The Mickey\u200b of <em>Steamboat Willie<\/em> \u200chas small, pupil-less black eyes instead of \u200dthe\u200b modern Mickey\u2019s oversized shoes and gloves.<\/p>\n<p>A \u200dHarvard Law School professor named Rebecca Tushnet, made a statement about the situation, claiming that while <em>Steamboat Willie<\/em> can be redefined in any way because of the public domain, certain elements of the more contemporary Mickey Mouse cannot be replicated. Disney \u200dretains\u2064 trademark ownership over those versions.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWhatever you do, to\u200b be protected against copyright infringement claims \u2026 you really have to be making new stuff\u200d and be sure you\u200c are \u200bbasing it on Steamboat \u2064Willie,\u201d Tushnet said.<\/p>\n<\/blockquote>\n<p>Tushnet also stated that although\u2062 Disney is forced to \u201cgrudgingly concede\u201d its hold on the reputation of <em>Steamboat Willie<\/em>, \u200cthe company will most likely sue anyone who recreates a new version of the character that nearly resembles Mickey Mouse.<\/p>\n<p>The Harvard professor forecasted\u2063 that one of the initial places that the character\u2063 might be recreated is on Etsy, an online selling platform. However, she said that one poor\u2063 step may open small businesses and artists on Etsy\u200b up to lawsuits from Disney.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cUnfortunately, those \u200cpeople are precisely the kind of people who are\u200d unlikely to have the resources \u200cto actually figure out the\u200d legal boundaries,\u201d Tushnet\u200c stated.<\/p>\n<\/blockquote>\n<p>However,\u2064 Disney\u2019s close grip on the \u200ciconic character may hold some\u2063 exceptions.
