During the episode, Neely <a href=\"https:\/\/townhall.com\/tipsheet\/mattvespa\/2023\/06\/11\/daniel-penny-reveals-what-jordan-neely-said-that-caused-him-to-placed-in-a-chokehold-n2624360\" target=\"_blank\" rel=\"noreferrer noopener\">allegedly<\/a> kept repeating the phrases, \u201cI\u2019m going to \u200dkill you,\u201d \u201cI\u2019m prepared to go to jail\u200d for life,\u201d \u200cand \u201cI\u2019m \u2063willing to die.\u201d<\/p>\n<p>In response, Penny and two \u200dof\u2063 his fellow \u2063passengers\u2063 attempted to restrain\u2063 Neely, which involved the former placing the latter in a\u200d headlock. Neely ultimately died during the encounter, with NYC\u2019s medical examiner <a href=\"https:\/\/www.foxnews.com\/us\/marine-veteran-daniel-penny-indicted-subway-chokehold-death-jordan-neely-sources\" target=\"_blank\" rel=\"noreferrer noopener\">determining<\/a> the death \u2062as a homicide.<\/p>\n<p>Penny\u200c \u2014 \u2062who\u2063 is currently <a href=\"https:\/\/nypost.com\/2024\/01\/17\/metro\/nyc-judge-rejects-daniel-pennys-motion-to-dismiss-jordan-neely-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">out on bail<\/a> for $100,000 \u2062\u2014 \u2062was \u2063 <a href=\"https:\/\/www.foxnews.com\/us\/marine-veteran-daniel-penny-indicted-subway-chokehold-death-jordan-neely-sour\" target=\"_blank\" rel=\"noreferrer noopener\">indicted<\/a> by\u200d a\u2064 grand jury in June\u2062 \u201con one \u200dcount each of criminally negligent \u200bhomicide and \u200csecond-degree manslaughter.\u201d If convicted, the former Marine could face up to 19\u2062 years in prison, according to the <a href=\"https:\/\/nypost.com\/2024\/01\/17\/metro\/nyc-judge-rejects-daniel-pennys-motion-to-dismiss-jordan-neely-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">New York \u200dPost<\/a>.<\/p>\n<p>In his Wednesday ruling, Judge Maxwell Wiley <a href=\"https:\/\/nypost.com\/2024\/01\/17\/metro\/nyc-judge-rejects-daniel-pennys-motion-to-dismiss-jordan-neely-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">reportedly<\/a> \u2063denied Penny\u2019s motion to dismiss the manslaughter \u2064case \u201cbecause of alleged\u2063 issues with prosecutors\u2019 instructions to the grand jury and claims \u200cthat the medical examiner didn\u2019t establish that Penny\u2019s actions\u200d killed Neely.\u201d According to the Post, Wiley claimed Neely\u2019s death certificate and testimony from\u200d the case\u2019s \u200cmedical examiner provided \u2064enough corroboration to \u201cestablish that defendant\u2019s \u200bactions caused \u200dthe death of Neely.\u201d<\/p>\n<p>Penny\u2019s next court hearing is scheduled for March 20.<\/p>\n<h2>Unequal Application of the Law<\/h2>\n<p>Whereas Penny<strong>&#8216;<\/strong>s ongoing prosecution and the criminalization of defending oneself\u200d and\u200c others against a threatening agitator is egregious, what\u2019s particularly \u2062offensive is<strong> <\/strong>city residents\u2019 unequal application\u2062 of \u2064a single standard of justice for \u200dindividuals who partake in \u2062similar acts of \u200balleged misconduct.<\/p>\n<p>Similar to Penny, Queens resident \u200dJordan \u2063Williams \u2014 who is\u2064 black \u2014 was charged by a Brooklyn prosecutor in June for his role in the death of an ex-convict\u200c on a \u200dBrooklyn subway.\u200b Video footage of the incident <a href=\"https:\/\/nypost.com\/2023\/06\/28\/accused-j-train-stabber-dodges-manslaughter-charges-in-fatal-nyc-subway-brawl-sources\/\" target=\"_blank\" rel=\"noreferrer noopener\">reportedly<\/a> \u2064showed\u2062 ex-con Devictor Ouedraogo \u201cchoking \u2063Williams \u2062and slugging his girlfriend,\u201d actions which resulted in\u200b Williams stabbing Ouedraogo and the latter\u2019s death.<\/p>\n<p>This led prosecutors \u200bto <a href=\"https:\/\/nypost.com\/2023\/06\/28\/accused-j-train-stabber-dodges-manslaughter-charges-in-fatal-nyc-subway-brawl-sources\/\" target=\"_blank\" rel=\"noreferrer noopener\">charge<\/a> Williams with \u201cmanslaughter and \u200ccriminal possession of a weapon.\u201d<\/p>\n<p>Unlike\u200b Penny, however, prosecutors\u2019\u2063 request \u2064that Williams be\u200b placed on \u2064a $100,000 cash bail was <a href=\"https:\/\/nypost.com\/2023\/06\/15\/j-train-stabber-jordan-williams-released-without-bail-after-arraignment\/\" target=\"_blank\" rel=\"noreferrer noopener\">denied<\/a> by a local judge. Less than a month later, a grand\u2064 jury <a href=\"https:\/\/nypost.com\/2023\/06\/28\/accused-j-train-stabber-dodges-manslaughter-charges-in-fatal-nyc-subway-brawl-sources\/\" target=\"_blank\" rel=\"noreferrer noopener\">dismissed<\/a> Williams\u2019 charges altogether.<\/p>\n<p>Neither Penny nor\u200d Williams should have been \u2062charged in the\u200d first place. Both men were clearly defending themselves and others against \u2063threatening, violent agitators. But NYC\u2064 residents\u2019 decision\u2062 to indict Penny and not Williams is further\u200b emblematic of Democrats\u2019 hierarchical worldview.<\/p>\n<p>The American left doesn\u2019t believe in a single \u2063standard\u200d of justice. Rather, it supports and actively fosters a system\u2062 that levies punishment based on one\u2019s political affiliation or identitarian\u200b features such \u2062as race or sexual\u2062 orientation \u2064\u2014 not the merits of the case. It\u2019s through this \u200ddistorted \u2064worldview that <a href=\"https:\/\/www.politico.com\/2020-election\/results\/new-york\/\" target=\"_blank\" rel=\"noreferrer noopener\">NYC Democrats<\/a> believe that Williams \u2014 \u2064who is black and therefore \u201coppressed\u201d \u2014 \u2063should go unpunished\u2063 while Penny \u2014\u2062 who is white, therefore privileged and an \u201coppressor\u201d \u200d\u2014 should have the book thrown at him.<\/p>\n<p>For Democrats, the facts \u2062of a case don\u2019t \u2063matter.\u2064 All that matters \u2063is whether the person on trial \u2062is wearing their\u200d team\u2019s jersey.
