FALLON\/AFP via Getty Images)<\/figcaption><\/figure>\n<h2>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/elizabeth-volberding\">Elizabeth Volberding<br \/><\/a>5:45 PM \u2013 Tuesday,\u2063 December 12, 2023<\/h2>\n<p>A United \u200cStates judge has upheld Texas&#8217;s ban on the popular video app, TikTok,\u200b on state-owned devices or \u200dnetworks.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-3\" style=\"min-width: 320px; min-height: 50px; text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-3'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>In a groundbreaking decision, a federal judge in Texas has upheld a law that\u200d prohibits the use of \u2064TikTok on state-owned devices\u2063 and networks.<\/p>\n<p>U.S. District Judge Robert Pitman dismissed a lawsuit brought by the Knight First \u2063Amendment Institute at Columbia University, which argued that the ban violated \u2062the First Amendment by restricting the use \u200dof TikTok on public university Wi-Fi.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWhile the Court\u2062 recognizes\u2064 the importance both of protecting academic\u200c freedom and supporting public employees\u2019 right\u200c to free speech, the Court finds that these important ideals\u200c do not dictate the\u200c appropriate\u200c framework for this case,\u201d Pitman declared.<\/p>\n<\/blockquote>\n<p>According\u200c to Pitman, the ban does not infringe on public employee speech, as university staff and\u2064 all public workers are still allowed to use TikTok on their personal devices, as long as they\u200c do not connect to \u200dstate networks.<\/p>\n<p>The judge also stated that the ban is a &#8220;reasonable\u200d restriction \u2064on access\u200b to TikTok in light of Texas&#8217;s concerns&#8221; regarding data protection and the\u200b Chinese-owned company ByteDance, which owns TikTok.<\/p>\n<p>However,\u2062 TikTok has denied allegations of security\u2064 or privacy risks associated with ByteDance.<\/p>\n<p>Jameel \u200cJaffer, the executive director of the \u200cKnight Institute,\u200b expressed\u200c disappointment with the verdict. The Knight \u2062Institute argued that the\u200b ban not only limits academic freedom but also hinders research on TikTok\u2063 at public schools in Texas.<\/p>\n<p>Jaffer further stated that the ban prevents &#8220;public university\u2063 faculty from studying TikTok \u2014 including from studying the very privacy concerns \u2064that supposedly\u200c motivated the ban.&#8221;<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cRestricting research and teaching\u2063 about one of the world\u2019s major \u2062communications platforms is not \u2063a sensible or\u2063 constitutionally permissible way of addressing legitimate concerns about TikTok\u2019s data-collection practices,\u201d Jaffer said\u200d in a statement.  <\/p>\n<\/blockquote>\n<p>Ramya Krishnan, a senior staff attorney at the Knight Institute, criticized the TikTok ban, arguing that it \u2063does not actually protect privacy since other platforms collect the same data and it can be easily purchased from\u2062 data brokers.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe Court should have required\u2064 Texas\u2062 to justify the ban.
