Now, thanks to the Texas state government, \u200bfreedom and federalism \u200bstand poised to gain an important victory.<\/h2>\n<p>This weekend on Fox\u2062 News\u2019 \u201cSunday Morning Futures\u201d with host\u2064 Maria Bartiromo, Republican Gov. Greg Abbott of Texas promised he soon will sign a\u2062 bill that \u2063will\u200d make\u200c illegally crossing Texas\u2019 border with Mexico \u2063a state crime.<\/p>\n<blockquote>\n<p>\u201cIn two weeks, I\u2019ll \u200dbe\u200d signing a new law in the\u200d state of Texas that\u200b will make it\u2062 illegal for people\u2063 to enter the state of Texas from another\u200d country illegally \u2063and authorizing \u200cevery peace office in \u2064the state of Texas\u2062 to arrest \u200cthose people \u2064entering our country illegally,\u201d <a href=\"https:\/\/www.westernjournal.com\/fed-abbott-set-sign-legislation-allowing-texas-state-police-arrest-deport-illegals-challenge-feds\/\" target=\"_blank\" rel=\"noopener\">Abbott<\/a> said.<\/p>\n<\/blockquote>\n<p>Were I to advise <a href=\"https:\/\/www.westernjournal.com\/gov-greg-abbott-shares-video-border-wall-construction-texas-doesnt-rest\/\" target=\"_blank\" rel=\"noopener\">Abbott<\/a> on the best way to speak about the new law\u00a0 \u2014 not a way\u200c that would\u200d satisfy lawyers\u200b but \u200dnonetheless\u200d the most constitutional and truthful \u2064way \u2014 I would \u200cencourage him to substitute <strong>\u201centering our state illegally\u201d<\/strong> for\u200d <strong>\u201centering our country illegally.\u201d<\/strong> More on that \u200cin a \u2062moment.<\/p>\n<h3>According to <a href=\"https:\/\/www.texastribune.org\/2023\/12\/01\/texas-border-sb4-illegal-crossing-state-law\/\" target=\"_blank\" rel=\"noopener\">The Texas Tribune<\/a> \u2014 an Austin-based news\u2063 outlet focused on statewide news \u2014 the law\u2062 will have\u200b major\u200d implications.<\/h3>\n<ul>\n<li>Senate Bill \u200b4, approved last\u200c month, will authorize Texas police to arrest illegal <a href=\"https:\/\/www.westernjournal.com\/sisters-shot-dead-day-thanksgiving-suspected-illegal-immigrant-charged-heinous-killings\/\" target=\"_blank\" rel=\"noopener\">immigrants<\/a> \u2063on state charges.<\/li>\n<li>Under the \u2063legislation, an illegal\u200d crossing between ports of entry will result in \u2063a\u200b Class B misdemeanor. \u2062A prior conviction \u200bwill make the charge a \u2063second-degree felony.<\/li>\n<li>State police will\u200c not have\u2064 unlimited discretion,\u200b as they \u2063should not \u2063under any circumstances. For instance, the legislation \u2063forbids arrests in places such as secondary schools, churches and \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-homeland-security-department-illegal-immigrants-should-get-vaccine\/\" title=\"Biden\u2019s Homeland Security Department: Illegal Immigrants Should Get Vaccine\">health care facilities<\/a>.<\/li>\n<li>Republican state Rep. David \u200cSpiller, who\u200d sponsored the bill\u2064 in the \u2062Texas House, also\u2062 noted the legislation will authorize police to focus\u200b only \u2064on\u200c <a href=\"https:\/\/www.westernjournal.com\/94-year-old-veteran-struggles-kicked-nursing-home-replaced-migrants-not-fair\/\" target=\"_blank\" rel=\"noopener\">immigrants<\/a> \u200b who have crossed\u2063 illegally in the last \u2063two to three \u2062years. Statutes of limitations will \u200bprevent law enforcement officials \u200bfrom targeting \u2064any illegal immigrant who arrived before\u2063 then.<\/li>\n<\/ul>\n<p>Of course, the usual suspects have \u200dlined up to denounce the bill.<\/p>\n<p>According to The Texas \u2064Tribune, opponents already have \u2064cried \u201cracial profiling.\u201d<\/p>\n<p>In \u200ca Nov. 15 <a href=\"https:\/\/www.nilc.org\/2023\/11\/15\/nilc-statement-condemning-anti-immigrant-texas-bill-sb-4\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> following the bill\u2019s passage, the National Immigration Law Center complained of \u201chatemongering and\u2063 intimidation.\u201d<\/p>\n<blockquote>\n<p>\u201cFederal courts, including the Supreme Court, have consistently \u2064held that \u200cthe \u200bfederal government has \u2062the sole \u2063authority to regulate \u2064immigration policy,\u201d \u200dthe organization \u200csaid. \u201cThe Texas Legislature is \u200bwrong to have passed it, and Governor \u200cAbbott will be wrong if he signs it.<\/p>\n<p>\u201cWe call on Texas \u200bto \u2064abandon this cruel, illegal \u200cscheme and recognize that immigrants make Texas and\u200b our \u2062nation stronger.\u201d<\/p>\n<\/blockquote>\n<p>Readers will quickly dismiss that last bit of sentimental and deceitful rubbish. Legal immigrants do indeed \u200c\u201cmake Texas and our \u2063nation stronger,\u201d but illegal \u2062immigrants do \u200cnot.<\/p>\n<p>The first line of that passage, however, does pose an apparent problem.<\/p>\n<p>As The Texas Tribune noted, federal courts have ruled that only the federal government may enforce\u200b <a href=\"https:\/\/www.westernjournal.com\/ap-gop-holding-bidens-overseas-aid-bargaining-chip-order-get-massive-victory-immigration\/\" target=\"_blank\" rel=\"noopener\">immigration<\/a> \u2062 laws. In 2012, for instance, the U.S. Supreme Court ruled that local police \u2063lacked \u2063the authority to\u2064 arrest \u200dpeople based on their immigration status.<\/p>\n<p>Here we have an issue that involves the very nature\u2062 of our constitutional structure.<\/p>\n<p>On one hand, when \u2062the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/d-c-statehood-is-a-democrat-power-grab\/\" title=\"D.C. Statehood Is A Democrat Power Grab\">federal government operates<\/a> within its legitimate constitutional sphere, states may not nullify\u2062 federal law.\u200c Americans <a href=\"https:\/\/millercenter.org\/the-presidency\/presidential-speeches\/december-10-1832-nullification-proclamation\" target=\"_blank\" rel=\"noopener\">settled<\/a> that\u2064 question nearly 200\u200c years ago.<\/p>\n<p>On the other hand, what happens when the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wh-press-secretary-scrambles-when-peter-doocy-pushes-back-on-painful-clean-energy-transition\/\" title=\"WH Press Secretary Scrambles When Peter Doocy Pushes Back On \u2018Painful\u2019 Clean Energy Transition\">federal government acts<\/a> outside its constitutional sphere? James Madison \u200c\u2014 long \u200drecognized as the father of the U.S. Constitution \u2014 wrote in <a href=\"https:\/\/founders.archives.gov\/documents\/Madison\/01-17-02-0128\" target=\"_blank\" rel=\"noopener\">1798<\/a> \u2062and again in \u2062 <a href=\"https:\/\/founders.archives.gov\/documents\/Madison\/01-17-02-0202\" target=\"_blank\" rel=\"noopener\">1800<\/a> that the states have\u200c an\u2063 obligation \u200cto protect their \u200dcitizens when the federal government tramples their liberties.<\/p>\n<p>Texas police may \u200dnot enforce federal immigration \u200claw. \u200cNo one seriously doubts as much.<\/p>\n<p>The people of Texas, however, have\u200c sovereign authority. They\u2064 cannot pass a law that conflicts\u2062 with federal\u200b law and\u2062 still remain members of the Union. They can, however, \u200cpass a \u2062law to protect themselves \u2014 a law, in fact,\u200b that does not conflict with federal laws in any way \u2014 when federal \u2062officials such as\u2064 President <a href=\"https:\/\/www.westernjournal.com\/bidens-borders-foreign-born-us-population-hits-highest-level-ever-recorded-american-history\/\" target=\"_blank\" rel=\"noopener\">Joe Biden<\/a> and Secretary of Homeland\u2064 Security <a href=\"https:\/\/www.westernjournal.com\/mayorkas-met-border-patrol-agents-biden-slandered-big-problem-report\/\" target=\"_blank\" rel=\"noopener\">Alejandro Mayorkas<\/a> criminally refuse to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-tells-missouri-they-cant-disregard-federal-gun-laws\/\" title=\"DOJ Tells Missouri They Can\u2019t Disregard Federal Gun Laws\">enforce federal laws<\/a>.<\/p>\n<p>Americans must\u2063 understand that the federal government has no sovereignty\u2063 whatsoever. Its only legitimate \u200dauthority comes directly from the \u2064sovereign people of\u2062 the United States.<\/p>\n<p>Likewise \u2014 and here we cite Madison\u2019s \u2064lifelong friend and political ally, <a href=\"https:\/\/www.westernjournal.com\/austin-washington-jefferson-actually-anti-slavery-heroes-dont-let-left-smear-names\/\" target=\"_blank\" rel=\"noopener\">Thomas Jefferson<\/a> \u2014 federal courts do not \u2062have ultimate authority. They alone cannot tell \u2064us what \u2063the Constitution \u200cmeans. Only\u200b we\u2062 \u2014 the sovereign people \u2014 have that power.<\/p>\n<p>If the judiciary were to have\u200d this kind of authority, Jefferson <a href=\"https:\/\/founders.archives.gov\/documents\/Jefferson\/03-15-02-0014\" target=\"_blank\" rel=\"noopener\">wrote<\/a> in\u2064 1819, \u201cthen indeed is our constitution a \u2062compleat felo de se\u201d \u2014\u2063 that \u200cis, a \u201cfelon against itself,\u201d an agent of\u2064 suicide.<\/p>\n<p>The\u200c people of Texas must not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-education-sec-on-womens-school-sports-we-have-a-legal-responsibility-to-include-transgender-athletes\/\" title=\"Biden Education Sec On Women\u2019s School Sports: We Have a \u2018Legal Responsibility\u2019 to Include Transgender Athletes\">violate federal law<\/a>. \u2064And\u2062 they\u200b must \u200cnot trample the \u2063rights and liberties \u2064of their \u200bfellow citizens. But they may \u2064exercise their sovereign authority to protect themselves.
