Fortunately, there is much more to the story. While\u2063 there\u2063 is still improvement \u200bto \u200cbe \u2063made,\u200c and it remains worthwhile\u200b to support legitimate religious liberty organizations, we\u200c are \u2064closer \u200bto entering a golden age of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-rules-against-christian-college-suing-biden-administration-over-trans-mandate\/\" title=\"Judge Rules Against Christian College Suing Biden Administration Over Trans Mandate\">religious liberty law<\/a> than\u200d we are to seeing that right extinguished. Establishment Clause jurisprudence is a worthy case study.<\/p>\n<blockquote>\n<h3>A\u2064 Turning Point: From Lemon to\u2064 Bremerton<\/h3>\n<p>One \u200bbad apple can spoil the \u200dwhole bunch, and \u200da sour decision on <i>Lemon v. Kurtzman<\/i> spoiled\u2062 establishment clause cases for\u200d half a century, until <i>Kennedy v.\u2064 Bremerton<\/i> brought a fair return to Establishment Clause\u2063 jurisprudence.<\/p>\n<\/blockquote>\n<p>In\u2063 <a href=\"https:\/\/www.oyez.org\/cases\/1970\/89\" target=\"_blank\" rel=\"noopener\"><i>Lemon v. Kurtzman<\/i><\/a>, the \u200dSupreme Court held\u2063 that issuing financial\u2063 relief to religious schools constituted an impermissible \u201cestablishment\u201d of religion.<\/p>\n<blockquote>\n<h3>The Legacy of Lemon<\/h3>\n<p>For the next 50 years, the \u2064 <i>Lemon<\/i> test \u200bwas the\u2063 law\u200d of \u2063the land. Under that test, a law must:<\/p>\n<ol>\n<li>Have a secular\u200d purpose<\/li>\n<li>Not advance \u2063nor\u2064 inhibit religion<\/li>\n<li>Not cause excessive entanglement of government and religion<\/li>\n<\/ol>\n<p>A corollary to this rule was\u200d that\u200c any\u2063 action which \u200dseemed \u200cto \u201cendorse\u201d religion \u2062was also \u2064unconstitutional. <i>Lemon<\/i> was so ambiguous that some government entities were deterred from offering any benefits \u2014 including those available to \u2063every other citizen \u2014 to religious people.\u200d <i>Lemon<\/i> also empowered anti-religious zealots to threaten or\u200d even sue any government that so much as allowed a Rabbi to\u2063 <a href=\"https:\/\/www.oyez.org\/cases\/1988\/87-2050\" target=\"_blank\" rel=\"noopener\">light\u200c a Menorah in a public park<\/a>, or\u200b <a href=\"https:\/\/www.becketlaw.org\/case\/gagliardi\/#:~:text=The%20lawsuit%20made%20the%20bizarre,was%20driven%20by%20anti%2DSemitism.\" target=\"_blank\" rel=\"noopener\">grant \u2064a zoning permit<\/a> to\u200d a\u2063 synagogue.<\/p>\n<\/blockquote>\n<p>The Court slowly but surely endeavored\u200d to ameliorate the harm of\u200c <i>Lemon<\/i>.\u200d Over the last few decades,\u2064 the\u2062 Supreme Court has repeatedly declined to apply\u200b <i>Lemon<\/i> in many cases where it seemed\u200c to \u200dbe the\u2063 governing law. Unfortunately, because the court never explicitly stated that <i>Lemon<\/i> was reversed, lower courts continued to apply its strict\u2062 rule.<\/p>\n<p>While religious\u2062 litigants were very likely \u2063to win at the Supreme Court, \u2064the vast majority of cases\u200c never reach the Supreme Court. Religious Americans were left at\u200b the mercy of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/government-unions-have-been-stealing-money-for-years-now-scotus-has-the-chance-to-intervene\/\" title=\"Government Unions Have Been Stealing Money For Years \u2014 Now, SCOTUS Has The Chance To Intervene\">lower court judges<\/a>, many of\u200c whom \u200ccontinued to apply <i>Lemon<\/i> \u200b in a merciless manner and fell influence to \u2063rampant, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pro-abortion-extremism-fueled-by-hatred-for-christian-principles-catholicvote-president\/\" title=\"Pro-Abortion Extremism Fueled By Hatred For Christian Principles: CatholicVote President\">anti-religious sentiment<\/a>. \u2063It is unknown \u2064how many religious Americans simply gave \u2062up when\u200c a city told them that <i>Lemon<\/i> prevented it from\u2063 allowing them \u2064to exercise their religion.<\/p>\n<blockquote>\n<h3>The Dawn\u200b of a New\u2062 Era: \u200dKennedy v. Bremerton<\/h3>\n<p><i>Lemon<\/i> was finally laid to rest in \u200cOctober\u2063 2021\u200b with <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21-418_i425.pdf\" target=\"_blank\" rel=\"noopener\"><i>Kennedy v.
