Let&#8217;s dive into the details.<\/p>\n<h3>The\u200d Charges Against Trump<\/h3>\n<p>Special Counsel Smith indicted Trump\u200c with four counts in \u2063a federal \u2063court in D.C.,\u200b holding\u2062 him criminally responsible for the events of Jan. 6, 2021. The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/michigan-attorney-general-wants-opponent-investigated-over-2020-election-claims\/\" title=\"Michigan Attorney General Wants Opponent Investigated Over 2020 Election Claims\">charges include conspiracy<\/a> to defraud the\u2062 United States, conspiracy against rights, conspiracy to obstruct an official proceeding, and\u200b obstruction of and attempt to obstruct an official proceeding.<\/p>\n<p>Now, the Supreme Court will determine whether the events of Jan. 6 can be considered criminal obstruction of an official\u200d proceeding under Section 1512 of the \u2063<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/5-key-takeaways-from-clinton-lawyer-michael-sussmanns-latest-attempt-to-get-criminal-charges-dismissed\/\" title=\"5 Key Takeaways From Clinton Lawyer Michael Sussmann\u2019s Latest Attempt To Get Criminal Charges Dismissed\">federal criminal code<\/a> in <em>United States v. To understand this, \u200bwe need \u2063to closely examine the specific language of the statute. Section 1512(c) \u200dstates:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>(c) \u2062Whoever corruptly \u2014 <\/p>\n<p>(1) alters, \u2062destroys, mutilates, or conceals a record, document, or \u200bother object, or attempts\u2064 to do\u2062 so, with the intent to\u2063 impair the\u2064 object\u2019s integrity or availability for use in \u2063an official proceeding; or <\/p>\n<p>(2) otherwise obstructs, influences, or impedes any official proceeding, or attempts\u200c to do so, <\/p>\n<p>shall be fined under this\u2064 title or imprisoned not more than 20 years, or both.<\/p>\n<\/blockquote>\n<p>Fischer\u2062 and Trump, along\u2062 with other defendants from Jan. 6, were charged with violating subsection 2 of\u200d \u00a7 1512(c) by &#8220;otherwise&#8221; obstructing or \u200bimpeding\u200b the certification \u200bof the electoral vote. \u200dFischer argued that the statute\u200c only criminalizes conduct that renders evidence unavailable to an \u2064&#8221;official proceeding.&#8221; The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/blackmail-cotton-blasts-dems-threatening-to-pack-supreme-court-if-it-upholds-mississippi-pro-life-law\/\" title=\"\u2018Blackmail\u2019: Cotton Blasts Dems Threatening To Pack Supreme Court If It Upholds Mississippi Pro-Life Law\">district court agreed<\/a> and dismissed the\u200d charge against Fischer, but \u2064the government appealed.<\/p>\n<h3>The Supreme Court&#8217;s Likely Decision<\/h3>\n<p>Based on\u200d previous \u200dSupreme Court decisions, it seems likely that the\u2062 high court \u2063will rule in favor of Fischer, Trump,\u2064 and other defendants from \u2062Jan. 6. In a similar case, <em>Begay v.\u2062 United States<\/em>,\u2062 the \u2063Supreme Court interpreted a statute that also used an &#8220;otherwise&#8221; \u200dcatchall clause.<\/p>\n<p>In <em>Begay<\/em>,\u200b the court held that a prior felony DUI conviction did not constitute\u200b a \u2062&#8221;violent felony&#8221; under the &#8220;otherwise&#8221; language of the statute. \u2063The majority reasoned\u200b that the\u200c listed examples in the statute indicated that it only covers similar crimes, rather than every crime that presents a serious potential risk of physical injury.<\/p>\n<p>Applying this\u2064 reasoning to \u2062the <em>Fischer<\/em> case, it\u2064 can be argued that\u200d subsection 2 of \u200d\u00a7 1512(c) only criminalizes conduct \u200cthat is similar to the conduct covered\u200d by subsection 1. Since the indictment against Fischer does not allege any impairment of evidence relevant \u2063to an official proceeding, it is likely that the \u200cSupreme Court will dismiss\u2063 the charge against \u200chim. The same would apply to \u200cTrump&#8217;s \u00a7 1512(c) charge \u2062and the\u2062 second count alleging conspiracy to violate the statute.<\/p>\n<p>With \u2062the \u2062Supreme Court set to decide the <em>Fischer<\/em> appeal this term, it would be reasonable for Special Counsel Smith to pause the \u2064criminal trial \u200dagainst Trump until a ruling\u2064 is made. However, it seems that\u200b Smith&#8217;s true\u2064 goal is to obtain a conviction against Trump\u200d before the \u200c2024 election, rather than \u2064seeking justice.<\/p>\n<p>But as the <em>Fischer<\/em> \u2064 case may soon reveal, the crimes Smith is pursuing may not\u200d even exist. They claim that Fischer&#8217;s actions on Jan. 6, which disrupted the certification of\u2064 the electoral vote, fall within the scope of the statute.<\/p>\n<p>The Supreme\u200b Court&#8217;s ruling in the Fischer case will have significant implications for Trump&#8217;s appeal. If the Court interprets\u2062 subsection 2 narrowly, it could\u2063 potentially dismiss the charges against Trump, as\u200c his actions on \u200bJan. 6 may not \u200bmeet\u200d the criteria of directly obstructing an \u2063official proceeding. However, if the Court \u2064adopts a broad interpretation, it may sustain the charges and allow the case to proceed.<\/p>\n<p>It is important to note that the Supreme Court&#8217;s decision in\u200d the Fischer case will not only impact Trump&#8217;s appeal but\u200c also have \u200cbroader implications for future cases involving obstruction of an official proceeding.
