The \u200bplaintiff, \u200dStudents for Fair Admissions \u2014 which successfully\u200b litigated a similar lawsuit in the U.S. Supreme\u200b Court\u200d against Harvard University\u200c and the University of North Carolina in\u200d 2023 \u2014 had sued West Point. Students for Fair Admissions sought a \u200bpreliminary and permanent injunction against the academy\u2019s use of race in its admissions process.<\/p>\n<p>Relying on its victory in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/20-1199_hgdj.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Students\u2062 for Fair Admissions v. President &#038; Fellows of Harvard College<\/em><\/a>, the organization argued that the equal protection principles embodied by the Fifth Amendment <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-kraken-released-attorney-sidney-powell-files-104-page-bombshell-complaint-of-massive-fraud-in-georgia-election-update-michigan-too\/\" title=\"BREAKING: KRAKEN RELEASED! In that case, the \u2063court held neither Harvard nor UNC \u200bhad established a \u2064compelling justification for a racially biased \u200badmissions process. But it left\u200d open the question of whether that ruling applied \u2064to the U.S. military academies because none of\u200c them was a party to\u2063 that\u2063 case.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-904425591\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-922641005fe174a71bcfcd6562e8cce0 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-922641005fe174a71bcfcd6562e8cce0\"><\/div>\n<p>Since then,\u200d Students for Fair Admissions sued the U.S. Naval Academy and West Point. In each case, the \u200cdistrict court denied a request for a \u2064preliminary injunction. The courts concluded that \u200bthey could not resolve the merits of the\u200c claims without the development of a factual record beyond the affidavits submitted \u2063by the parties.<\/p>\n<h2 class=\"wp-block-heading\">\u2018Compelling\u2019 Racial Discrimination<\/h2>\n<p>In the\u2063 West Point case, like the\u2062 Annapolis case, the federal government\u200d admitted that\u200c race plays a role in the admissions \u2062process. West Point argued, however, that\u200d the \u2062armed forces have a \u201ccompelling\u201d \u200dneed to discriminate on the basis of race in their admissions for several reasons. Namely, (1) that a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/no-the-supreme-court-did-not-carve-out-a-military-exception-in-race-based-admissions\/\" title=\"No, Supreme Court didn't create military exception for race-based admissions.\">diverse officer corps<\/a> is necessary for the \u201clethality\u201d of\u200c and the \u201ccohesion\u201d within military units, \u2064(2) such a policy is necessary\u200b for satisfactory recruitment and retention of\u200d a \u200dpotential and existing officer\u2062 corps, and (3)\u2064 such a policy would\u2063 enhance\u2064 \u201cthe military\u2019s legitimacy in the eyes of the nation and the world.\u201d<\/p>\n<p>The government also argued\u200b that the courts should defer to the military\u2019s judgment that bending to racism is necessary. West Point noted the Supreme Court has often declared that judgments about military necessity are peculiarly within\u200d the province of military professionals to make. The judge in the Annapolis case expressed a willingness \u2063to defer to the military\u2019s claimed need for discrimination, while the\u200c judge in\u200b the West Point case declined to \u2062decide how to resolve that point.<\/p>\n<p>At this stage, the two opinions should leave us with the following conclusions.<\/p>\n<div class=\"fdrlst__b89e9-5e11f8ae7eac390e85be0b5f78b23dee fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-5e11f8ae7eac390e85be0b5f78b23dee\"><\/div>\n<h2 class=\"wp-block-heading\">Law and Facts Left Unexamined<\/h2>\n<p>First, each court decided that, before it could adequately\u200c address the merits of \u200dthe plaintiff\u2019s claims, it needed a more\u2063 elaborate development of the underlying facts. That\u200c is not surprising. Before reaching the \u2063Supreme Court, the \u200bHarvard and UNC cases had both been tried in different federal\u2062 courts, where an extensive factual record was established. Perhaps, the district courts in the \u2062Annapolis and West \u2062Point cases will later decide \u2063that they can resolve those \u200dcases at \u200cthe summary judgment stage. No one\u2064 should be surprised, \u200chowever, if each court concludes that a\u200c full trial\u200d is necessary for it\u2062 to enter a judgment for Students for Fair Admissions \u2062or the service academies.<\/p>\n<p>Second, neither court analyzed in any detail the legal issues posed \u2064by the plaintiffs. There are \u2064numerous reasons why their denials\u200b of preliminary relief do not signal their view about the ultimate\u200b merits of the claims. Significantly, neither court decided whether the government\u2019s alleged need for \u201cdiversity\u201d was compelling, let \u2064alone whether the government has shown a surpassing need for \u201c<em>racial<\/em> diversity.\u201d<\/p>\n<p>The courts also did not\u200c require the government to explain why racial diversity is necessary to establish \u2064the \u201clethality\u201d or \u201ccohesion\u201d of military units. No service branch assigns different tools of warfare to different soldiers,\u2064 sailors, airmen, or marines based on their race, \u200cso it is \u2062not\u2063 obvious how or why the government\u2019s alleged need for\u2062 racial \u200bdiscrimination contributes to the \u201clethality\u201d of our \u2064fighting \u200bforces.<\/p>\n<p>Similarly, unless the government \u2063can \u2064prove that servicemembers\u2064 will be influenced \u200dby the color of their officers \u2014\u200d that is, \u200bthey will be\u2062 less likely to fully comply with the orders issued by officers whose skin color does\u200b not match their own \u2014 it is difficult \u2062to understand how or why \u201ccohesion\u201d \u2063would be affected\u2063 by the racial makeup \u2063of military personnel.<\/p>\n<div class=\"fdrlst__b89e9-c1253bfc7990d53e133da32ef5b91b67 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-c1253bfc7990d53e133da32ef5b91b67\"><\/div>\n<h2 class=\"wp-block-heading\">Legitimacy or Lethality?<\/h2>\n<p>Third, the government\u2019s claim that racial\u200c discrimination is \u200d\u2014 paradoxically \u2014 necessary to establish the\u200b \u201clegitimacy\u201d of our armed forces is, to be kind, precisely the type of vacuous claim that the Supreme Court rejected in 2023.<\/p>\n<p>Why \u200cdo \u2063we \u2064need the eyes of the world to see the racial composition of our military as \u201clegitimate\u201d for our military \u2064to fight effectively? Why should we care about any factor other than our ability to protect the nation\u2019s interests against foreign nations who want\u200c to do us harm and destroy \u200bour way of life? How many \u2064minority\u2063 officers does the \u200cmilitary need to cross \u2062the line from being an \u201cillegitimate\u201d military to one that is instead \u201clegitimate\u201d? Whose opinion counts when answering that \u200bquestion \u2014 China\u2019s? Russia\u2019s? Iran\u2019s? North Korea\u2019s? And what is \u200c <em>their<\/em> record of illegitimate discrimination in this regard? The government\u2019s claim is \u200bprecisely the sort of political sop that \u200bcannot constitute a \u201ccompelling\u201d justification for racial\u200c discrimination.<\/p>\n<h2 class=\"wp-block-heading\">Precedent to Consider<\/h2>\n<p>Fourth, neither judge addressed the relevance\u200b of the Supreme Court\u2019s 2005 decision\u200c in <a href=\"https:\/\/www.oyez.org\/cases\/2004\/03-636\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Johnson v. California<\/em><\/a>, \u200din which\u200c the court rejected California\u2019s argument that it had a compelling interest in assigning prisoners to cells on the\u200b basis \u200dof their race. The court held that \u201ccompliance with the Fourteenth Amendment\u2019s ban on racial\u2062 discrimination is not only consistent with\u2062 proper prison administration, but also \u200bbolsters the legitimacy of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-doj-nominee-denies-being-anti-police-despite-defund-the-police-op-ed\/\" title=\"Biden DOJ nominee denies being anti-police despite \u2018Defund the Police\u2019 op-ed\">entire criminal justice system<\/a>.\u201d In addition, the court rejected the proposition that decisions about race-based cell assignments \u201care better left in the first instance to the\u2063 officials \u2062who run our\u2063 Nation\u2019s prisons.\u201d<\/p>\n<p>The\u200b bottom line is this: The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-who-led-attack-on-robert-bork-confirming-judges-at-a-rate-not-seen-in-over-50-years\/\" title=\"Biden, Who Led Attack On Robert Bork, Confirming Judges At A Rate Not Seen In Over 50 Years\">district court judges<\/a> \u200din\u2064 the Annapolis and \u2064West Point cases have decided that factual\u200b development \u200cis necessary for them to adjudicate the plaintiff\u2019s claims and that, in the meantime, the academies\u2063 may continue \u200bwith\u2064 their admissions \u200dpolicies. That is a \u2063setback for the plaintiff but only a \u200ctemporary one.<\/p>\n<p>To be sure, the plaintiff must wait longer for those courts to decide on the relief that it sought,\u200d and it might ultimately lose the cases on the merits. But the plaintiff\u200c is still in the game. The first inning or two have been played, but there are more to\u2062 go,\u2062 and the score \u2064is 0-0.
