In the <a href=\"https:\/\/nycourts.gov\/courts\/appellatedivisions.shtml\" target=\"_blank\" rel=\"noopener\">New York\u200c judicial system<\/a>, there are two court levels above it \u2014 the \u200d <a href=\"https:\/\/ww2.nycourts.gov\/index.shtml#:~:text=The%20Appellate%20Division%20is%20New%20York%20State%27s%20intermediate,the%20Court%20of%20Appeals%2C%20the%20State%27s%20highest%20court.\" target=\"_blank\" rel=\"noopener\">Appellate \u200cDivision<\/a> and the\u200b <a href=\"https:\/\/nycourts.gov\/ctapps\/\" target=\"_blank\" rel=\"noopener\">Court of Appeals<\/a>.)<\/p>\n<p>In his July 2022 ruling, \u200cthe <a href=\"https:\/\/www.timesunion.com\/state\/article\/Judge-declares-COVID-19-regulations-void-17297543.php\" target=\"_blank\" rel=\"noopener\">Times Union<\/a> \u200dreported at the time, Justice Ronald Ploetz \u201csaid the \u200blaw could conceivably grant the\u2063 commissioner the\u200b power to force anyone into isolation \u2064or quarantine, despite a lack of evidence \u2063that a person is infected with\u2063 COVID-19.\u201d<\/p>\n<p>\u201cInvoluntary detention is a severe deprivation of individual liberty, far \u200dmore egregious than other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dhs-suggests-opposition-to-covid-19-restrictions-could-make-someone-a-domestic-terrorism-threat\/\" title=\"DHS Suggests Opposition To COVID-19 Restrictions Could Make Someone A Domestic Terrorism Threat\">health safety measures<\/a>, such as <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/heres-what-each-of-bidens-42-executive-orders-will-actually-do\/\" title=\"Here\u2019s What Each Of Biden\u2019s 42 Executive Orders Will Actually Do\">requiring mask-wearing<\/a> at certain venues,\u201d Ploetz wrote, according to the \u2062Times Union. \u201cInvoluntary quarantine may have\u200b far-reaching consequences\u2063 such as loss of income (or employment) and isolation from family.\u201d<\/p>\n<p>The \u2063regulation\u2062 was adopted in <a href=\"https:\/\/www.health.ny.gov\/facilities\/public_health_and_health_planning_council\/meetings\/2022-02-10\/docs\/crc_agenda.pdf\" target=\"_blank\" rel=\"noopener\">February 2022<\/a> under\u2064 the administration of Gov. Kathy \u2062Hochul \u2014 an elected official with such little regard for freedom of speech that she \u200bhas literally told her state\u2019s\u200b conservatives\u2063 they should <a href=\"https:\/\/www.westernjournal.com\/hochul-180-gets-wish-republicans-vote-feet-clown-show\/\" target=\"_blank\" rel=\"noopener\">go live somewhere\u200c else<\/a>.<\/p>\n<p>Her administration, represented by Attorney General Letitia James\u2062 (whom most Americans have\u2063 heard of by now as\u2062 former President <a href=\"https:\/\/www.westernjournal.com\/trump-unleashes-corrupt-letitia-james-outside-courtroom-plays-race-card\/\" target=\"_blank\" rel=\"noopener\">Donald Trump\u2019s legal nemesis<\/a> in \u2062New York), appealed Ploetz\u2019s ruling against the regulation.<\/p>\n<p>In the <a href=\"https:\/\/nycourts.gov\/courts\/ad4\/Clerk\/Decisions\/2023\/1117T1500\/PDF\/0722.pdf\" target=\"_blank\" rel=\"noopener\">Nov. 17 decision<\/a>, the appeals court ruled in the state\u2019s favor \u2014 not on the merits of\u200c rule 2.13 itself or the objections to it, but on the narrow grounds that\u2064 the\u200b challengers lacked \u201cstanding\u201d in the case.<\/p>\n<p>The \u200cchallengers are three\u200b Republican lawmakers \u2014 \u00a0state Sen. George Borrello,\u200d Assemblyman Chris Tague and \u2064former Assemblyman, now U.S. Rep. Michael\u200d Lawler \u2014 and the conservative group <a href=\"https:\/\/unitingnys.com\/\" target=\"_blank\" rel=\"noopener\">Uniting\u2063 NYS<\/a>.<\/p>\n<p>The <a href=\"https:\/\/nycourts.gov\/courts\/ad4\/Clerk\/Decisions  <\/p>\n<h2> How does\u200c the court ruling\u2063 in New\u2064 York \u200caffect the credibility of public health measures \u2064and undermine public trust in decision-making based on scientific evidence<\/h2>\n<p><span>  9.\u201d <\/p>\n<p>But the appeals court disagreed. According to the \u2063Albany Times Union, the appellate panel ruled that \u2064the \u200dstate\u2062 Health Department has \u201cbroad authority\u201d to issue quarantine and isolation orders, even without a \u2062confirmed\u2063 infection or exposure to a communicable disease. This means that state officials can essentially detain individuals indefinitely\u2063 based\u2064 on their own discretion.<\/p>\n<p>This is a concerning development for several reasons. Firstly, it raises serious questions about\u200d due process. Due process \u2063is a fundamental principle\u200d in any democratic society that \u2062ensures individuals are afforded fair treatment and\u200b legal rights.
