They made it clear that\u2062 they wanted Mr. Weiss to keep \u200dthis litigation alive \u2064through the presidential election,&#8221; Biden\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-trump-campaign-takes-fight-over-pennsylvania-election-and-mail-in-ballot-laws-to-us-supreme-court\/\" title=\"NEW: Trump Campaign Takes Fight Over Pennsylvania Election and Mail-In Ballot Laws to US Supreme Court\">legal team wrote<\/a>.<\/p>\n<\/blockquote>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;Because the facts in the\u2063 case did not change and \u2063the law only became more difficult for such prosecutions, \u2063the public record\u200d supports no \u200dconclusion other\u2062 than \u200d [that] Mr.\u200b Weiss changed his decision \u200bbecause he buckled under political pressure \u200dto\u200b bring more severe charges,&#8221; they continued.<\/p>\n<\/blockquote>\n<p>Some\u200d have\u200d compared this document to one submitted by Trump, who requested\u2063 the dismissal of accusations against\u200b him in the federal election meddling investigation, claiming they were politically motivated.<\/p>\n<p>Additionally, Hunter&#8217;s attorneys alleged that federal prosecutors broke a plea deal \u2064that would have excluded the weapons allegations entirely.<\/p>\n<p>They argued that the current president&#8217;s son &#8220;gave \u2062up various rights,&#8221; including his Fifth Amendment right \u2063to remain silent, in exchange for an agreement meant to protect him from weapon-related crimes.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;As the \u200bprosecution \u200dtold the Court, &#8216;based on the terms of the agreement\u2026 We cannot bring firearms charges based on \u200dthe\u2062 firearm identified in \u200bthe factual statement to\u200b the Diversion Agreement.&#8217; Nevertheless, the prosecution did just\u2062 that by subsequently bringing this indictment charging Mr. \u200bBiden with three felony \u200bfirearm\u200c offenses, which all relate to the firearm identified in the Diversion Agreement&#8217;s factual statement.<\/p>\n<\/blockquote>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;Because\u200d Mr. Biden\u2062 gave up valuable\u200d rights as part \u2064of this contract, in \u2062exchange for the prosecution&#8217;s promise not to prosecute him, &#8216;such promise must be fulfilled,'&#8221; the attorneys added.<\/p>\n<\/blockquote>\n<p>In \u2064September, \u2062Biden was accused by federal \u200cprosecutors of three <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/delaware-countys-top-prosecutor-becomes-fifth-democrat-to-run-for-pennsylvania-attorney-general\/\" title=\"Delaware County's lead prosecutor joins PA attorney general race as fifth Democrat\">gun-related \u200bcrimes<\/a>: two\u2062 counts of concealing drug usage from potential gun buyers and one count of illegally possessing a handgun while \u2063under the influence of a controlled substance. <\/p>\n<p>He pleaded not guilty\u2064 to\u2063 all charges.<\/p>\n<p>After a plea bargain\u200b with the government collapsed\u200c last summer due to concerns about the terms of the\u200c agreement from \u2064the judge overseeing the case,\u2062 he pleaded \u200dnot guilty to all \u200ccounts. According \u200bto the terms of the arrangement, he would have\u2064 avoided a formal accusation \u2062related to guns \u2063by pleading guilty to two tax violations.<\/p>\n<p>In addition, \u2063Biden argued that his gun possession \u2064charge \u2063is &#8220;illegal in light of the\u200c Supreme \u200dCourt&#8217;s historic\u200b Second Amendment rights ruling,&#8221;\u2062 referring to the \u2063NYSRPA vs. \u200dBruen case last year.<\/p>\n<p>One federal appeals court has already declared the legislation to be &#8220;unconstitutional,&#8221; according to Biden&#8217;s \u2064counsel. They \u200bclaimed that if the accusation in \u200bBiden&#8217;s case is proven unfounded, the other charges would\u200c also be dismissed.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;While Congress could criminalize gun possession\u200b by someone who \u200cwas actively intoxicated, or perhaps someone who at least \u2062actively had a controlled substance in their \u200cbody, a prohibition on gun ownership by anyone who \u200chad\u2062 at some time used a \u2063controlled substance is constitutionally \u2062overbroad \u200cunder Bruen,&#8221; Biden&#8217;s attorneys wrote.<\/p>\n<\/blockquote>\n<p>The lawsuit also \u2062questions Weiss&#8217;s authority\u2063 as\u200c special counsel, arguing that he cannot hold both positions simultaneously as \u2064he is the \u2064U.S. Attorney for \u2064Delaware.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;That \u2063appointment is flatly \u200dprecluded by the U.S. Department of Justice&#8217;s own regulations setting the &#8216;Qualifications of the Special Counsel,&#8217; which provide: &#8216;The\u2064 Special Counsel\u200d shall be \u200dselected from \u2063outside the United \u200cStates Government,'&#8221; Biden&#8217;s\u200b attorneys continued.<\/p>\n<\/blockquote>\n<p>The filings, which primarily relied on personal \u200cinformation to prove that Biden had \u200dneglected his tax obligations, presented three felonies and \u2063six \u2062misdemeanors in \u2064California.\u200b These documents offered a\u200c glimpse into Biden&#8217;s potential response to \u2064the\u2062 second indictment presented by Weiss last week.<\/p>\n<p>Stay informed!
