Version: 4.0.47--><p>A federal judge ruled this week that mail-in ballots that are not correctly dated by the Pennsylvania voters who cast them must be counted in next year\u2019s elections.<\/p>\n<p>The ruling essentially means that votes in the battleground state that cannot be properly vetted as legitimate could help decide which presidential candidate receives <a href=\"https:\/\/www.westernjournal.com\/pennsylvania-county-recount-2020-election-votes-president-2023\/\" target=\"_blank\" rel=\"noopener\">the commonwealth\u2019s<\/a> 20 electoral votes.<\/p>\n<p>In a ruling over a lawsuit brought about over Pennsylvania ballots that were sent by mail in the 2022 election but not counted, the judge argued that existing Pennsylvania election law regarding ballots sent through the mail violates the civil rights of those who failed to fill them out correctly.<\/p>\n<p><a href=\"https:\/\/www.nytimes.com\/2023\/11\/21\/us\/politics\/pennsylvania-mail-ballots-ruling.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a> reported Judge Susan Paradise Baxter of the District Court for the Western District of Pennsylvania issued a 77-page <a href=\"https:\/\/static01.nyt.com\/newsgraphics\/documenttools\/b10bbfb83d581027\/4815af39-full.pdf\" target=\"_blank\" rel=\"noopener\">opinion<\/a> about problematic ballots.<\/p>\n<p>In her response to a lawsuit over the matter filed by a number of far-left activist groups, Baxter ruled against a number of Pennsylvania county election boards.<\/p>\n<p>In her ruling, Baxter addressed <a href=\"https:\/\/www.westernjournal.com\/pennsylvania-voter-ditching-biden-2024-cant-afford-four-years\/\" target=\"_blank\" rel=\"noopener\">Pennsylvania<\/a> voters who claimed they were \u201cdisenfranchised in the November 2022 election because their mail ballots were not counted\u201d after they neglected to fill them out properly.<\/p>\n<p>The judge claimed that requiring such ballots to be properly dated violates <a href=\"https:\/\/www.westernjournal.com\/biden-transportation-department-uses-civil-rights-act-1964-halt-texas-highway-widening-project\/\" target=\"_blank\" rel=\"noopener\">the Civil Rights Act of 1964\u2019s<\/a> provision on voting.<\/p>\n<p>\u201cThe provision protects a citizen\u2019s right to vote by forbidding a state actor from disqualifying a voter because of their failure to provide or error in providing some unnecessary information on a voting application or ballot,\u201d Baxter stated.<\/p>\n<p>She added such ballots \u201cshould be counted because their statutory rights have been violated.\u201d<\/p>\n<p>The ruling was celebrated by the far-left American Civil Liberties Union on X:<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">BREAKING: A federal court in Pennsylvania just ruled that voters who submit mail ballots in time for an election but forget to write the date on the mail ballot envelope will still have their ballots counted.<\/p>\n<p>\u2014 ACLU (@ACLU) <a href=\"https:\/\/twitter.com\/ACLU\/status\/1727088570945724645?\">November 21, 2023<\/a><\/p>\n<\/blockquote>\n<p>The <a href=\"https:\/\/www.westernjournal.com\/aclu-seeks-overturn-law-increases-penalties-prostitutes-sell-services-knowing-hiv\/\" target=\"_blank\" rel=\"noopener\">ACLU\u2019s<\/a> celebration of the decision was met with pushback from people who expressed concerns that the ruling will undermine the integrity of next year\u2019s election:<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Objectively speaking, this makes it easier for bad actors to cheat in voting.
