He is also right to say that\u200c Biden\u2019s policies are causing a\u2063 \u201cnation-wrecking\u2063 nightmare on \u2063our southern border,\u201d and not only on our border,\u200c but in our major cities.<\/p>\n<p>No nation can tolerate for \u200blong the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-releases-list-of-president-trumps-accomplishments-and-it-is-historic\/\" title=\"White House Releases List of President Trump\u2019s Accomplishments \u2013  And It Is Historic!\">record-breaking number<\/a> of illegal immigrants that this country \u2064has seen and <a href=\"https:\/\/www.zerohedge.com\/political\/we-did-it-joe-illegal-migrant-encounters-exceed-300000-first-time-us-history\" target=\"_blank\" rel=\"noreferrer noopener\">continues<\/a> to\u200d see under Joe Biden. Trump\u2019s proposed measures to stem \u200dthis illegal\u2063 tide,\u200c to defend America\u2019s \u2063communities from the inordinate costs\u2064 that it \u200cimposes, \u2063and to enforce the laws as Congress \u200chas written them, are long \u200boverdue.\u2062 And even \u200bif, as Trump recognizes, bold measures including \u201crecord-setting deportation operations\u201d that will result in \u201cmillions\u201d of deportations will be needed, those actions are necessary and \u200bproportionate to\u200b the magnitude of \u200bthe problems Biden has \u2064caused.<\/p>\n<\/blockquote>\n<h3>Trump&#8217;s Proposal \u2064Raises Concerns<\/h3>\n<ul>\n<li>One initiative that Trump proposes, however, should give pause even to his strong supporters (of whom I am one). This is\u200c his pledge to \u201cinvoke the Alien Enemies Act \u200dto remove known or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/like-the-wild-west-chicago-prosecutor-refuses-to-charge-releases-suspects-in-gang-related-gunfight\/\" title=\"\u2018Like The Wild West\u2019: Chicago Prosecutor Refuses To Charge, Releases Suspects In Gang-Related Gunfight\">suspected gang members<\/a>, drug dealers, or \u2063cartel members\u200d from the\u200b United \u200dStates.\u201d<\/li>\n<\/ul>\n<p>The \u2062problem here \u200cis that\u2062 the law in question does not authorize the action Trump proposes. In \u2063the laudable effort to \u2063enforce the immigration laws\u200b as Congress has enacted them,\u2062 a \u200breelected President Trump should not himself stray beyond them into illegality. If he needs new legal\u2063 authorities to take actions that will \u2062protect the \u200cintegrity of America\u2019s borders \u2064and correct the disastrous \u200dpolicies \u2062of the Biden administration, he should \u200cask Congress for those fresh authorities, not simply arrogate them\u200b to himself. He should be \u200daiming to restore the rule of law in \u2062the area of immigration \u200dcontrol (and elsewhere), not to compound Biden\u2019s illegalities\u200b with \u2063his \u200cown.<\/p>\n<p>Trump\u2019s first term began \u200bwith a\u2062 blunder\u200b on immigration law\u200d (the misnamed \u201cMuslim ban\u201d): His original executive\u2062 order had to\u200b go through two\u2063 later rounds of \u2064 <a href=\"https:\/\/www.aclu.org\/news\/immigrants-rights\/muslim-ban-what-just-happened\" target=\"_blank\" rel=\"noreferrer noopener\">revisions<\/a> before finally being \u2063 <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/585\/17-965\/\" target=\"_blank\" rel=\"noreferrer noopener\">upheld<\/a> by the Supreme Court. The episode caused\u200b avoidable \u200dembarrassment \u200bat the start of Trump\u2019s administration. The second\u200d term should not \u200breplay \u2062the error of the first.<\/p>\n<p>The <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/50\/21\" target=\"_blank\" rel=\"noreferrer noopener\">Alien Enemies\u2064 Act<\/a> is \u2062an old statute, \u2064enacted in its original form \u2062in the administration of John Adams. In essence, it provides authority for the president \u2064to remove alien enemies (such as\u2062 German, Japanese, or\u200c Italian nationals in World War II) from the \u2064United States. The act requires\u2064 that an antecedent condition be satisfied before the powers \u2063that it vests are \u200bactivated. Those conditions are either\u200d that (1) \u201cthere\u200c is a declared war between\u2064 the United States and a[] \u200cforeign nation or government,\u201d or that (2) an\u200d \u201cinvasion, or\u200d predatory incursion\u2064 is perpetrated, attempted, or threatened against the \u200bterritory of the\u2062 United States <em>by \u200bany foreign nation or\u2063 government<\/em>\u201d (emphasis\u2063 added).<\/p>\n<p>Broadly speaking, the law provides authority to expel foreign\u200d nationals either \u2063when there is \u200da declared war between the state \u200bof their\u2063 nationality and the United States, or\u2064 else\u200b an \u2064actual or threatened invasion of this country\u2062 by that state.<\/p>\n<p>The first condition is\u2063 not\u2064 met: There is no declared war between\u200d the United States and the only nation \u2014 Mexico \u2014 on its southern border.\u2063 But the second condition is also \u200bnot met. Even if one considers the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrats-recruiting-gop-senators-for-amnesty-deal\/\" title=\"Democrats Recruiting GOP Senators for Amnesty Deal\">illegal border crossings<\/a> of large\u200b numbers\u200b of gang members, \u2063drug dealers,\u200b and cartel members from\u2063 Mexico into the United States to\u2063 be an \u2064\u201cinvasion\u201d (which,\u2064 in a \u200dlegal sense, it might not be), their\u2064 invasion is not being\u2062 done \u2063 <em>by \u200dthe nation\u2063 or \u200bgovernment of Mexico.<\/em> This seems to\u2063 be true even if it could \u2063be established that the government\u2062 of Mexico has not taken (under Biden) adequate steps to police its border with the U.S. or to prevent millions\u200d of illegal aliens from crossing it.<\/p>\n<p>Mexico has assisted U.S. border control operations in the recent past: As\u200d Trump\u2019s op-ed points \u2064out, as president he \u201cgot the Mexican government to deploy tens of thousands of soldiers to the border \u2062free\u2064 of\u200d charge.\u201d \u200bIf Biden has been unwilling to continue such\u200b cooperation\u2063 with the Mexican government, the fault is his: His failure does not make Mexico responsible for the flow of \u200dillegal migrants.<\/p>\n<p>Moreover, Trump\u2019s proposal to use the Alien Enemies Act to \u2062remove \u201cknown or suspected\u201d \u2062gang members and\u200c the rest is not as easy\u2064 to implement as it might seem. It has long been established \u2062that those facing \u2063removal are entitled to \u200dat least a\u200b modicum of due process. While\u200c such a process might be \u200dtruncated\u200b in the case of \u200dthose illegal entrants \u201cknown\u201d to be \u200bgang members\u2064 or the like, it \u200bwould have to be \u2063more substantial for those merely \u2063\u201csuspected\u201d of such \u200bactivities or associations.<\/p>\n<p>None of this is\u2062 to deny that gangs, cartels, and traffickers of drugs or human bodies entering this country from\u2063 Mexico are \u2064not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/premiering-nov-10-830pm-et-flatline-americas-hospital-crisis-documentary\/\" title=\"Premiering Nov 10, 8:30PM ET: Flatline - America's Hospital Crisis | Documentary.\">causing immense harm<\/a> \u2064to the people and institutions of this country. They are, and\u200b our federal government should make every\u200b effort \u200dto stop them. But\u200c the Alien Enemies \u200bAct does not \u200bprovide a legal fix for this \u200bproblem.<\/p>\n<p>A reelected President\u2062 Trump will\u2062 surely encounter \u200ca buzzsaw of left-wing \u2062and \u200ccorporate opposition when he begins \u200bdeporting millions\u200c of aliens who have no legal right to be here. He should not undercut or compromise that program by entangling it with another initiative that the courts\u200c are \u200bvery likely to shoot\u2064 down. He would be better advised to\u2064 toss that ball\u2063 to Congress. On day one, he \u200cshould offer a well-considered piece of legislation to Congress, aimed at the specific targets of cartels, gangs, \u2064and traffickers,\u200d that would\u2064 fully empower him \u200cto \u200cmove swiftly and decisively against them.<\/p>\n<hr class=\"wp-block-separator\">\n<\/div>\n<p> <\/p>\n<h2> What potential \u2063consequences could arise from invoking the Alien Enemies Act in \u200bthe absence of legally justifiable conditions<\/h2>\n<p><span>  Vent individuals involved \u2064in criminal activities from crossing into the United\u200c States.<\/p>\n<p>Therefore, while Trump&#8217;s intention of removing known or suspected gang members, drug\u200c dealers, or cartel members from the United States is commendable, his proposal to invoke the \u200dAlien Enemies Act is misguided. The act does not provide the legal\u200c authority\u200b to take such actions under the \u2062current circumstances. As a leader who claims to prioritize the rule of law, Trump should not overstep the boundaries set by existing legislation.<\/p>\n<p>If Trump\u2063 believes that additional legal authorities \u200dare necessary to address the problems caused\u200c by the Biden administration&#8217;s \u200cpolicies, he should seek the approval of Congress. It is crucial to restore the\u200c integrity \u2064of \u200bAmerica&#8217;s borders and correct the failures of Biden&#8217;s \u2063immigration approach, but it should be done within the confines of the law.<\/p>\n<p>It is worth\u200c noting that Trump&#8217;s first \u200cterm was marred by the controversial &#8220;Muslim ban&#8221; executive order, which\u2063 faced multiple revisions before being upheld by the\u200c Supreme Court. Such missteps should not be repeated in his second term. Taking actions \u200bthat exceed the \u200clegal boundaries would only undermine Trump&#8217;s credibility and invite unnecessary legal challenges.<\/p>\n<p>The Alien \u200cEnemies Act,\u2062 enacted during John Adams&#8217; administration, \u200dwas designed to address specific circumstances, namely a declared war\u200c or an invasion \u2064from a foreign state. Neither of these conditions applies to the \u2064current situation with\u200c Mexico.\u2064 While the \u200binflux of gang members, drug\u2062 dealers,\u2064 and cartel members may be viewed\u200b as an invasion in a broader sense, it\u200b cannot be attributed to the\u200b Mexican \u2064government \u200cas a deliberate act of aggression.<\/p>\n<p>Therefore, it is imperative to carefully consider \u2063the \u2064implications and potential consequences of invoking\u2062 the Alien Enemies Act in the absence of legally justifiable conditions.\u2064 Trump \u2063should focus on\u200b implementing \u2062sensible and\u200c lawful measures that prioritize border security and address the challenges caused by illegal immigration.<\/p>\n<p>In\u2064 conclusion, Trump&#8217;s commitment to reversing Biden&#8217;s border disaster is commendable, given his previous success in enforcing immigration laws. However, his proposal to invoke the Alien Enemies Act raises concerns due to the lack\u200c of legal authority. Trump should seek congressional approval for any necessary\u2064 legislative measures to address the immigration crisis while upholding the rule of law.
