The appeal was heard by Judge \u200cLeslie Southwick, a George W. Bush appointee, and Trump appointees Kurt Engelhardt\u200d and Cory Wilson.<\/p>\n<p>The\u2063 5<sup>th<\/sup> \u200d Circuit panel \u2063sided with Texas, arguing that the language in the 1986\u2062 emergency care law requires hospitals to \u200c&#8221;stabilize&#8221;\u2062 both the pregnant \u2063woman and her fetus.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;The Texas plaintiffs&#8217; argument that medical treatment is\u200d historically subject to the police power of the\u2063 States, not \u2062to be\u2064 superseded unless that was the clear\u2064 and manifest purpose\u2064 of Congress, \u2062is convincing,&#8221; Engelhardt wrote.<\/p>\n<\/blockquote>\n<p>Last month, the \u2064Texas\u2062 Supreme Court denied a request for an emergency court order that would have\u2063 allowed Kate Cox, a\u2063 pregnant woman whose\u200b fetus had \u200ba fatal \u200bdiagnosis,\u2062 to have an abortion in the \u2064state. As a result, Cox\u2062 had to leave \u200dTexas to \u2064undergo the procedure.<\/p>\n<p>In 2022, Paxton filed a lawsuit to block oversight from \u2062the Department of Health \u200dand Human Services, which stated \u2062that doctors should provide abortions\u2063 in emergency cases in accordance\u2063 with a federal law passed in \u200c1986.<\/p>\n<p>This forced doctors to provide necessary care\u200b to patients in emergency rooms, regardless of their \u2064financial situation.<\/p>\n<p>The \u2064Biden administration also faced a ruling by United States\u2063 District Judge James Wesley Hendrix,\u200b who prohibited the federal \u2062agency from \u2063enforcing the\u2062 oversight in \u200cTexas and against two\u2062 anti-abortion groups of doctors in 2022.<\/p>\n<p>In his decision, Hendrix concluded that the department&#8217;s guidelines went &#8220;well \u2064beyond&#8221; the written language\u200c of the\u2062 Emergency Medical Treatment and Labor Act.<\/p>\n<p>In Tuesday&#8217;s \u2062opinion, \u200bEngelhardt stated \u2063that the appeals\u2062 court agreed\u2064 with the district court&#8217;s \u200dfinding that the federal \u200cstatute known\u200b as EMTALA &#8220;does not \u2064provide an unqualified right \u200bfor the pregnant mother\u200c to abort her child, especially when EMTALA imposes equal stabilization obligations.&#8221;<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;We therefore decline to expand\u2064 the scope of EMTALA,&#8221; Engelhardt added.<\/p>\n<\/blockquote>\n<p>Stay informed!
