(Photo by STEPHANE DE \u200bSAKUTIN\/AFP via Getty\u2063 Images)<\/figcaption><\/figure>\n<h2>OxyContin Maker&#8217;s \u2064$6 Billion Bankruptcy Deal Faces\u200b Supreme Court \u200cScrutiny<\/h2>\n<p>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/brooke-mallory\">Brooke Mallory<\/a><br \/>11:47 AM\u200b \u2013 Monday,\u2064 December \u200c4, 2023<\/p>\n<p>The\u2064 legitimacy of a nearly $6 billion bankruptcy deal involving Purdue Pharma, the maker of the drug OxyContin, which is\u200b blamed for \u200bsparking\u2064 the deadly opioid crisis, will be\u2064 the subject of \u2063arguments before the Supreme Court on Monday morning.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-3\" style=\"min-width: 320px; min-height: 50px; text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-3'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>Purdue \u200bPharma\u2019s owners, the \u200bSackler family, \u200chave\u2062 made a $6 billion\u200c settlement offer to resolve thousands of claims that \u200daccused the company of causing the opioid crisis. If the justices approve the agreement, Purdue would become a charity and commit its billions of dollars to treating addiction and\u2062 other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tragedy-as-91-year-old-us-marine-vet-dies-by-jumping-from-new-york-city-high-rise\/\" title=\"91-year-old US Marine veteran tragically dies after jumping from NYC high-rise.\">mental \u2062health issues<\/a>,\u2064 while the Sackler family owners would no longer be held\u200d legally liable.<\/p>\n<p>The\u200c terms\u200d of the \u2064settlement were accepted\u2063 by a bankruptcy court in 2011, \u200bbut in September of the same year,\u2064 the \u2064U.S. Trustee Program\u2014a Justice \u200cDepartment \u200bwatchdog that\u2062 monitors\u200d bankruptcy proceedings\u2014moved to reject the\u2063 agreement.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cOn the most direct\u200c level, it will \u2062determine whether Chapter\u200b 11 is a viable process \u2064for settling mass torts,\u201d according to an American Bar Association overview of \u2062the case \u200cby Anthony Casey, \u200cprofessor at the University of Chicago Law School.<\/p>\n<\/blockquote>\n<p>Approximately 60,000 individuals who have filed\u200b personal injury claims voted in favor of the settlement agreement, but U.S. Trustee for\u200c the Department of Justice (DOJ), William\u200b Harrington, objected, claiming that such \u2063\u201cnondebtor releases\u201d need\u2062 the\u200c released\u200c parties\u2019 unanimous assent.<\/p>\n<p>According to court records, Harrington has further maintained that \u200dthe deal\u200d absolves Sackler \u2064family members of responsibility for \u201calleged wrongdoing in concocting and\u2063 perpetuating for profit one of\u200b the most severe \u200dpublic health crises ever experienced in the United States.\u201d<\/p>\n<p>The Supreme Court in August denied the\u2063 Stamford, Connecticut-based pharmaceutical company the\u200c ability to pursue bankruptcy proceedings, upholding Harrington\u2019s conclusions that the agreement provides \u2062\u201cunprecedented\u201d protection against\u200c future civil \u2064lawsuits.<\/p>\n<p>The possibility that the Sackler family members \u2062would be absolved of \u2064civil liability also sparked outrage \u2063from victims \u200bof \u200copioid abuse, and advocacy \u200dgroups raised awareness about the more than 280,000 people\u200b who died in the United States \u2062from overdoses involving \u200dprescription opioids between 1999\u200d and 2021, according to the CDC.<\/p>\n<p>On Monday morning, activists and supporters of the\u200b fight against opioid abuse\u2062 will assemble outside the Supreme Court\u2063 to demand that the settlement be overturned \u200don the grounds that it does\u200c not adhere to the existing U.S. Bankruptcy Code.<\/p>\n<p>Speaking on behalf of a coalition \u2062of organizations \u200craising awareness about\u200c opioid consumption, Maya\u200b Fitzpatrick said that the settlement is \u200ba \u201cstark example of privileges retained by the wealthy to leverage \u200dthe legal system to their advantage.\u201d The group\u2019s plan is to demonstrate outside the\u200b high\u2062 court.<\/p>\n<p>The majority \u2063of lawsuits filed \u2063against Purdue and\u2063 its\u200b owners charge them with encouraging the opioid \u200dcrisis by falsely advertising the painkiller. \u200dThe business entered\u2064 a guilty plea to misbranding and \u200dfraud related to OxyContin marketing in 2007 and 2020.<\/p>\n<p>The ramifications of this case are \u2063extensive, encompassing continuing \u200bdisagreements about\u2062 the Boy Scouts of America settlement\u2064 and possible\u200b upcoming cryptocurrency litigation,\u2062 even though\u200d thousands of\u2064 victims of opioid abuse \u200cand their payouts are at\u200d stake on Monday.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIf the Court declares\u200b a blanket\u200b prohibition on nonconsensual nondebtor releases, it could overturn settlements \u200bin pending cases like the one involving the Boy Scouts of \u2062America \u2062and\u200c prevent\u2063 global settlement in future cases,\u201d Casey\u2064 wrote.<\/p>\n<\/blockquote>\n<p>Purdue\u2019s settlement would\u2062 take effect, and the status \u2062quo would be\u200c preserved if the high court ruled\u2063 that\u200d the Bankruptcy\u2064 Code \u2063permits nondebtor discharges.<\/p>\n<p>A Purdue lawsuit, according to Casey, \u201ccould be expected\u201d to be resolved, leaving plaintiffs to pursue \u201cdifficult piecemeal litigation against dispersed,\u2064 hard-to-reach\u2063 wrongdoing shareholders.\u201d<\/p>\n<p>The justices are expected \u2063to render a decision on \u200cthis\u2063 issue by the end of June, and oral arguments\u200c are set for 10 \u200ba.m.<\/p>\n<p>Stay informed!
