It was concocted by\u2064 bureaucrats in Washington D.C. \u2062and approved by a political appointee.<\/p>\n<p>This is the \u200cessence of the case of <em>Loper Bright Enterprises v. Raimondo<\/em>, where New England fishermen are taking on Commerce Secretary Gina Raimondo. This\u2064 landmark case has the potential to weaken or even end the controversial <em>Chevron<\/em> deference, a doctrine that has given the administrative state sweeping\u200d control over\u2062 the American economy. Ruth \u2063Marcus of The Washington\u2063 Post summarizes their arguments:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;But the fundamental question was clear: \u200cWho decides?\u2064 From the liberal point of view: unelected judges or regulators with expertise\u2063 and accountability? From the \u200bconservative\u200d vantage \u200bpoint:\u2062 judges constitutionally\u200c empowered \u200bto say what the \u2063law is or\u2063 unelected bureaucrats?&#8221;<\/p>\n<\/blockquote>\n<p>It&#8217;s hard to fathom how any judge who swore to uphold the Constitution could side with the &#8220;liberal\u2064 point of view.&#8221; Justices are intentionally unelected. It&#8217;s not a trick; it&#8217;s their purpose. Their duty\u200c is to interpret the constitutionality of laws and their implementation. Failing to do so would be \u2062a dereliction of duty. Yet, the left treats the Supreme Court as if it were an autocratic \u200dStar Chamber for simply doing its job.<\/p>\n<p>On the\u200c other hand, the Constitution does not grant unelected bureaucrats the \u200bauthority to make laws. The executive \u200dbranch&#8217;s role is to execute laws as written. Initially, \u200cconservatives supported <em>Chevron<\/em> as a means to curb judicial activism. \u200bHowever, the broad discretion given \u200cto \u2062agencies \u2064in making &#8220;reasonable&#8221; decisions when the law\u2062 is ambiguous has been abused. \u200bThis has \u200dled\u200d to agencies like the Environmental Protection Agency regulating every puddle and molecule of carbon dioxide.<\/p>\n<p>Furthermore, the notion that \u200dgovernment regulators possess unparalleled expertise and accountability\u2062 is a myth. Democrats often claim a monopoly on apolitical policy expertise, but \u200cthere are always\u200b significant disagreements over regulatory policies. This is why politics exists, and \u2063why Democrats seek \u200bto bypass Congress and debate.<\/p>\n<p>Moreover, the idea \u2063that government regulators are the best and brightest, chosen based on merit, is complete \u2062nonsense. Anyone who\u200c has \u2064paid \u200dattention to the government knows this. This is especially true for political appointees, whose most valuable skills are \u2063navigating \u2063bureaucracies and avoiding risks.<\/p>\n<p>Furthermore, bureaucrats lack the kind of \u200caccountability that most people \u2064would recognize. When \u2062was the last time an agency faced consequences for failed policies? When was the last \u2062time the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/journalists-like-jo-becker-claim-to-hold-power-accountable-but-are-really-establishment-tools\/\" title=\"Jo Becker and other journalists claim to hold power accountable, but they are actually establishment tools.\">administrative \u2062state<\/a> \u2064was \u2064reined in? How many regulators or appointees are ever fired? If you performed as poorly\u200b as Alejandro Mayorkas, you would be unemployed forever.<\/p>\n<p>Even if \u2064regulators were exceptionally talented and hardworking, they would still have no right to create laws out of thin air.<\/p>\n<p>Yet, the most vocal defenders\u200c of American &#8220;democracy&#8221; believe \u2064that <em>Chevron<\/em> deference abuses are essential for governance. Reading left-wing commentary on the topic, one might think that federal\u200d agencies did not exist \u2064before 1984.<\/p>\n<p>The outcry\u2063 over the potential demise of <em>Chevron<\/em> deference is just \u200canother example\u200c of the left&#8217;s abandonment of any \u2063limiting principle. It&#8217;s all about the consequences, all the time. Anything Democrats dislike is\u200c seen as \u2062an attack on &#8220;democracy.&#8221; When \u2063the court returns the abortion issue,\u200d which is not mentioned in \u2064the Constitution, to the voters, every leftist in the country \u2062claims that &#8220;democracy&#8221; is under threat. When the same \u2063court threatens to curb unelected technocrats \u200bfrom doing as they please, democracy is once again\u2063 in danger. It doesn&#8217;t even make sense.<\/p>\n<p>What\u200c <em>Chevron<\/em> deference does is incentivize Congress to write \u200dvague laws and allows presidents to abuse \u200dtheir \u200cpower. It creates instability as each administration interprets the \u200blaw according to its\u2063 own preferences. It poses\u2062 a threat to the separation of powers. It was a colossal \u2064mistake. And unlike most of the\u200d left&#8217;s current hysteria, it genuinely\u2063 endangers &#8220;democracy.&#8221;<\/p>\n<hr class=\"wp-block-separator\">\n<\/div>\n<p> <\/p>\n<h2> How does the case of Loper Bright\u2062 Enterprises \u200dv. Raimondo \u200dhighlight the issue of bureaucrats being appointed\u200d through political\u200d connections rather\u200b than expertise and accountability?<\/h2>\n<p><span>  Nonsense. Many bureaucrats are appointed through political connections and are driven \u2063by \u2063their own agendas rather than expertise and accountability. The case\u200b of <em>Loper Bright Enterprises v. Raimondo<\/em> highlights \u200bthis issue, as fishermen are being forced \u2064to pay the\u2063 salaries of regulators\u2062 who have power over them, without any legal basis for \u2062this \u2062demand.<\/p>\n<p>The \u200b<em>Raimondo<\/em> case\u200b has brought the\u2062 controversial <em>Chevron<\/em> deference doctrine into the spotlight. This doctrine has granted the administrative state extensive control over the American economy, but its\u200c constitutionality is being questioned. The\u2063 outcome of this case \u200ccould potentially weaken or even end \u200cthe \u200bdeference given to administrative agencies.<\/p>\n<p>However, it is concerning that during the Supreme Court oral arguments, the liberal \u200cjudges seemed\u200c more focused on\u2063 preserving the power of government experts\u200b rather than upholding the Constitution.
