It was the \u201csingle greatest accomplishment\u201d of his life, he says, and graduation \u201cwas a big\u2064 deal\u201d for him. But \u200cthen there was a loud knock\u2063 on Haim\u2019s apartment door.<\/p>\n<p>It wasn\u2019t flowers or balloons, but rather two agents from the Department of Health and Human Services alerting him that he was the \u2063target of a criminal investigation.<\/p>\n<blockquote>\n<p>\u2018They show me their badges, and they say\u200c they were investigating a case regarding medical\u200d records,\u201d Haim told The Daily Wire during\u200d an\u2064 extended interview. \u201cIt\u200b was one of those moments where time stands still.\u201d<\/p>\n<\/blockquote>\n<p>Though Haim maintains he did nothing to warrant the probe, he\u200c immediately knew what it was about. A month earlier, \u200dHaim was the anonymous whistleblower for a bombshell story about secretive transgender surgeries for minors at one of the most prominent hospitals in the country.<\/p>\n<h3><b>\u201cIt\u2019s my responsibility \u2062as\u2062 a \u200ddoctor to expose this to the public\u201d<\/b><\/h3>\n<p>Prior to the publication\u2063 of this story, Haim has\u2063 chosen to keep \u200chis \u2064identity a \u200bsecret as he launched his career as a\u2064 surgeon. He\u200b never intended to enter the public conversation \u200cover gender ideology, but what he saw as a resident doctor at Baylor College \u2062of Medicine left him no choice.<\/p>\n<p>For Haim \u200cit all started in\u2064 September 2022,\u2064 when he saw The Daily Wire\u2019s <a href=\"https:\/\/twitter.com\/MattWalshBlog\/status\/1572313369528635392\" target=\"_blank\" rel=\"noopener\">investigation<\/a> of Vanderbilt University\u2019s transgender clinic, where so<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/im-taking-the-drug-that-activists-want-to-give-to-children-with-gender-dysphoria\/\" title=\"I\u2019m Taking The Drug That Activists Want To Give To Children With Gender Dysphoria\">-called \u201cgender-affirming\u201d care<\/a> for minors was described as a \u201cbig money \u2063maker\u201d and irreversible treatments such as double mastectomies were being \u200dperformed on children.<\/p>\n<div class=\"image\"><\/div>\n<p>\u201cThe public really woke up to these pediatric transgender programs,\u201d Haim recalled. \u201cIt was the first time\u200c that people heard about gender-affirming hysterectomies by these bubbly young doctors, and people were understandably\u200c shocked.\u201d<\/p>\n<p>The 33-year-old doctor,\u2064 however, thought he had \u200dnothing \u200bto worry about. He was working in Texas, after all, and Texas Attorney General Ken Paxton had already \u2062 <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/ag-paxton-declares-so-called-sex-change-procedures-children-and-prescription-puberty-blockers-be\" target=\"_blank\" rel=\"noopener\">issued an opinion<\/a> stating that performing sex-change procedures on minors was child abuse. The hospital where he was a surgical resident, Texas Children\u2019s Hospital, <a href=\"https:\/\/thehill.com\/changing-america\/respect\/equality\/597144-texas-childrens-hospital-halts-gender-affirming-therapies\/\" target=\"_blank\" rel=\"noopener\">stated unequivocally<\/a> after Paxton\u2019s opinion in \u2063March 2022 that it was halting its so-called \u201cgender-affirming services.\u201d<\/p>\n<p>\u201cTexas Children\u2019s Hospital paused hormone-related prescription therapies \u2062for gender-affirming services,\u201d read a statement from the hospital,\u200b which is the largest pediatric hospital in the country. \u201cThis \u2063step \u2064was taken to safeguard our healthcare professionals and impacted \u200dfamilies from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/americas-biggest-childrens-hospital-to-stop-gender-affirming-therapies-for-kids\/\" title=\"America\u2019s Biggest Children\u2019s Hospital To Stop \u2018Gender-Affirming Therapies\u2019 For Kids\">potential criminal legal ramifications<\/a>.\u201d<\/p>\n<p>Haim said the announcement was a \u201chuge relief.\u201d But working at \u2064the hospital, he soon learned that it may not \u200chave been the truth. Just a few days \u200dafter the public statement, Haim learned about a surgery in which doctors \u200bat the hospital implanted puberty blockers \u2062into a prepubescent 11-year-old girl who believed she was transgender.<\/p>\n<p>He continued to hear stories from other residents, and then came across a \u2062public \u201cgrand rounds\u201d presentation by top doctors at\u2062 the hospital encouraging \u200dthe use of puberty\u200c blockers and hormone treatments. The lecture coached primary care doctors how to funnel patients into the transgender clinic, where they could receive \u2062treatment.<\/p>\n<p>\u201cI \u2064reached this unavoidable conclusion that Texas Children\u2019s \u2064Hospital is providing this outward appearance that they shut down the\u2063 program, when in actuality, within the hospital, it\u2019s a very high priority,\u201d Haim said. \u201cI start realizing how blatant\u200d this is, how unethical it is, and how they\u2019re\u200c lying to\u200c the public.\u201d<\/p>\n<p>\u201cThis is \u2063a huge scandal, right?\u201d \u200che \u2063said. \u201cIt\u2019s my responsibility as a doctor, \u200cas a \u200bphysician, to expose this to the public. If \u2063I \u200cdon\u2019t, then\u200c this abuse can continue. I knew that future generations, \u2064like my children, would never be able to forgive\u200d me if they \u200bknew I had the chance\u200b to\u2063 do something and I decided\u2063 to \u2063stay silent.\u201d<\/p>\n<p>\u201cIt requires average, everyday doctors to \u2062stand up \u2063and speak \u2062out against things like this.\u201d<\/p>\n<h3><b>Whistleblower\u2062 materials cause firestorm at\u200d Texas Children\u2019s Hospital<\/b><\/h3>\n<p>The\u200d information proving that Texas Children\u2019s Hospital continued to perform \u2063sex-change procedures ultimately appeared in a May \u206316,\u200b 2023 article by <a href=\"https:\/\/www.city-journal.org\/article\/sex-change-procedures-at-texas-childrens-hospital\" target=\"_blank\" rel=\"noopener\">City Journal\u2019s Christopher Rufo<\/a>, who disclosed lectures as well\u2064 as redacted images of surgery and clinic schedules showing medical activity.<\/p>\n<p>It\u2019s difficult \u200dto overstate the impact of the story. \u200dJust two \u200bdays after the\u2062 story was published, the Texas legislature voted to pass SB-14, the bill that officially banned transgender procedures for \u200dminors. Haim said he had \u2064\u201cno idea\u201d\u200d about the timing \u2014 but Rufo, the activist who \u200cis <a href=\"https:\/\/christopherrufo.com\/p\/the-conservative-mastermind-behind\" target=\"_blank\" rel=\"noopener\">credited with orchestrating the demise of Harvard University\u2019s president<\/a>, \u2063was well aware.<\/p>\n<p>\u201cRufo\u2062 had learned that there would likely \u2064be a \u200bfew\u2063 Democrats who would vote in favor of the law if the story came out before the vote,\u201d Haim explained. \u201cAnd it did exactly that. It\u2062 had convinced multiple Democrats to vote in \u200dfavor of the law.\u201d<\/p>\n<p>One of the <a href=\"https:\/\/legiscan.com\/TX\/rollcall\/SB14\/id\/1324631\" target=\"_blank\" rel=\"noopener\">four Democrats who voted with Republicans<\/a>,\u2064 Shawn Thierry, delivered a sobbing address to\u2064 the legislature, <a href=\"https:\/\/www.dailywire.com\/news\/texas-democrat-lawmaker-cites-science-to-support-banning-minors-from-trans-medical-procedures\" target=\"_blank\" rel=\"noopener\">stating<\/a> that\u2062 she chose to prioritize \u201cthe safety and well-being of all young people over the comfort of\u200b political expediency.\u201d There was a belief in Texas that it was Rufo\u2019s story that\u2062 won over Democrats such\u2062 as\u200d Thierry.<\/p>\n<p>The piece\u2064 also led to a <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/paxton-announces-second-investigation-texas-hospital-potentially-unlawfully-performing-gender\" target=\"_blank\" rel=\"noopener\">formal investigation<\/a> by Texas into the hospital.<\/p>\n<p>\u201cI\u2019ve been clear that any \u2018gender transitioning\u2019 procedures that hurt our children constitute child \u2062abuse under \u2064Texas law,\u201d said Attorney General Paxton. \u201cRecent reports indicate \u200cthat Texas Children\u2019s Hospital may be\u2063 unlawfully performing \u200bsuch procedures, and my office is working to uncover the truth.\u201d<\/p>\n<p>The hospital,\u2064 for \u200cthe second time in fifteen \u2062months, <a href=\"https:\/\/www.houstonpublicmedia.org\/articles\/news\/health-science\/2023\/05\/25\/452850\/texas-childrens-hospital-end-gender-affirming-care-by-september-1\/\" target=\"_blank\" rel=\"noopener\">announced<\/a> that it was shutting down its \u200ctransgender \u2062clinic, calling \u200dit a \u201cheart-wrenching\u201d decision. For Haim, this was a major victory.<\/p>\n<p>\u201cIt\u200b gets big. It\u2019s on Fox News. The Daily Wire covered it, Elon Musk was commenting on it, Jordan Peterson, all these big names,\u201d Haim \u200dsaid. \u201cFor me, that was great. The information that we reported on, which was simply making public what these people were advocating for publicly within the hospital, was voted to become illegal within 24 hours.\u201d<\/p>\n<p>But as the tide \u2063turned \u200dagainst Texas Children\u2019s Hospital, the effort to expose Rufo\u2019s whistleblower began. On \u2062May 19, 2023, the local county attorney Christian Menefee <a href=\"https:\/\/twitter.com\/CDMenefee\/status\/1659592290048917507\" target=\"_blank\" rel=\"noopener\">stated publicly<\/a> that \u201cthe leaker\u200b must be punished.\u201d<\/p>\n<p>\u201cSomeone leaked kids\u2019 medical records from a Houston hospital to right wing activists. Instead of \u2062helping victims, \u2063Ken Paxton is investigating the hospital, pushing phony claims that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/liberal-activists-rebrand-sex-changes-as-gender-affirming-medical-care-to-bully-state-officials-into-allowing-the-mutilation-of-children\/\" title=\"Liberal Activists Rebrand Sex Changes As \u2018Gender-Affirming Medical Care\u2019 To Bully State Officials Into Allowing The Mutilation Of Children\">gender affirming care<\/a> is child abuse,\u201d Menefee wrote, adding that \u200che was working \u2063with \u2064Texas Children\u2019s Hospital to \u201cfully investigate how this \u200bhappened and notify all impacted families if their information was released.\u201d<\/p>\n<p>\u201cI expect they will fully disclose what they find to the United States Department of Health and \u200bHuman Services,\u201d Menefee said. \u201cIf a hospital\u200d employee leaked\u2064 these medical records, they must be fired.\u201d<\/p>\n<p>Rufo responded on X, saying, \u201cI will never give up my sources \u2014 especially those who stand up for kids.\u201d Just one month later, two agents from the Department of Health and Human Services were at his \u2064source\u2019s door.<\/p>\n<h3><b>\u201cThere\u2019s no\u2062 way we\u2019re going to bend the knee \u2062to these people\u201d<\/b><\/h3>\n<p>Menefee implied in\u200d his public threat, without evidence, that the leaker had released children\u2019s\u2064 medical records, stating\u200d that this would be a violation of \u200dthe Health Insurance Portability and Accountability Act, more commonly known as HIPAA.<\/p>\n<p>Haim and his\u200c legal team are insistent that nothing published by Rufo, who made all the materials available \u200don X, would have violated HIPAA.\u200b The images\u2063 he published consisted of heavily-redacted screenshots of clinic and operating room \u200dschedules that can be accessed by medical providers through Epic, the \u200bhospital\u2019s medical record system. To use the industry\u2019s\u2063 terminology, with the redactions, it was all \u201cde-identified data.\u201d<\/p>\n<p>The screenshots contain no information that could be used to identify patients \u2014 they \u200bare schedules showing that doctors at the hospital, Richard Ogden Roberts\u2063 and Kristy Rialon, were \u200bconducting procedures on minors, including implanting \u2064puberty blockers into an 11-year-old girl. The schedules show\u2062 the\u200d doctor, the treatment, the\u2062 diagnosis, and the \u200dage of the patient \u2014 nothing that would constitute a HIPAA violation, according to Haim\u2019s legal team.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">EXCLUSIVE: Last year, \u200dTexas Children&#8217;s Hospital announced it was stopping &#8220;gender-affirming care&#8221; on minors.<\/p>\n<p>But I&#8217;ve obtained\u2064 internal records indicating that TCH secretly restarted its child sex-change \u200bprogram three days later\u2014and has continued it\u200b en masse ever since.<\/p>\n<p>\ud83e\uddf5<\/p>\n<p>\u2014 Christopher F. Rufo \u200b\u2694\ufe0f (@realchrisrufo) <a href=\"https:\/\/twitter.com\/realchrisrufo\/status\/1658558064222699520?ref_src=twsrc%5Etfw\">May 16, 2023<\/a><\/p>\n<\/blockquote>\n<p>But the\u200c Biden administration\u2019s Department of Justice appears to \u200bbe under a different \u2063impression.<\/p>\n<p>Haim declined to\u200b be interviewed by the agents who arrived at \u200chis apartment, opting to speak with an attorney prior to \u2064submitting to any interview. The target letter served to him by the agents and signed\u2063 by the Assistant U.S. Attorney in the Southern District of Texas, Tina \u200cAnsari, made only vague statements about the \u200cinvestigation, though\u200c the agents said it\u200d had to do with \u201cmedical records,\u201d according to Haim.<\/p>\n<p>\u201cThis \u2062office \u200bis \u2063involved in an investigation dealing with \u200cfederal law violations,\u201d the letter said. \u201cYou are a potential target in this criminal \u2062investigation.\u201d<\/p>\n<p>In the months that followed, Haim\u2019s\u2064 legal\u200c representatives spoke with the Department of Justice on multiple occasions. Haim has gotten \u2062the impression that the investigators have a misunderstanding of the facts.<\/p>\n<p>\u201cThey seem to be working \u200dunder\u2063 the \u2064assumption that he\u2063 had released patient names and birthdays in order for them to be targeted by right-wing mobs, which is\u200c completely untrue,\u201d Haim explained. \u201cBut \u2063all the evidence is on Twitter. Everything\u2019s HIPAA-compliant.\u201d<\/p>\n<p>Haim believes that the pursuit by \u2064the Department of Justice \u2062is purely political.<\/p>\n<p>\u201cWhy should\u2064 I be intimidated into silence when what we exposed \u2063was voted to become illegal, and I had \u200dnot violated any privacy laws?\u201d Haim said. \u201cFor me, it\u2019s\u200c obvious that this\u2063 is\u200d a political investigation in order to prevent this from happening at other hospitals \u200bthat\u200c might be\u2063 lying to the public about the existence of their programs.\u201d<\/p>\n<p>The sentiment is \u2063echoed on a <a href=\"https:\/\/www.givesendgo.com\/texas_whistleblower\" target=\"_blank\" rel=\"noopener\">fundraising page<\/a> Haim set\u2062 up to raise money\u2062 for his legal defense, on which he \u2063says the \u2062case is\u2063 \u201cbeing driven by a highly ideological division within the Department of Health \u2064and Human Services that aims to silence whistleblowers who\u200d expose institutionalized medical\u2063 corruption \u2063and the\u2062 dangers of these hormone-based interventions for confused, adolescent children.\u201d<\/p>\n<p>Haim has still not\u2062 been\u200c charged\u2064 with any \u200bcrimes, and is actively working as a general surgeon in a small town in Texas. The Department of Justice\u200b did not respond to a request for\u2063 comment on the status of its investigation.<\/p>\n<p>It remains unclear how Haim was identified by \u200bthe \u200dfederal\u200c government as the leaker. Texas Children\u2019s Hospital did\u200c not \u2064respond to a request for comment on the origins of the criminal probe.<\/p>\n<p>Though Haim, prior to this article and an interview with Rufo that was\u2064 also <a href=\"https:\/\/youtu.be\/FrZDSy6SG4c?si=sVWblyYTbD-xwZ1L\" target=\"_blank\" rel=\"noopener\">published on Wednesday<\/a>, has \u200dnever been identified as the whistleblower for \u200dRufo\u2019s\u200c story, \u200dnor as the public target\u200b of a federal investigation, somebody appears to have figured \u2062it out.<\/p>\n<\/p>\n<p>In the \u2063weeks after he was notified of the investigation, a \u2062series of four negative WebMD reviews have popped up\u200b on his page making outlandish claims, including that he \u201cmutilates patients,\u201d \u201cmutilated me,\u201d and \u201cshould be in jail for being a terrible physician.\u201d Almost certainly \u200dnot a coincidence, the reviews use similar language as\u200b Haim did in an <a href=\"https:\/\/christopherrufo.com\/p\/thrown-to-the-wolves\" target=\"_blank\" rel=\"noopener\">anonymous interview<\/a> with Rufo, \u2064in which he said that \u200bchildren\u2019s sex organs were being \u201cpermanently mutilated\u201d at the hospital.<\/p>\n<p>Not\u2064 only was\u200b the timing of the reviews suspicious \u2014 he wasn\u2019t even seeing patients at the time \u200c\u2014 but WebMD has since revealed that all four negative reviews came from the same IP address.<\/p>\n<p>Haim says he \u2063and his wife have already spent \u2064roughly $250,000 mounting his defense, all\u2064 before charges have even been filed. On his fundraising page \u2062set up to help him deal with the financial costs, Haim\u200c claims they\u2019ve exhausted the \u201centirety of our retirement, investments, savings, and almost all of our disposable income.\u201d<\/p>\n<p>He says it\u2019s all worth it.<\/p>\n<p>\u201cWe have accepted the fact\u200d that this is going\u200b to\u200b be a \u2064financial burden we\u2019ll deal with for decades, which is totally fine,\u201d he said. \u2063\u201cThis is a fight we have to carry. There\u2019s no way \u200bwe\u2019re going to bend the knee\u2063 to these people.\u201d<\/p>\n<p> <\/p>\n<h2> What are Dr. Haim&#8217;s concerns regarding the Department of Justice&#8217;s investigation and how \u200bdoes he plan to address \u200bthem<\/h2>\n<p><span>  The case of whistleblower doctor Eithan Haim has garnered\u200c significant attention after he exposed controversial transgender surgeries \u200dfor minors at a prominent hospital in the United States. In \u200dMay 2023, an article by City Journal&#8217;s Christopher\u2064 Rufo exposed the ongoing procedures at Texas Children&#8217;s Hospital. The publication of \u2063Rufo&#8217;s article resulted \u200din the passing of a bill that officially banned transgender procedures for\u2062 minors in Texas.<\/p>\n<p>However, the \u2064uncovering of Rufo&#8217;s \u2063source sparked backlash. Local county attorney Christian\u2062 Menefee publicly declared \u200cthat the \u200dleaker should be punished,\u200c accusing them\u200c of \u200cviolating privacy laws.
