Reynolds Tobacco Company\u2019s \u2063challenge to a standard\u200b in California that banned flavored\u200b tobacco products in the state.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-3\" style=\"min-width: 320px; min-height: 50px; text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-3'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>The\u200d Supreme\u2064 Court&#8217;s decision means that California&#8217;s\u2064 flavored\u2064 tobacco \u2062ban will remain \u200cintact.<\/p>\n<p>R.J. Reynolds, a subsidiary of British American Tobacco (BAT), and other\u200d plaintiffs had appealed a lower court&#8217;s ruling, arguing that\u2064 California&#8217;s law contradicted a federal\u200b statute governing\u200d tobacco products.<\/p>\n<p>These tobacco companies\u2064 claimed \u2064that the <a href=\"https:\/\/www.fda.gov\/tobacco-products\/rules-regulations-and-guidance\/family-smoking-prevention-and-tobacco-control-act-overview\" target=\"_blank\" rel=\"noreferrer noopener\">Tobacco \u200bControl Act <\/a>(TCA) did not grant states the authority to\u2062 outlaw\u2062 flavored cigarettes. In December 2022, \u200dCalifornia&#8217;s ban on flavored tobacco products \u2063went\u200c into effect, with 62%\u200c of state\u2062 voters \u2062supporting its \u2062passage.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cUnder \u200bthe TCA, states\u2063 have broad authority to regulate the\u200c sale of tobacco \u2062products. \u200bThey can raise the minimum purchase age, restrict \u200csales to particular times and locations,\u200b and enforce licensing regimes. But one thing they cannot do is completely prohibit the sale of those \u2064products \u200cfor failing\u200d to\u2062 meet the state\u2019s \u200bpreferred tobacco\u2064 product standards,\u201d the companies wrote \u2062in a request for\u200c the case \u2064to be taken up by the Supreme Court. \u201cThat is because the TCA\u2019s preemption clause specifically denies states and localities the power to enact \u2018any requirement which is\u2062 different from, or in addition to,\u2019 federal \u2018tobacco product standards.\u201d<\/p>\n<\/blockquote>\n<p>The tobacco companies argued that the Supreme Court should have taken up the case because \u200cthe ban &#8220;shut \u200bthe\u200d doors to one of the Nation\u2019s largest markets for flavored tobacco products and thereby banned a product (menthol\u2063 cigarettes) that has\u200b been lawfully \u200dsold for nearly a century,&#8221; and could result in significant economic losses and job cuts.<\/p>\n<p>California\u200b urged the Supreme\u200b Court not \u200dto take \u2063up the case, with Attorney General Rob Bonta (D-Calif.) stating that states should \u2063have \u200cthe authority to regulate \u200ctobacco \u2064products and citing previous court\u2062 rulings \u2064in support \u200dof \u2062his position.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThis Court long ago recognized the broad\u200d authority of the States to regulate in that way. The Court rejected R.J. Reynolds Tobacco Company&#8217;s challenge to a standard in California that banned flavored tobacco products in the state. This means that California&#8217;s ban on flavored tobacco products will remain \u2062intact.<\/p>\n<p>R.J.
