Michael Byrd during the event at the Capitol\u200c in her left shoulder as she was trying to climb through \u2062a barricaded door near the House Speaker\u2019s Lobby\u200c and died at \u200ca nearby hospital.<\/p>\n<p>Her husband, Aaron \u2062Babbitt, filed the lawsuit in \u2063a U.S. District Court in California, alleging several claims against the government.<\/p>\n<p>Judicial Watch, a conservative activist group, said in a press release on Friday that their lawyers will be representing Aaron in the lawsuit,\u200d and he \u2063is seeking $30 million.<\/p>\n<p>In 2021, the U.S. Capitol Police cleared Byrd of any misconduct following an internal\u200d investigation that revealed he may have prevented the deaths of lawmakers and staff \u2064members.<\/p>\n<p>In August 2021, the Justice Department decided not to file charges against Byrd, citing insufficient evidence that Byrd shot Ashli\u2063 in an unreasonable manner or in\u2062 a way that purposefully violated her civil\u200d rights.<\/p>\n<p>However, Aaron claimed in the lawsuit that after his wife was shot, she was ambushed and that several people\u2064 shouted, \u201cYou just murdered her.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p><strong>\u201cAshli was unarmed,\u201d the lawsuit says. \u201cHer hands were up in the air, empty, and in plain view of \u200cLt. \u2062Byrd and other officers in the lobby.
