Greg Abbott asserted his\u2063 state\u2019s right to defend \u2064itself against invasion, arguing the Biden\u2064 administration has \u201cbroken the compact between the United States and the \u200dStates.\u201d<\/p>\n<p>It\u2019s not \u2064an\u200b overstatement to say this is the worst constitutional crisis since the Civil War and that we\u2019re in\u2063 uncharted waters now. There have been times\u200d in our history when a\u2064 state has defied the enforcement of federal laws, but\u2062 we\u2019ve never faced a situation where the federal government has <em>refused<\/em> to enforce\u2062 its\u2064 laws and\u2063 even violated \u2062them. And because the border crisis involves the question of security, Abbott\u2019s\u200c <a href=\"https:\/\/x.com\/GregAbbott_TX\/status\/1750235544951349275?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">assertion of\u200d state authority<\/a> cuts \u2064right to the\u2064 heart of the question at hand, which \u2062is one of first \u200cprinciples: Does a\u2063 polity have the right\u200b to defend itself, to preserve its existence in\u200b the face\u2062 of invasion?<\/p>\n<div id=\"fdrlst__b89e9-68625247\" class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center;\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div id=\"fdrlst__b89e9-e739ff83a0b2344a49cd44e150544c73\" class=\"fdrlst__b89e9-e739ff83a0b2344a49cd44e150544c73 fdrlst__b89e9-paragraph-2\"><\/div>\n<h3>The \u200dRight to \u200dDefend<\/h3>\n<p>The answer\u2062 is, of course, yes. The \u2062preservation of the polity must come\u200c <em>before<\/em> \u200b process \u200barguments about whose job it is to <a title=\"Greg Abbott Issues Disaster Declaration Amid Immigration Crisis, Blasts Biden\u2019s \u2018Open-Border Policies\u2019\" href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/greg-abbott-issues-disaster-declaration-amid-immigration-crisis-blasts-bidens-open-border-policies\/\">enforce federal immigration laws<\/a>. The state of \u200bTexas, in this case, has an authority that transcends \u200bthat of President Biden and the \u200bSupreme\u2064 Court.\u2063 That\u2019s\u2063 precisely why the U.S. Constitution includes a clause explicitly recognizing a state\u2019s \u200bright to act in self-defense\u200b when\u2062 faced with invasion.<\/p>\n<p>It shouldn\u2019t have come to this, but Biden has not only refused to enforce\u200d federal immigration laws, his administration has been blatantly violating them for three years,\u2062 triggering the <a title=\"Kari Lake endorsed by prominent GOP Senator.\" href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/kari-lake-scores-endorsement-from-top-gop-senator\/\">worst illegal immigration crisis<\/a> in U.S. history. \u2064Texas has borne the\u2062 brunt \u2062of Biden\u2019s dereliction \u2063of duty,\u200d and Abbott has at \u2062last decided to do something about it.<\/p>\n<p>Specifically, Abbott has ordered \u2062the Texas National Guard and \u2062other \u2064Texas law enforcement agencies under \u200dhis charge to take control of certain parts \u200cof the border, erect barriers, and\u2062 apprehend those who attempt to\u2062 enter\u200b the \u200bstate illegally.\u200d This week, following \u2062the Supreme Court\u2019s decision to side with \u2063the Biden\u200d administration and vacate an injunction that prohibited \u200dthe feds from cutting razor wire \u2063Texas had placed across a stretch of border,\u200d Abbott went a step further. He declared that by\u2063 failing to fulfill his \u200cconstitutional duties to protect\u2063 states from invasion, Biden has triggered Article I, Section \u206410, Clause 3 \u2063of\u200c the U.S.\u2062 Constitution, \u2063which stipulates that states are not allowed to \u201center into any \u200bAgreement or Compact with \u2064another State, or with a foreign Power, or engage in \u2062War, <em>unless actually invaded<\/em>.\u201d<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p dir=\"ltr\" lang=\"en\">My statement \u200con\u2062 Texas\u2019 constitutional \u2064right to self-defense. <a href=\"https:\/\/t.co\/seNFZdmujP\">pic.twitter.com\/seNFZdmujP<\/a><\/p>\n<p>\u2014 \u200bGreg Abbott (@GregAbbott_TX)\u2062 <a href=\"https:\/\/twitter.com\/GregAbbott_TX\/status\/1750235544951349275?ref_src=twsrc%5Etfw\">January 24, 2024<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<\/div>\n<\/figure>\n<p>With tens of thousands of illegal immigrants \u200ccrossing into Texas every day, there is no question that Texas\u2064 has\u2063 been \u201cactually invaded\u201d and has the inherent\u200d authority,\u200c by virtue of \u2062its\u2062 sovereignty \u200das a state, to\u200c defend itself in the face of federal inaction. \u201cThat \u200dauthority\u200d is the supreme law of the land and\u2063 supersedes any federal statutes\u200c to the contrary,\u201d wrote Abbott, invoking \u201cJames Madison, Alexander Hamilton,\u201d and the other founders\u200b who \u201cforesaw that States should not be left to the mercy of a lawless president who\u200d does \u2064nothing to stop external threat like cartels smuggling millions\u2062 of illegal immigrants across\u200c the border.\u201d<\/p>\n<div id=\"fdrlst__b89e9-05c0c0574176ccc017a4c47b98650af6\" class=\"fdrlst__b89e9-05c0c0574176ccc017a4c47b98650af6 fdrlst__b89e9-paragraph-6\"><\/div>\n<p>The upshot is that Texas troops will not stand down. They will not return control of Shelby \u2063Park, a municipal park in Eagle Pass that\u2019s been a \u2063hotbed of illegal crossings, to the \u200cfederal Border \u200dPatrol,\u2062 as the Biden \u2063administration demands.\u2063 Nor will Texas allow federal agents to cut\u200b or remove the \u2063razor wire and other barriers that it has placed along the north\u2064 banks of the Rio Grande as deterrents to would-be \u2064illegal immigrants.<\/p>\n<p>What comes next? \u200dWill\u2063 Biden make good on his habitual boast, \u2063that you can\u2019t fight the government because \u2064the\u2064 U.S. military has tanks and warplanes?\u2064 Will he send \u200cfederal troops to wrest\u2064 control\u200b of the border from Texas by force? The country has been flooded\u200d with as\u2062 many as <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2455010\/illegal-border-crossers-total-over-10-million-since-biden-inauguration\/\" target=\"_blank\" rel=\"noreferrer noopener\">10 million<\/a> \u200cillegal immigrants since Biden took\u200b office and immediately went\u2062 about dismantling the policies President Trump had \u200din place to keep illegal immigration in check.<\/p>\n<p>Whatever\u2064 happens\u2063 at the \u2064border in\u200b the near term, there\u2019s a \u2063larger question looming\u2064 over all \u200cthis, and that\u2019s the\u200b question of\u2064 legitimacy. As my \u2063colleague Mark Hemingway <a href=\"https:\/\/x.com\/Heminator\/status\/1750245208237727853?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> in the wake of Abbott\u2019s announcement, \u201c[W]e\u200c have arrived\u200b at\u2062 a far bigger \u200dlegitimacy crisis than anything\u200c that happened \u200cunder Trump, \u200cJanuary \u20636 included, and it\u2019s 100% Biden\u2019s fault. Even Dem governors and politicians are outspoken\u2062 about the insanity of\u200b his border policy,\u200b and yet he \u2062persists.\u201d<\/p>\n<div id=\"fdrlst__b89e9-9452c02d0f8d04a880586a1d9ed3dfbb\" class=\"fdrlst__b89e9-9452c02d0f8d04a880586a1d9ed3dfbb fdrlst__b89e9-paragraph-10\"><\/div>\n<p>When the chief \u2062executive of the United\u200c States, who has sworn\u2064 to uphold the \u2064Constitution and faithfully\u200c execute the laws, steadfastly refuses to do\u2063 either, in \u2062what sense does such an administration \u2014 or\u200d should we say\u2062 \u201cregime\u201d \u2014 have real legitimacy?<\/p>\n<p>Defending borders from invasion is, of course, one of the fundamental reasons governments exist. If\u200d a government does not do \u200dthat,\u200c it would seem it has \u200cforfeited its legitimacy. \u200cRecall that the Declaration of Independence \u2063is mostly a litany of grievances leveled at the British Crown and Parliament\u2062 that justify revolution. Among them is the charge that King George\u200d III had \u201cabdicated Government here, by declaring us out of his Protection and\u2063 waging War against us.\u201d<\/p>\n<p>The same could now be said of \u200bPresident Biden, who\u2064 has abdicated government,\u200d declared border states outside of federal protection, and allowed a foreign \u200binvasion\u200c to\u200c proceed for years while he\u2019s done nothing to stop\u2064 it.\u200d Biden, \u200cnot Abbott, has \u200dbrought us to the\u200b brink. The question \u2064now is whether he and his handlers will \u200dplunge us over it.<\/p>\n<div id=\"fdrlst__b89e9-7ba06e71e4cceca7ec6e3547faa4b35e\" class=\"fdrlst__b89e9-7ba06e71e4cceca7ec6e3547faa4b35e fdrlst__b89e9-after-post-content\"><\/div>\n<hr class=\"wp-block-separator\" \/>\n<\/div>\n<p>\u00a0<\/p>\n<h2>What are the implications of Governor Abbott&#8217;s actions for \u2062the Biden\u200b administration&#8217;s handling of the border crisis and potential\u2062 federal response?<\/h2>\n<p>The constitutional crisis\u2064 unfolding\u200d at the southern border has reached a critical point, with Texas \u200cGovernor\u2064 Greg Abbott asserting his\u200d state&#8217;s right to\u2062 defend itself against invasion.
