In\u200d 2021,\u2063 WMU <a href=\"https:\/\/www.mlive.com\/news\/kalamazoo\/2023\/03\/wmu-professors-contract-not-renewed-due-to-views-on-homosexual-behavior-lawsuit-says.html\" target=\"_blank\" rel=\"noreferrer noopener\">fired\u200c adjunct music professor Daniel Mattson<\/a> \u2064 simply\u200d because he expressed his religious views off-campus during his personal time. After a remarkably\u200b short seven\u2062 months of \u2062litigation, Mattson was\u200c vindicated on October 31st of this \u200byear.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-571876996\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-998919e793013f1949c39d0488d0085f fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-998919e793013f1949c39d0488d0085f\"><\/div>\n<p>Mattson, an accomplished \u200csymphony\u2063 trombonist, had been a part of WMU&#8217;s School of Music \u2063since 1999. He performed with the\u2063 university&#8217;s\u200d Western Brass Quintet, which consisted of faculty members \u2062from the School of Music. Additionally, Mattson played \u2063with the Western \u200bWinds, a student-faculty \u2063ensemble.<\/p>\n<p>In 2009, Mattson returned to Catholicism and left behind his previous homosexual lifestyle. For years, he wrote \u200darticles and\u2062 spoke \u2062at public events, sharing his perspective on \u2064how the church\u2062 should engage with individuals who\u200c experience same-sex attraction. Throughout \u2064this time, Mattson kept his \u2062religious activities separate \u2062from his work\u200d at \u200cWMU and never imposed his beliefs \u2064on his students.<\/p>\n<h2 class=\"wp-block-heading\">Punished for Christian Ideas<\/h2>\n<p>In 2017, Mattson \u2062published <em><a href=\"https:\/\/www.amazon.com\/-\/es\/Daniel-Mattson\/dp\/1621640728\" target=\"_blank\" rel=\"noreferrer noopener\">Why I\u2062 Don\u2019t Call Myself Gay:\u2064 How I Reclaimed My Sexual Reality and Found Peace<\/a><\/em>, an autobiography detailing his experience with \u200csame-sex attraction. He \u2063advocated for the church to compassionately\u200d engage\u200b with individuals\u200b who \u2064experience\u2062 same-sex attraction while presenting Catholicism as a\u2064 better alternative.<\/p>\n<p>In October 2021, Mattson agreed to perform as a guest artist at the School of Music. However, a newly appointed faculty member and\u2062 LGBT \u2064activist \u200ddiscovered Mattson&#8217;s writings about his experiences with homosexuality \u2063and his return to \u2063Catholicism. She \u200claunched a\u200d campaign \u2064to \u200dcancel Mattson&#8217;s planned events, stating\u2063 on Twitter, &#8220;I won&#8217;t be attending any \u2063recitals\u200b by ex-gay activists, thanks.&#8221;<\/p>\n<div class=\"fdrlst__b89e9-ad4c0f7d88859cff9fc35ca817ae80d1 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-ad4c0f7d88859cff9fc35ca817ae80d1\"><\/div>\n<p>She\u200c rallied students, faculty members, and DEI administrators to join her cause. In the weeks \u2064leading up to the recital, there \u200cwere extensive discussions via email\u2063 and \u2062social media, with\u2064 many expressing support \u2064for the idea that Mattson&#8217;s presence on \u2063campus\u200b was &#8220;harmful&#8221; to LGBT students.<\/p>\n<p>The university administration swiftly and harshly responded to the outcry against Mattson&#8217;s religious speech. They stripped him of his core duties, hindered his involvement in\u200c important school activities, and ultimately refused\u2062 to renew his teaching contract.<\/p>\n<p>Mattson refused to be silenced without\u2064 a fight. He challenged WMU&#8217;s ultimatum, which forced\u200b him to \u2062choose between his\u2063 career as an esteemed artist and mentor on campus\u2064 and his life as a religious \u200bbeliever and advocate\u2063 for conflicted Catholics off-campus.<\/p>\n<h2 class=\"wp-block-heading\">Violations of Free Speech\u2062 and Religion<\/h2>\n<p>In March \u20642023, Mattson,\u2064 represented by the Center for\u200c Individual Rights,\u2063 a nonprofit\u2062 public interest law firm, \u2063 <a href=\"https:\/\/www.scribd.com\/document\/632998240\/WMU-adjunct-professor-lawsuit\" target=\"_blank\" rel=\"noreferrer noopener\">filed a \u2063federal lawsuit<\/a> challenging\u200b his termination as a violation \u200dof his rights to religious freedom and freedom of speech under the First and 14th Amendments.<\/p>\n<div class=\"fdrlst__b89e9-0f668da146d882a17c3b90eb2554fa8c fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-0f668da146d882a17c3b90eb2554fa8c\"><\/div>\n<p>WMU&#8217;s attempts to cancel Mattson clashed\u200d with Supreme Court \u2064precedents that protect the right to religious free speech. In the recent case\u200b of <em>Kennedy v. Bremerton School District<\/em>, the Supreme Court reaffirmed \u200dthat\u2062 government actions that burden sincere religious practices\u2063 must be justified by \u2064a\u200c compelling\u2062 government interest and narrowly\u200c tailored to\u2063 that \u2062interest.<\/p>\n<p>In the 2018\u2063 decision of <em>Masterpiece Cake Shop v. Colorado Civil Rights Commission<\/em>, the court recognized that a\u200d violation of free exercise\u2062 can\u2064 also be proven by demonstrating government \u2062hostility towards religion. In this case, the <a href=\"https:\/\/www.scribd.com\/document\/632998240\/WMU-adjunct-professor-lawsuit\" target=\"_blank\" rel=\"noreferrer noopener\">school administration&#8217;s email<\/a> to the entire community made their views clear: &#8220;Mr. Mattson \u2063is also a high-visibility \u200badvocate for the position \u200cthat homosexuality is a chosen lifestyle that is to be avoided. He \u200dhas\u200d stated his \u200bposition strongly and widely. While he is free to express his beliefs, we\u200b cannot ignore the fact that they \u200bare harmful to members of our\u200b LGBTQ community, particularly our students.&#8221;<\/p>\n<p>Furthermore, laws dating back to the 1960s prohibit \u2064public \u2062employers from\u200d retaliating against \u200bemployees based on \u2063protected speech\u200b that addresses\u200c matters of public concern and is \u2064not part of their official duties.<\/p>\n<p>Faced with the legal authority supporting Mattson&#8217;s case and his refusal to be \u2062easily canceled, WMU quickly responded. Instead of defending \u2064their sectarian or \u2062viewpoint-based punishment in court, less than seven months after\u2063 the lawsuit\u2063 was filed, WMU settled the case and agreed to compensate Mattson for damages\u2064 and attorney&#8217;s fees.<\/p>\n<p>These are\u200c the tactics of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/walsh-while-others-are-canceled-for-tweets-and-jokes-cardi-b-suffers-no-consequences-for-drugging-and-robbing-men\/\" title=\"WALSH: While Others Are Canceled For Tweets And Jokes, Cardi B Suffers No Consequences For Drugging And Robbing Men\">leftist cancel mob<\/a>. Rather than a government-controlled censorship regime, activist mobs have informally collaborated with\u2063 DEI bureaucrats to pressure administrators\u2063 into censoring, \u2063punishing, expelling, and firing students and professors who challenge leftist orthodoxies on\u200b race and gender. These radicals have\u200b responded to even the slightest \u2063deviations from DEI orthodoxy \u2064with severe consequences, putting sincere religious believers \u2064at risk\u200b of losing their livelihoods.<\/p>\n<p>For Mattson, the victory goes beyond financial compensation. It is a vindication \u2062of his fight for \u200cthe rights\u200d of \u2064all individuals to\u2063 express\u2063 their religious beliefs, regardless of others&#8217; opinions. \u200bWith more victories like this, we can hope to see a turning point in the battle against cancel culture.<\/p>\n<div class=\"fdrlst__b89e9-913b256d396b2cce0c6b9ce6b834f43e fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-913b256d396b2cce0c6b9ce6b834f43e\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n<p> \u200b rnrn  <\/p>\n<h2> Should universities have the power to terminate employees based on their\u200b personal beliefs, and what effect does this have on academic freedom<\/h2>\n<p><span>  Lear: they believed Mattson&#8217;s religious speech was harmful to LGBT students and therefore justified his termination.<\/p>\n<p>However, Mattson&#8217;s lawsuit argues that the\u200c university&#8217;s actions violated his rights to\u2063 freedom of speech and \u200dreligion. He contends that expressing his religious views off-campus during his personal time should not result in punishment or termination from his job. However, in recent years, there has been a growing trend of silencing unpopular or \u2062controversial views on college campuses. The rise of\u200d cancel culture and\u2062 mob mentality has created an environment where\u2062 anyone who deviates from the prevailing ideology can be ostracized and punished.<\/p>\n<p>But this case demonstrates that there is hope for change. Legal battles like the one fought by Daniel Mattson can provide a pathway\u200d to protect the rights of \u2062professors and\u200c students to\u2062 express their views without fear of retribution. The outcome of this case will have far-reaching implications \u2063for academic freedom\u200b and the future of free speech on college campuses.<\/p>\n<p>Universities have a responsibility to uphold the principles of \u200bfree speech and intellectual diversity. They \u2062should foster an environment where ideas \u200ccan be freely exchanged and debated,\u200d even if they\u2064 are controversial or unpopular.
