That level \u2062of speech repression sounds more typical \u2064of \u2063authoritarian societies, but fortunately, during their\u200b conference \u200bthis Friday,\u200d the court is set to\u200b vote on taking up her case. As\u2063 a bonus, the\u200b court has a chance to continue undoing the decades-old legal cover \u2064provided\u2063 for the abortion industry by public officials.<\/p>\n<\/blockquote>\n<h3>Challenging Speech Restrictions<\/h3>\n<ul>\n<li>After\u2062 the Supreme Court\u2019s\u2063 decision in <em>Dobbs v. Jackson Women\u2019s\u200b Health Organization<\/em> overruled <em>Roe \u200dv. Wade<\/em>, \u2062Westchester County passed an <a href=\"https:\/\/westchestercountyny.legistar.com\/View.ashx?M=F&#038;ID=11039152&#038;GUID=249D5398-E8F2-4E42-B2F5-0E76E0EAF8FE\">ordinance<\/a> restricting free speech around abortion facilities. It established a \u200d100-foot zone around\u200d them and prohibited anyone from\u2062 approaching within eight feet of a \u2063person in that zone to provide information\u200c or counseling unless given express consent.<\/li>\n<\/ul>\n<p>Before this law was passed, Vitagliano \u200bhad \u2063participated in a prayer vigil at the Planned Parenthood in White \u2064Plains, New York, where she prayed peacefully \u200dand \u2062held signs about the\u2064 effects of abortion on both expecting mothers and fathers.\u2064 She trained to serve as a volunteer\u2064 \u201csidewalk counselor,\u201d discussing <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/peaceful-montana-pro-life-advocate-vindicated-after-erroneous-unconstitutional-charges\/\" title=\"Peaceful Montana Pro-Life Advocate Vindicated After Erroneous, Unconstitutional Charges\">life-affirming alternatives<\/a> to pregnant\u200d women contemplating abortion.\u200c But she\u200d has been unable \u2063to\u200c put her training\u200b into action because,\u2064 under the county law,\u2064 if she approaches a woman to speak\u2063 about alternatives to abortion, \u200dshe could be criminally punished.<\/p>\n<p>Vitagliano went \u2063to court, asserting that \u2064her free-speech rights had been violated by the county law. Unfortunately, she faces an obstacle in the \u200cshape of\u200b <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/530\/703\/case.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Hill v. Colorado<\/em><\/a>, a 2000 Supreme Court decision. The court in \u2063 <em>Hill<\/em> rejected a request by\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/as-pro-life-activists-face-stiff-federal-sentences-bill-to-repeal-weaponized-face-act-introduced\/\" title=\"Bill introduced to repeal 'weaponized' FACE Act as pro-life activists face harsh federal sentences.\">pro-life\u200d activists<\/a> to overturn a \u200bColorado law that is almost identical \u200bto Westchester County\u2019s.<\/p>\n<blockquote>\n<p>\u201cThe fact\u200b that the \u200dmessages conveyed \u2063by\u200b those\u200d communications may be offensive to their recipients does not deprive them of \u2064constitutional protection,\u201d wrote\u200c Justice John Paul Stevens for\u200c the majority. \u201cOn the other hand,\u201d Stevens continued, states may \u2063exercise police powers \u201cto protect the\u200b health and safety \u2063of their \u2063citizens\u201d and that \u2063interest\u2062 may\u2063 \u201cjustify \u200da special focus\u2064 on unimpeded access to health care facilities and the avoidance of\u200c potential trauma to \u2064patients associated \u2062with confrontational\u200d protests.\u201d<\/p>\n<\/blockquote>\n<p>That confusing opinion\u2064 was sadly typical of the late Justice Stevens, who started in the court\u2019s \u200bideological center but drifted haphazardly\u2064 to \u200bthe left as he got older. \u200bBy contrast, \u200dthe late \u2064Justice Antonin\u200b Scalia, in a scathing \u2063dissent joined by Justice \u200cClarence\u200d Thomas, saw things\u200c clearly.<\/p>\n<blockquote>\n<p>\u201cWhat is before us, \u2063after \u200ball, is a speech regulation directed \u200dagainst the opponents of \u200cabortion, and it therefore enjoys the benefit \u200bof the\u2063 \u2018ad \u2063hoc \u2062nullification machine\u2019\u2062 that the Court \u200bhas set in motion to \u200bpush aside whatever doctrines\u200d of constitutional law stand in the way of that highly favored practice,\u201d Scalia wrote.<\/p>\n<p>Clearly exasperated, \u200dhe added, \u2064\u201cHaving \u2064deprived\u2064 abortion opponents of the political right to persuade the electorate that abortion should be restricted by law, the Court today continues and\u2064 expands its assault \u2063upon their individual right to \u200bpersuade women contemplating\u2063 abortion \u200bthat\u200c what they \u200care doing is wrong.\u201d<\/p>\n<\/blockquote>\n<p>Scalia was right to denounce\u200d the mantle of legal protection given\u200b by the court to\u200d the\u2063 abortion industry at the time <em>Hill<\/em> was decided. Thankfully, things are changing.\u200b <em>Dobbs<\/em> was an indispensable\u200c first step to restoring our \u2062constitutional order.\u2062 But more needs to be\u2063 done. Overturning <em>Hill<\/em> \u2063is\u200c a great place to start.<\/p>\n<p>Although\u2062 Vitagliano\u2019s request \u200cfor review is grounded in her right to free speech, the\u2064 court need not ignore her religious convictions in support of life. This is such an\u2063 important \u2063point. The <a href=\"https:\/\/becketnewsite.s3.amazonaws.com\/20230721171729\/2023-07-21-1-1-Petition-for-a-Writ-of-Certiorari-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">petition<\/a> \u2064for review \u2062to the court explains, \u200c\u201cConsistent \u200cwith her Catholic faith, [Vitagliano] opposes abortion, believing it is the \u200bdeliberate taking of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/human-smugglers-are-using-bidens-border-incompetence-and-social-media-to-find-their-next-victims\/\" title=\"Human Smugglers Are Using Biden\u2019s Border Incompetence And Social Media To Find Their Next Victims\">innocent human life<\/a>.\u201d<\/p>\n<p>Vitagliano \u200dis not alone in feeling drawn \u200bby\u2062 her\u200c Catholic faith \u2064to stand up\u2064 for pregnant\u200b women \u200cand\u2064 their unborn children. Earlier\u200c this month, the United States Conference of Catholic \u2064Bishops (USCCB)\u200c <a href=\"https:\/\/www.catholicnewsagency.com\/news\/256025\/us-bishops-approve-voting-guide-that-calls-abortion-preeminent-priority\" target=\"_blank\" rel=\"noreferrer noopener\">reiterated<\/a> \u200bthat opposing abortion is the \u201cpreeminent priority\u201d for the bishops\u2019\u2062 conference, a \u2063decision\u200b that\u200d drove leaders of the\u2063 American Church\u2019s progressive faction wild\u200d with indignation. A\u200b guide the USCCB plans to disseminate\u2064 to Catholic voters before the 2024 election explains that abortion, \u2064\u201cdirectly attacks our most vulnerable and voiceless\u200d brothers and \u2062sisters \u200band destroys more \u2062than a million lives per year in our country alone.\u201d<\/p>\n<p>Religious motivation for speaking, or refusing to engage in \u201ccompelled speech,\u201d has also animated \u2062recent cases in which the court vindicated the\u200c free-speech guarantee. \u2063In upholding the right of a \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fired-football-coach-sues-school-officials-for-retaliation-over-political-differences\/\" title=\"Fired Football Coach Sues School Officials for Retaliation Over Political Differences\">high school football coach<\/a> to pray on \u2064the\u200b field after games, the court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21-418_i425.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">observed<\/a> that\u2064 the\u2062 \u201cFree Speech Clause provides overlapping protection \u200cfor \u2063expressive religious activities. That the First \u200cAmendment \u200bdoubly \u200bprotects religious speech is \u200dno accident.\u200b It is a natural outgrowth of the framers\u2019 distrust of government attempts to regulate religion and suppress dissent.\u201d<\/p>\n<p>Vitagliano\u2019s lawyers at \u200b <a href=\"https:\/\/www.becketlaw.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Becket Law<\/a> understand the special protection the founders believed should be afforded religious \u2062expression. Becket\u2019s \u200c <a href=\"https:\/\/becketnewsite.s3.amazonaws.com\/20220602192111\/303-Creative-Amicus-Brief-.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>amicus<\/em> brief<\/a> filed with the court earlier this year in<em> 303 Creative v. Elenis<\/em>, a free-s  <\/p>\n<h2> What is the significance of the Supreme Court&#8217;s decision in Hill v. Colorado and \u200chow \u200bdoes it pose a challenge to Vitagliano&#8217;s case?<\/h2>\n<p><span>  N\u200c her fight to protect free speech and religious convictions. Many Christians across America have faced similar attempts by the\u2064 government\u200c to silence their\u200b voices and undermine\u200d their deeply held beliefs. It is crucial for the Supreme Court to once again rise to the occasion and defend the First Amendment.<\/p>\n<p>The case\u200b of Debra\u2064 Vitagliano, \u2064a Catholic woman \u200dfrom \u200dWestchester County, New York, highlights the need for protection against speech repression. Vitagliano has been barred from counseling pregnant women outside abortion facilities under a restrictive ordinance passed by Westchester County. \u200bThis ordinance \u2064establishes a 100-foot zone around these \u2063facilities and prohibits anyone from approaching within eight\u200b feet \u200bof a person in that zone to provide information or\u200d counseling\u2064 without express consent.<\/p>\n<p>Before this law was \u2063enacted, \u2062Vitagliano \u200dparticipated in a peaceful prayer vigil at a Planned Parenthood\u200b clinic, where she prayed and held signs\u200d advocating for the sanctity of life. Colorado. In that case, \u2062the court rejected a request by pro-life activists to overturn\u2063 a similar\u200c law \u2064in Colorado. Overturning Hill would \u200bbe a crucial step \u200ctowards restoring\u200d our \u200cconstitutional \u200dorder \u200dand\u2064 ensuring that individuals are not silenced or punished \u2062for expressing their deeply held convictions.<\/p>\n<p>It is essential for the Supreme Court to recognize the \u2064significance\u200d of this case and seize the\u200b chance to protect both free speech and religious convictions. By doing\u2064 so, the court can reaffirm the principles\u2063 enshrined in the First \u2062Amendment and\u2062 provide a shield against \u2063further government attempts to muzzle Christians and undermine their rights.
