However,\u2063 last week,\u00a0the high court decided to <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-rejects-derek-chauvin-appeal\" target=\"_blank\" rel=\"noopener\">decline<\/a> to hear the appeal.<\/p>\n<p>Videos of\u200b Floyd\u2019s detainment on the ground by\u200d Chauvin went viral in 2020, sparking protests \u200band riots across the U.S.\u200b and even Europe.\u200b Mohrman argued \u200bthat holding the trial in Minneapolis, where \u200dthe incident\u200d occurred, \u2062effectively guaranteed Chauvin \u200ban unfair trial.<\/p>\n<p>\u201cUnder the \u200cSixth Amendment of the\u2062 U. S. Constitution, every criminal defendant is \u2063guaranteed a right to\u2062 a fair trial,\u201d the attorney told <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-rejects-derek-chauvin-appeal\" target=\"_blank\" rel=\"noopener\">The\u2064 Daily Wire<\/a> via a phone interview.\u200d \u201cAnd part of that\u2064 fair trial-right\u200c is not to be tried in a location where the jurors have either \u2063been exposed to extensive \u2064pre-trial publicity, or there has been such community outrage\u200c and the like that the jurors,\u200c before they \u200ceven were impaneled \u2064before the trial, would have concluded\u200d the defendant\u2019s guilty, or would \u2062have been pressured into rendering a guilty verdict.\u201d<\/p>\n<p>\u201cWhen that happens,\u201d Mohrman \u200dsaid, \u201cthe Supreme Court\u200b precedents\u2064 require that the \u2062case be moved \u2064to another location\u2062 or venue, as the\u200c law puts it.\u201d But this is not what happened in\u200b Chauvin\u2019s case.<\/p>\n<p>\u201cDuring the\u2064 questioning, I would say the vast majority \u2014\u2063 not only the vast majority, probably 75 to 80 percent of the jurors \u2014 \u200cexpressed\u2064 concerns for their own personal safety as a result of being \u200bimpaneled on the jury,\u201d he said. \u201cVirtually every \u200djuror had obviously heard\u2062 about the case, knew \u2064about\u2062 the riots, had seen the\u2062 videos that were\u2062 taken when George \u2063Floyd was\u2063 arrested; virtually all the jurors \u200dhave seen\u200b that, so it\u2019s \u200ddifficult in a \u2063case \u2063like that to impanel the jury where the\u200b jurors haven\u2019t\u2062 formed \u2064firm \u2063conclusions before the trial even starts.\u201d<\/p>\n<p>Mohrman \u2062noted \u200bthat the legal team\u2019s \u201cprimary argument\u201d is that \u201cdue to\u200d the\u200c riots that took place in Minneapolis, every juror who was impaneled had a stake in the \u2062outcome\u200b of the trial, because no juror would want to see their communities\u2062 burned\u2064 again in riots.\u201d<\/p>\n<p>There \u200cis also a Federal Civil Rights conviction against Chauvin, for which \u200che is serving over\u2063 20 \u2063years concurrently\u2064 with his \u200cstate sentence.
