That would \u200dmean the charges against him would\u2062 be thrown out.<\/p>\n<p>U.S. \u2064District Judge Tanya Chutkan <a href=\"https:\/\/www.westernjournal.com\/trump-not-entitled-presidential-immunity-j6-civil-lawsuits-federal-appeals-court-rules\/\" target=\"_blank\" rel=\"noopener\">disagreed<\/a> in a fiery Dec.\u2064 1 ruling \u2064that said\u2062 Trump\u2019s \u201cfour-year service as Commander \u2063in Chief did not bestow on him\u2064 the \u2063divine right of kings to evade the criminal accountability that \u2064governs his fellow\u200b citizens,\u201d according to <a href=\"https:\/\/www.cnn.com\/2023\/12\/01\/politics\/trump-presidential-immunity-election-subversion-case-chutkan\/index.html\" target=\"_blank\" rel=\"noopener\">CNN<\/a>.<\/p>\n<p>Trump appealed the \u200cruling, beginning a chain of\u200c appeals that\u2064 is not likely to stop \u2062until it \u2063reaches the U.S. Supreme\u200b Court.<\/p>\n<p>On Wednesday, Chutkan <a href=\"https:\/\/s3.documentcloud.org\/documents\/24223135\/chutkan-ruling-on-trial-stay.pdf\" target=\"_blank\" rel=\"noopener\">issued an order<\/a> recognizing that the case might not make it to trial if <a href=\"https:\/\/www.westernjournal.com\/supreme-court-agrees-hear-jan-6-defendants-appeal-implications-trump-prosecution-enormous\/\" target=\"_blank\" rel=\"noopener\">Trump<\/a> is successful in his appeal.<\/p>\n<p>\u201cDefendant\u2019s appeal automatically stays \u200cany further proceedings that would \u200cmove this case \u2062towards trial or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/newsom-recall-petition-close-to-success\/\" title=\"Newsom Recall Petition Close To Success\">impose additional burdens<\/a> of litigation on Defendant,\u201d the judge wrote, adding that the ruling \u201cSTAYS the deadlines \u200dand proceedings scheduled \u200dby \u2063its Pretrial Order, as amended.\u201d<\/p>\n<p>The ruling noted that the\u200c pause lasts only as long as the appeals process continues and that any delay \u2062to the scheduled March 4 \u2063trial date would be considered \u200cbased\u200d on \u2062the time it takes for the court\u200d system to deal with the former president\u2019s appeal.<\/p>\n<p>It also said restrictions upon Trump, including\u200c a <a href=\"https:\/\/www.westernjournal.com\/trump-goes-nuclear-federal-judge-reimposes-gag-order-will-not-stand\/\" target=\"_blank\" rel=\"noopener\">gag order<\/a> Chutkan\u2062 issued, remain in effect.<\/p>\n<p>Trump\u2019s campaign said \u200dthe ruling will deprive \u2062special prosecutor Jack Smith of what Trump has alleged the Biden administration wants most \u2014 a trial that takes place before the 2024\u2064 presidential election.<\/p>\n<p>\u201cThis\u200b is a big win for \u200c <strong>President Trump<\/strong> \u200dand our rule of law, as\u2062 it derails Deranged \u200dJack Smith\u2019s rush to judgment strategy of interfering in \u2062the 2024 Presidential Election in support \u2063of Joe Biden\u2019s campaign,\u201d Trump campaign \u2062representative Steven \u2063Cheung said, according \u200cto <a href=\"https:\/\/thehill.com\/homenews\/campaign\/4359020-trump-campaign-jan-6-case-pause\/\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>.<\/p>\n<p>\u201cThey\u200d waited almost three years to bring this hoax\u200d \u2018case\u2019 and \u2064are now desperately trying, and failing, to \u2062rush it because\u2063 they know President Trump is dominating \u2062the election,\u201d Cheung said.<\/p>\n<p>\u201cThe Constitution should\u2063 not be suspended in a baseless \u200dprosecution against the leading candidate for \u2062President. The American people,\u200c not the courts, should decide who becomes president, and they are supporting President Trump in historic numbers,\u201d he said.<\/p>\n<p>Smith already\u200c has asked the Supreme\u2064 Court to give him special treatment to <a href=\"https:\/\/www.westernjournal.com\/jack-smith-runs-supreme-court-asks-justices-make-first-ruling-trump\/\" target=\"_blank\" rel=\"noopener\">expedite its hearing<\/a> of Trump\u2019s appeal on the immunity issue.<\/p>\n<p>The Supreme Court has asked the Trump legal\u2062 team to reply to Smith\u2019s call for speed.
