\u2062 Wade are found to have a conflict.\u201d Taking a personal leave rather than \u200brisking the court disqualifying the entire Fulton County DA\u2019s office,\u2063 Cunningham claims, \u200dis \u201cthe\u200c judicious and \u2062farsighted course\u201d\u2063 of \u2064action for Willis. Cunningham even\u2062 called it \u201can act of public service by Ms. Willis,\u201d explaining it \u201coffers the best option \u200cfor keeping the criminal case on track\u200b and holding\u2062 Mr. \u2062Trump and his\u200b co-defendants accountable for their \u2063actions in \u200bthe 2020 election if that is the \u2064just outcome.\u201d<\/p>\n<p>But in \u200cexplaining how that is \u201cthe best option,\u201d Cunningham gives away his game \u2014 that it is not\u2063 necessarily \u2062a \u201cjust outcome\u201d \u200dhe wants, but a conviction\u200b of Trump and one that arrives before the \u20622024 election.<\/p>\n<p>If presiding \u200cJudge Scott McAfee grants Roman\u2019s motion, \u201cit could\u200c bring the entire case \u200dto a \u2064halt,\u201d \u2063the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/harvard-study-homeschoolers-generally-become-well-adjusted-responsible-young-adults\/\" title=\"Harvard Study: Homeschoolers Generally Become \u2018Well-Adjusted, Responsible\u2019 Young Adults\">op-ed explained<\/a>, stressing that \u201cunder Georgia law, if a district attorney is disqualified, <a href=\"https:\/\/law.justia.com\/cases\/georgia\/supreme-court\/2014\/s14a0220.html\" target=\"_blank\" rel=\"noreferrer noopener\">so is the \u200dentire staff of \u2064the district attorney\u2019s office<\/a>.\u201d And unlike the Just Security analysis of the conflict of interest, Cunningham\u2064 sees a real risk in the disqualification of Willis and her office.<\/p>\n<p>As Cunningham put it, \u200dthe defendants will argue \u200dWillis \u201cacquired\u200c a personal interest \u2062or stake\u201d in their convictions, with Trump and his alleged \u200bco-conspirators likely\u200b arguing, \u201cMs. \u200dWillis and Mr. Wade concocted the extensive \u200cspecial grand jury \u200cinvestigation \u2014 which has spanned\u2063 about seven\u200c months and\u200c involved some 75 witnesses \u2014 and the subsequent\u2062 98-page, 41-count\u2063 indictment against 19 defendants, to make money for themselves by enabling Mr. \u2062Wade to bill the D.A.\u2019s office more than $650,000 for working\u2062 on both the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gaetz-set-to-introduce-bill-to-defund-jack-smith-investigation-into-trump\/\" title=\"Gaetz to propose bill cutting funds for Trump investigation by Jack Smith.\">grand jury\u200c investigation<\/a> and the prosecution of the \u200cindictment.\u201d<\/p>\n<p>While acknowledging he didn\u2019t \u2063know \u200cwhether the defendants\u2019 argument would \u2064succeed, Cunningham highlighted several unusual factors\u200d in\u200d the case, including Wade\u2019s lack of obvious \u2063qualifications and that\u200c his prior prosecutorial experience was limited to misdemeanors. Add\u200d to\u2063 that the fact that Wade received compensation far exceeding that of even Willis and\u200c then spent those funds on Willis.<\/p>\n<p>Ashleigh Merchant, the Georgia-based attorney\u200c who exposed Willis\u2019 relationship with Wade \u2014\u2063 as well as \u2063the alleged conflict of \u200dinterest, when she filed\u200b Roman\u2019s motion to disqualify Willis\u2064 and \u2064the Fulton County DA\u2019s office \u2014 sees Cunningham\u2019s \u2062essay as confirming her\u2064 client\u2019s position.<\/p>\n<p>\u201cProfessor Cunningham\u2019s opinions\u200b reflect the reality that\u2064 Ms.\u200d Willis\u2019 \u200bactions are indefensible under Georgia law \u2063and, as we pointed out,\u2063 threaten to greatly \u2064undermine the public\u2019s confidence in the eventual outcome of\u2062 this case,\u201d Merchant told \u2062The Federalist. \u201cThat is\u200d exactly why we have \u200dasked that both she\u2062 and Mr. Wade be removed\u200c from the case.\u201d<\/p>\n<p>But even Cunningham\u2063 admits \u2064what he \u2063perceives\u2063 as the real risk \u2064of Willis\u2019 continued \u200cinvolvement in\u200d the case: that disqualifying Willis and her office would send \u2063the case \u200cto \u2063the <a href=\"https:\/\/pacga.org\/\">Prosecuting \u200bAttorneys\u2019 Council of Georgia<\/a>,\u200b where an independent <a href=\"https:\/\/law.georgia.gov\/resources\/appointment-substitute-prosecutor\">prosecutor<\/a> would be appointed \u2063to take the case over from Willis.<\/p>\n<p>\u201cAnd that\u2019s \u2062where\u200c things could really go off the rails,\u201d \u200dCunningham cautioned. \u201cTake one precedent: On \u2063July 25, 2022, Ms. Willis was \u200cdisqualified from prosecuting Burt Jones, who was then a state\u2062 senator, after she <a href=\"https:\/\/apnews.com\/article\/2022-midterm-elections-donald-trump-georgia-atlanta-37ac6b6fe45e5c28c848618a0d4988d0\">hosted<\/a> a fund-raiser\u2064 for \u200cMr.\u2062 Jones\u2019s \u2063eventual opponent in the \u200brace for lieutenant governor. Eighteen months later, the PACGA still hasn\u2019t\u2064 appointed a special prosecutor, and Mr. Jones, now lieutenant governor, has\u200b not even been \u2064indicted.\u201d<\/p>\n<p>But\u200b in the eyes of the Georgia State\u200c University law professor, \u201cDelay is not \u200deven\u2062 the worst possible outcome for the case if Ms. Willis \u200cis \u2063disqualified.\u201d Rather, the worst possibility would be\u2064 that\u200c the prosecutor appointed by the\u2064 Prosecuting Attorneys\u2019 Council\u2064 of Georgia \u201ccould \u200cdecide to \u200breduce \u2062or \u2062dismiss \u200ccharges against some or all of \u200cthe defendants, including Mr. Trump.\u201d<\/p>\n<p>One need only\u200d fear that outcome, however, \u2064if a \u2063criminal conviction, \u2063as opposed to justice,\u2063 were the end\u2062 goal. And \u2062one would only worry that an independent prosecutor \u200cwould reduce or\u2064 dismiss some or all the \u200ccharges against Trump and his co-defendants if those charges should\u200d never have\u200b been brought in the first instance.<\/p>\n<p>That the anti-Trump \u200bbrigade is so forcefully pushing to keep the criminal \u200cprosecution of Trump in the hands of the Fulton County DA\u2019s office, even if that means \u2062Willis must step aside, speaks volumes to the frivolousness\u2063 of the indictment.<\/p>\n<p>Whether fellow Democrats pressure Willis to \u2062follow \u200cCunningham\u2019s script remains to be seen, \u2062but with Judge McAfee\u2062 ordering the DA to file a written response to allegations of a conflict of interest \u2064by Feb. 2,\u2063 2024, \u2062we should know soon.<\/p>\n<p>But \u2064Democrats,\u200c from their efforts\u2063 to keep this case in Fulton County, have already made\u200b clear \u200bthat\u200d they know Willis\u2019 case against Trump is bunk.<\/p>\n<hr class=\"wp-block-separator\">\n<\/div>\n<p> <\/p>\n<h2> \u200bWhat potential consequences could result \u2063from a\u2064 thorough investigation into the claims against \u2062Willis and Wade?<\/h2>\n<p><span>  \u200b Get tricky for\u200c \u2063Willis and the Democrats. \u200d\u2062An independent \u2062prosecutor could thoroughly \u2060investigate the claims against \u2063Willis and\u200d Wade, potentially resulting in \u2063serious consequences for \u2062both of them. \u2062It could also\u200c expose any\u2063 political motivations\u200c or biases behind the\u2062 prosecution\u2063 of Trump and his \u2063associates.<\/p>\n<p>The \u200cDemocrats&#8217; desperate fight to keep \u2064the Fulton County prosecutor&#8217;s office in charge of the Trump case raises\u2063 questions about the integrity and fairness of\u200d the prosecution. It suggests that there may be ulterior motives behind the charges brought against\u2062 Trump and his co-defendants.<\/p>\n<p>The allegations \u200dof an affair\u200b between Willis and Wade, as well\u2062 as the misuse of taxpayer funds, not only \u2064cast\u200c doubt on the credibility of the \u2063prosecution but also raise serious ethical concerns. If true, \u200cthese allegations\u2064 would indicate \u2063a gross\u200c abuse of power and a clear conflict of interest on Willis&#8217; part.<\/p>\n<p>The fact that Willis allegedly appointed Wade without proper approval and paid him significantly more than\u2063 her own \u200dsalary further\u2062 fuels suspicion of wrongdoing. It calls into question her judgment and raises doubts about her ability to objectively handle the case.<\/p>\n<p>The\u2063 Just Security article and The New York Times op-ed attempting to defend Willis and argue \u200cagainst her disqualification\u2062 only serve to muddle the situation further. \u2063Their arguments appear to be more concerned with ensuring a conviction of Trump rather than upholding justice and fairness.<\/p>\n<p>The suggestion that Willis should take a personal leave\u200d of absence and hand over control of the district attorney&#8217;s office and\u2063 the case against Trump to\u2064 a career deputy \u2062district \u200battorney seems like a questionable compromise. It does not address the underlying issues of conflict of interest and potential misconduct.<\/p>\n<p>The concerns raised by\u2064 defendant Michael Roman&#8217;s motion to disqualify Willis and the Fulton County DA&#8217;s office cannot be easily dismissed. They go to the heart of the integrity of the legal system and the pursuit of justice. The allegations against Willis \u2062and Wade must be thoroughly investigated, and if found to be true, appropriate action should be taken.<\/p>\n<p>Ultimately, the pursuit of justice \u2063should be impartial and free from any \u2064political motivations. The integrity of the legal system depends on it.
