In a new report by the\u2063 Manhattan Institute, Notre\u2062 Dame Law Professor\u2064 Nicole\u200d Stelle Garnett and I uncover\u200d the rampant unconstitutional religious discrimination happening in state programs \u2062throughout the country.<\/p>\n<\/blockquote>\n<p>The Supreme Court, \u2062in last year\u2019s Carson v. Makin case, made it clear that states cannot exclude religious organizations or\u2062 force them to\u2064 secularize. However, \u2063many states, including those expected to embrace religious\u2062 freedom, continue to\u2062 unfairly discriminate against \u200breligious schools and charities.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-2000258596\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-67f22c52b32fbc2a6f6b6a1a6831c60e fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-67f22c52b32fbc2a6f6b6a1a6831c60e\"><\/div>\n<p>Here are nine surprising offenders:<\/p>\n<h2>1. Virginia<\/h2>\n<p>Disabled students in Virginia suffer due to the\u200b state&#8217;s\u200d violation of\u200b the First\u200c Amendment. Virginia&#8217;s school districts and local governments can \u2063only contract\u2063 with non-religious institutions for special \u2062education\u2064 services, forcing students with religious affiliations to attend further or inferior options.<\/p>\n<p>Virginia also unfairly treats religious\u200b institutions in various ways, such as excluding them from receiving funds\u2064 for social services and\u2062 historic preservation consideration. Even \u2062fuel used in school buses taking students to religious schools is not eligible\u200c for tax rebates.<\/p>\n<div class=\"fdrlst__b89e9-65a5f147099d64edd8bc26db60f61386 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-65a5f147099d64edd8bc26db60f61386\"><\/div>\n<h2>2. Montana<\/h2>\n<p>Montana, like Virginia, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-poised-to-deliver-victory-for-school-choice-in-religious-vouchers-case\/\" title=\"Supreme Court Poised To Deliver Victory for School Choice in Religious Vouchers Case\">excludes religious schools<\/a> from its\u200b school bus fuel tax rebate. It also restricts work-study programs \u200band <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/five-unorthodox-pro-life-bills-advancing-in-state-legislatures\/\" title=\"Five Unorthodox Pro-Life Bills Advancing In State Legislatures\">specialty license plates<\/a> for religious\u2062 nonprofits.<\/p>\n<h2>3. Georgia<\/h2>\n<p>Georgia\u2062 prohibits pre-kindergarten providers\u2062 from giving any religious instruction and imposes restrictions on support services for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/here-are-5-common-sense-education-proposals-democrats-shot-down\/\" title=\"Here Are 5 Common Sense Education Proposals Democrats Shot Down\">high-risk students<\/a> \u200din religious schools. It even limits the generosity\u200d of its employees by excluding contributions to religious \u2062organizations.<\/p>\n<h2>4. Alabama<\/h2>\n<p>Alabama allows a moment of silence during the pre-K school day but forbids religious \u200cinstruction. It also places restrictions on funding structures used for religious purposes and excludes faith-based organizations \u200cfrom its employees&#8217; charitable campaign.<\/p>\n<h2>5. Arkansas<\/h2>\n<p>Arkansas restricts pre-K content to be secular and nonsectarian, and it excludes religious projects from its Small Museum Grant Program. It also prevents\u2064 waterworks commissions\u2062 from donating to \u200csectarian nonprofits.<\/p>\n<h2>6. Oregon<\/h2>\n<p>Oregon goes a step\u2064 further by outright banning\u200b religious organizations from\u200b its universal pre-K program. It also restricts course selections for high school\u2063 and college students \u2063to nonsectarian\u200c options.<\/p>\n<h2>7. Florida<\/h2>\n<p>Florida excludes \u2064sectarian organizations from \u200cits <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/vaccine-mandates-hit-schools\/\" title=\"Vaccine Mandates Hit Schools\">remote learning program<\/a> and scholarship programs. It also\u200d places restrictions on the content\u200b of programming provided to victims of domestic violence.<\/p>\n<h2>8. Missouri<\/h2>\n<p>Missouri has made \u200dimprovements but still falls\u2064 short \u200din certain areas. It restricts the\u200d use of state loans for\u2063 sectarian instruction and excludes support services for \u200dhigh-risk students \u2062in\u200c religious schools.<\/p>\n<h2>9. Indiana<\/h2>\n<p>Indiana prohibits students from being paid\u2064 for sectarian\u2064 work and excludes religious projects from its\u2064 historic preservation grant program. It even regulates the religious expression of \u200bthe deceased.<\/p>\n<h2>The Path Forward<\/h2>\n<p>American conservatives, often \u200dseen as defenders of \u2064religious liberty,\u2064 may\u2064 be surprised to find their states among the \u200dworst violators of the Carson principle. However, there is hope for change. Red states can quickly remedy these violations by \u200damending laws or \u200bissuing opinion\u2064 letters\u2062 from state attorneys general. Organizations \u2064like the Becket\u2063 Fund and religious liberty clinics are ready to fight for infringed religious liberties.<\/p>\n<div class=\"fdrlst__b89e9-4e8ab1c4e111afedd1a085ff79387e50 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-4e8ab1c4e111afedd1a085ff79387e50\"><\/div>\n<hr class=\"wp-block-separator\">\n<\/div>\n<p> <\/p>\n<h2> How does\u2064 Colorado&#8217;s exclusion of religious organizations from\u200b accessing \u200cstate grants impact the educational options \u200bavailable to families<\/h2>\n<p><span>  Rictions on the ability of religious schools to receive \u2063or distribute state funds for various programs and services. Additionally, Alabama has\u200d enacted laws that prevent certain religious organizations from receiving property tax exemptions and imposes limitations on the \u200bability of religious schools \u200dto participate in \u200dpublic school sports programs.<\/p>\n<h2>5. Maine<\/h2>\n<p>Maine prevents religious schools from participating\u200d in the state&#8217;s tuition \u2062assistance program, denying students the opportunity to receive financial \u2064aid for \u200btheir education. This not only restricts the choices\u2062 available to students and their families but also hinders the ability of religious schools to thrive and\u2062 provide\u2062 quality education.<\/p>\n<h2>6. Colorado<\/h2>\n<p>Colorado has implemented policies that exclude\u2063 religious organizations \u200dfrom accessing state \u200bgrants for\u200c various purposes, including private\u200b school vouchers. This discriminatory\u2064 treatment restricts the educational options available to families and limits the ability\u200d of religious schools \u2063to operate and serve their communities.<\/p>\n<h2>7. Kentucky<\/h2>\n<p>Kentucky denies\u2063 certain religious entities the ability to participate in the state&#8217;s foster care and adoption services. By\u200d excluding\u2062 these organizations\u200c solely based on their religious affiliations, the state is preventing many children from finding loving homes and perpetuating discrimination against religious institutions.<\/p>\n<h2>8. Missouri<\/h2>\n<p>Missouri has\u200d enacted laws that restrict religious\u2064 organizations from accessing state funding for various social welfare programs. This not only undermines the ability \u200bof these \u200borganizations to provide crucial support to\u200c vulnerable individuals and\u2062 communities but also\u2063 unfairly\u2064 discriminates \u200cagainst them based on their religious beliefs.<\/p>\n<h2>9. New \u200dMexico<\/h2>\n<p>New Mexico excludes religious entities from participating in various state programs and services, including the state&#8217;s textbook loan program. This \u2064denies students \u2064attending religious schools access to \u2062necessary educational resources, hindering their\u2062 academic advancement and impeding the ability \u200dof religious\u2063 schools \u200dto provide a\u200b well-rounded education.<\/p>\n<p>These examples are just \u2062a snapshot of \u200cthe religious discrimination \u200boccurring across the country. \u2064It is essential that \u200cwe recognize and address these\u2064 injustices\u2062 to uphold the principles of religious \u2062freedom \u200cand equal treatment for \u2062all. Religious schools and charities play a vital role in our society, and they should not\u200c be \u200dunfairly excluded or\u200b disadvantaged\u2063 by state programs and \u2062policies.<\/p>\n<p>If we \u2064truly value religious\u200d freedom, it is necessary to ensure that government\u2063 actions do \u2064not infringe upon the rights\u200c of religious institutions and individuals. The Supreme \u2062Court&#8217;s decision in Carson v.
