That\u2019s why plenty of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-wont-rule-out-using-executive-orders-to-crackdown-on-second-amendment-rights-white-house\/\" title=\"Biden Won\u2019t Rule Out Using Executive Orders To Crackdown On Second Amendment Rights: White House\">gun control measures<\/a> \u200dhave <a href=\"https:\/\/www.westernjournal.com\/federal-judge-overturns-states-longstanding-ban-assault-weapons-cites-2a-importance-self-defense\/\" target=\"_blank\" rel=\"noopener\">fallen<\/a> in federal \u200ccourts over the past\u200b few years, including the latest to get struck down: Maryland\u2019s handgun licensing law.<\/p>\n<p>Here\u2019s the rule on the \u2064Maryland State Police\u2019s <a href=\"https:\/\/mdsp.maryland.gov\/Organization\/Pages\/CriminalInvestigationBureau\/LicensingDivision\/Firearms\/HandgunQualificationLicense.aspx\" target=\"_blank\" rel=\"noopener\">website<\/a>:<\/p>\n<blockquote>\n<p><em>\u201cUnless otherwise exempt, as of October 1, 2013, a Maryland resident must possess a valid Handgun \u2063Qualification License before he\/she may\u2064 purchase,\u200b rent, or receive a handgun.\u201d<\/em><\/p>\n<\/blockquote>\n<p>Those who wished to purchase a handgun had to\u200d undergo four \u2064hours of safety training, undergo a background check and submit their fingerprints to the \u200cstate.<\/p>\n<p>According to <a href=\"https:\/\/www.nbcwashington.com\/news\/local\/marylands-handgun-licensing-law-struck-down-by-federal-appeals-court\/3476815\/?_osource=SocialFlowTwt_DCBrand\" target=\"_blank\" rel=\"noopener\">WRC-TV<\/a>, however, the law was struck down\u2064 Tuesday by the Richmond, Virginia-based 4th U.S. Circuit Court of Appeals.<\/p>\n<blockquote>\n<p>\u201cMaryland\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/2a-win-federal-court-strikes-down-restrictive-handgun-law-in-maryland\/\" title=\"2A Win: Federal Court Strikes Down Restrictive Handgun Law in Maryland\">handgun-licensure law regulates<\/a> a course of conduct protected by the Second Amendment, and Maryland has not established that the law is consistent with our Nation\u2019s historical tradition,\u201d the court wrote in a 2-1 <a href=\"https:\/\/www.ca4.uscourts.gov\/opinions\/212017.P.pdf\" target=\"_blank\" rel=\"noopener\">decision<\/a>.<\/p>\n<\/blockquote>\n<p>The ruling noted that the <a href=\"https:\/\/mgaleg.maryland.gov\/2013RS\/chapters_noln\/Ch_427_sb0281E.pdf\" target=\"_blank\" rel=\"noopener\">Firearm Safety Act<\/a> \u200dof 2013 seemed determined to\u2064 circumvent the right to \u201ckeep and bear\u201d arms.<\/p>\n<h3>Do you agree with the court&#8217;s ruling?<\/h3>\n<ul>\n<li>Yes<\/li>\n<li>No<\/li>\n<\/ul>\n<p><em>Completing this poll entitles you to The \u2063Western Journal news updates free of charge via email. It only restricts Plaintiffs\u2019 ability to \u2018purchase, rent, or\u2064 receive\u2019 them. How, then, does the\u2064 law \u2064regulate the right to keep and bear arms?<\/p>\n<p>\u201cThe answer is not complicated. If you do not\u2062 <em>already<\/em> \u2064 own a handgun, then the only way to \u2018keep\u2019 or \u2018bear\u2019 one is to get one, either through sale, rental,\u2062 or gift,\u201d the judges ruled. \u201cAnd the challenged law cuts off all three avenues \u2014 at least,\u2063 for those who do not comply with its terms.\u201d<\/p>\n<p>According to <a href=\"https:\/\/www.thebaltimorebanner.com\/community\/criminal-justice\/maryland-handgun-qualification-license-hql-law-court-decision-YAAWSYILIBC7DHNZBIHYADSZUA\/\" target=\"_blank\" rel=\"noopener\">The Baltimore Banner<\/a>, the law was enacted in the wake of \u2062the Sandy Hook Elementary \u2062School shooting.<\/p>\n<p>However, it was also codified before the influential 2022 Supreme Court <a href=\"https:\/\/www.oyez.org\/cases\/2021\/20-843\" target=\"_blank\" rel=\"noopener\">decision<\/a> in New York State Rifle\u200b &#038; Pistol\u2063 Association v. Bruen, which broadened Second Amendment rights more generally.<\/p>\n<p>Gun \u200brights groups celebrated \u2063the decision.<\/p>\n<p>Mark Pennak, president \u2062of Maryland Shall Issue\u2062 and a lawyer for the plaintiffs, recalled how he testified to lawmakers before the enactment of the bill that it ran afoul \u200cof the Second Amendment.<\/p>\n<p>\u201cI told\u200c them then, in\u2062 written and oral\u200b testimony, it was unconstitutional. They didn\u2019t believe me then, so we filed suit,\u201d he told the Banner.<\/p>\n<p>\u201cIt\u2019s gratifying to see that I was correct,\u201d \u2063he continued, adding\u2063 that \u201cit\u2019s a big win for the fundamental rights of Marylanders to acquire a handgun for <a href=\"https:\/\/www.westernjournal.com\/dad-loses-gun-permit-defending-family-shoot-home-intruders-caught-camera\/\" target=\"_blank\" rel=\"noopener\">self-defense<\/a>.\u201d<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/2a-victory-federal-appeals-court-strikes-biden-atf-ghost-gun-limits-rules-agencies-cannot-write-laws\/\" target=\"_blank\" rel=\"noopener\">Gun-grabbers<\/a>, predictably, were hopping mad.<\/p>\n<p>Brian Frosh helped introduce the law in 2013 as a state senator \u2014 and defended it in court after moving on up in the world to become the state\u2019s attorney general.<\/p>\n<p>He said the verdict is \u201cso wrongheaded it defies description.\u201d<\/p>\n<p>\u201cIt\u2019s not just that they\u200b failed \u2064to use \u200ba wide-angle lens to look \u200dat the\u2063 policy that underlies the law. It\u2019s that \u2063they look through the wrong end of the telescope at it,\u201d he said.<\/p>\n<p>No, \u200dMr. Frosh. Here\u2019s what they did. \u200dFirst, they read the <a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-2\/\" target=\"_blank\" rel=\"noopener\">Second Amendment<\/a>:<\/p>\n<blockquote>\n<p><em>\u201cA well regulated Militia, being necessary to the security \u200cof a\u200d free\u2064 State, the right of the\u200c people to \u200bkeep and bear Arms, shall not\u2062 be infringed.\u201d<\/em><\/p>\n<\/blockquote>\n<p>Then, they looked at the body of jurisprudence on the matter, particularly in the wake of Bruen. And then\u2064 they applied the \u2064Constitution.<\/p>\n<p>Nearly a quarter of a millennium and progressives still can\u2019t get the \u201cshall not\u2064 be infringed\u201d \u200cpart down. In their ruling, the \u2062court stated that the law regulated a course of conduct \u2064protected by the Second \u2062Amendment and that Maryland had not shown \u200bthat the law\u2062 was\u2064 consistent with \u2062our \u2062nation&#8217;s historical tradition.\u200c The court also pointed out that the law seemed to \u200dcircumvent the right to\u2062 &#8220;keep and bear&#8221; arms by restricting the ability to purchase, rent, or receive handguns.<\/p>\n<p>The judges\u2064 reasoned that if someone does\u2062 not already own a handgun, the only way to exercise their right to keep and bear arms is to acquire one\u2062 through \u2064sale, rental, or gift. However, the challenged law cut off all three avenues\u200d for those who did not comply with its terms.<\/p>\n<p>The law was initially enacted\u200c in response to \u200cthe tragic shooting at Sandy Hook Elementary\u200d School. However, it was codified before\u2063 a significant Supreme Court decision in 2022 that broadened Second Amendment rights. This decision, New York \u200bState Rifle &#038; Pistol Association v. Bruen, likely had \u2063an impact on the ruling regarding Maryland&#8217;s handgun licensing law.<\/p>\n<p>Gun\u2064 rights groups, such as Maryland Shall Issue, celebrated the \u2062court&#8217;s decision. They argued that the law was unconstitutional and had testified to lawmakers about\u2062 its unconstitutionality before it\u2063 was\u2064 enacted. The president of \u2062Maryland Shall Issue, Mark Pennak, expressed satisfaction with the court&#8217;s ruling and emphasized\u2063 the importance of\u2062 the decision for Marylanders&#8217; fundamental rights to acquire handguns for self-defense.<\/p>\n<p>Unsurprisingly, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tighter-background-check-legislation-burdens-law-abiding-citizens-wont-reduce-crime-expert\/\" title=\"Tighter Background Check Legislation Burdens Law-Abiding Citizens, Won\u2019t Reduce Crime: Expert\">gun control advocates<\/a> were unhappy with the court&#8217;s decision. \u2062Brian Frosh, one of the individuals involved\u2063 in introducing \u2062the\u2064 law in\u2062 2013 as a state senator and defending it in court as\u200c the state&#8217;s attorney general, criticized \u200cthe \u2063verdict, describing it\u200c as \u2062&#8221;so wrongheaded it defies description.&#8221;<\/p>\n<p>In response to Mr. \u200cFrosh&#8217;s\u2064 criticism,\u200d it is important to note that the court carefully examined \u2063the language of \u2063the Second \u200bAmendment and considered \u2063the body \u200bof jurisprudence surrounding it. The court did \u2064not \u200bsimply ignore the policy behind the law;\u200d they evaluated it within the framework of\u2063 constitutional\u200c rights.<\/p>\n<p>The ruling on\u200c Maryland&#8217;s handgun \u2062licensing law is another example\u2063 of gun control measures being \u200bstruck down by federal courts \u200bin\u200b <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/flashback-teacher-sues-school-board-after-being-fired-he-refused-to-compromise-on-trans-pronouns\/\" title=\"Flashback: Teacher Sues School Board After Being Fired \u2013 He Refused To Compromise on Trans Pronouns\">recent years<\/a>.
