(Photo by\u200c KAREN BLEIER\/AFP\u2062 via Getty Images)<\/figcaption><\/figure>\n<p>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/brooke-mallory\">Brooke Mallory<\/a><br \/>5:25 PM \u2013 Friday, January 5, 2024<\/p>\n<p>On Friday, the Supreme \u200dCourt rejected a Biden administration attempt to guarantee \u2064easier access to abortion in hospitals in red states by allowing \u2063Idaho to continue enforcing its restriction on the operation in\u200c emergency rooms.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-3\" style=\"min-width: 320px; min-height: 50px; text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-3'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>Just over\u2062 a\u2064 year after Roe v. \u200dWade was overturned, the court decided to hear arguments in the case this spring, bringing a second significant\u200d abortion issue before the justices.<\/p>\n<p>According to Idaho law, a \u2064doctor cannot perform an abortion procedure unless they\u200b can prove that the mother\u2019s life is in danger.<\/p>\n<p>The Biden administration asserted that emergency departments are required by separate federal legislation to offer \u201cstabilizing care,\u201d which includes abortions, in a wider range of situations, such as \u2064when\u200c a \u2063patient\u2019s health is \u2064in \u201cserious jeopardy.\u201d<\/p>\n<p>A significant claim\u200d in the case was made when the Supreme Court reversed Roe v. Wade \u2063last year. Even\u2064 after that, there\u2064 are still a\u2062 lot of unresolved legal issues over the process that are currently pending in\u200d federal courts.<\/p>\n<p>A conservative appeal against the Food and Drug\u2062 Administration\u2019s (FDA\u2019s) \u200clong-standing clearance of the\u200c abortion drug mifepristone has already been accepted by \u200bthe Supreme Court. <\/p>\n<p>The federal legislation at issue in this case mandates that hospitals receiving government\u2064 funds, such as\u2062 those provided \u2062by Medicare, give patients stabilization treatments even if \u200bthey are unable to \u200cpay for it. The goal was to \u201cguarantee \u200bthat all patients would receive basic medical treatment\u201d in hospitals.<\/p>\n<p>Following the Roe v. Wade ruling by the Supreme Court, the\u200d Biden administration declared that federal \u2064law mandates hospitals to give expectant patients the same treatment, including the option to have an abortion if required, even in states \u2064where the procedure is prohibited.<\/p>\n<p>Idaho officials say\u2062 that \u2063the Medicare\u200b law is being interpreted \u200cas a \u201cfederal super-statute on the issue of abortion, one that strips Idaho of its sovereign interest\u200b in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/human-smugglers-are-using-bidens-border-incompetence-and-social-media-to-find-their-next-victims\/\" title=\"Human Smugglers Are Using Biden\u2019s Border Incompetence And Social Media To Find Their Next Victims\">protecting innocent human life<\/a> and turns emergency rooms into a federal enclave where \u200bstate standards of care do not \u200capply.\u201d<\/p>\n<p>However, according\u2062 to\u200d the Justice Department, the guideline just clarifies already-existing federal\u200c law. Federal officials maintain that state laws prohibiting \u200dabortion that took effect\u2062 last year are superseded by that federal legislation.<\/p>\n<p>Pregnancy can cause serious \u200bmedical issues in some women, such\u2063 as sepsis, uncontrollable bleeding, renal failure, and loss of fertility, which would not be covered under provisions for the life of \u200ca mother.<\/p>\n<p>Idaho was backed by twenty conservative states, many\u2063 of which had strong abortion prohibitions. However, the recommendation from the Biden administration may possibly \u2062affect more states\u200c than just conservative ones with stringent limitations.<\/p>\n<p>Those with more\u200d generous exemptions\u2063 than Idaho\u2019s,\u200b or those without outright\u2063 bans on abortion,\u2064 may also be impacted. Even if their state \u200clegislation would \u200cnormally permit abortions, religiously affiliated institutions that\u200d accept \u200cfederal financing but refuse to \u2062perform them\u2064 are subject to the federal \u2062statute in question.<\/p>\n<p>Earlier this month, a federal \u2064appeals\u2064 court \u200cin California\u200d temporarily ruled with the Biden administration, preventing the implementation of the relevant portions of the\u200c Idaho statute.\u2063 The Supreme Court\u2019s decision merely resolves the issue temporarily\u2062 and forbids \u200cthe Idaho law\u2019s execution while the underlying legal dispute is resolved in the lower courts.<\/p>\n<p>Stay informed!
