Local lawmakers in November updated that statute to strike the term &#8220;homosexuality&#8221; after a local LGBT group and the ACLU <a href=\"https:\/\/www.dnj.com\/story\/news\/2023\/11\/16\/boropride-aclu-wins-effort-remove-homosexuality-murfreesboro-city-code\/71607166007\/\" target=\"_blank\" rel=\"noopener\">sued<\/a> \u200c the city and secured \u200ca court ban on its enforcement.<\/p>\n<p>Newsom&#8217;s tweet came just a <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240AB873\" target=\"_blank\" rel=\"noopener\">month after he signed a law<\/a> requiring K-12 students in \u200bCalifornia to take internet media literacy courses on the grounds that &#8220;online misinformation has posed risks to international peace, interfered with democratic decisionmaking, and\u2062 threatened public health.&#8221;<\/p>\n<p>A spokesman for Newsom said that &#8220;it literally took a court order&#8221; for the city to change its old city code. By Friday morning, Newsom&#8217;s tweet had a <a href=\"https:\/\/twitter.com\/GavinNewsom\/status\/1725261423037804717\" target=\"_blank\" rel=\"noopener\">community note<\/a> appended, \u200cnoting that the ordinance \u200ddoes not ban homosexuality. The spokesman did \u2064not immediately \u2063respond to a follow-up question about whether the governor\u200b stands by his tweet.<\/p>\n<p>The <em>New Republic<\/em>&#8216;s <a href=\"https:\/\/newrepublic.com\/post\/176915\/tennessee-town-ban-public-homosexuality\" target=\"_blank\" rel=\"noopener\">story<\/a>\u2014which does not include a comment from Murfreesboro officials and whose primary authority is a transgender activist&#8217;s <a href=\"https:\/\/www.erininthemorning.com\/p\/city-ordinance-banning-public-homosexuality\" target=\"_blank\" rel=\"noopener\">blog post<\/a>\u2014centers on a city ordinance from June aimed at curbing kids&#8217; exposure to sexually explicit and \u200cinappropriate\u200c behavior and materials. These rules set &#8220;community\u2062 decency standards&#8221; that forbid people from publicly engaging in &#8220;indecent behavior&#8221;\u2014described as &#8220;indecent exposure,\u2064 public indecency, lewd behavior, nudity or sexual conduct.&#8221;<\/p>\n<p>The claim\u2063 that the ordinance also bans &#8220;being \u200bgay&#8221; relies on the law&#8217;s cross reference of a \u20631949 city code provision that defines sexual conduct as &#8220;acts of masturbation, \u2064homosexuality, sexual intercourse, or physical contact with a person&#8217;s clothed or unclothed genitals.&#8221;<\/p>\n<p>Murfreesboro lawmakers in October\u200b changed that provision to remove mention of\u200b homosexuality, nearly a month before the <em>New Republic<\/em> ran\u200b its story and before the activist&#8217;s blog \u2062post was \u200dpublished. The lawmakers \u200bin early November formally approved the amendment.<\/p>\n<p>A Murfreesboro \u200bspokesman told the \u2062 <em>Washington\u200d Free Beacon<\/em> \u2063 that\u200d until this change, the old provision\u2062 defining sexual conduct had not been amended since the 1970s. The\u2063 spokesman also noted that the city has &#8220;no record or recollection of it having ever been enforced for purposes of homosexuality.&#8221;\u200c Many states and localities keep obsolete or anachronistic \u2064laws on the books because repealing or changing them is \u2063a\u2064 low priority, <em>Vox<\/em> has <a href=\"https:\/\/www.vox.com\/the-highlight\/2019\/11\/18\/20963411\/weird-old-laws-historical-obsolete-laws\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>Neither the <em>New Republic<\/em> nor the reporter who authored the story responded to \u2063requests for comment.<\/p>\n<p>This isn&#8217;t the first time Newsom has made false\u200c or misleading claims against conservatives, particularly around the culture wars. The \u2062governor <a href=\"https:\/\/www.foxnews.com\/politics\/gavin-newsoms-office-fails-provide-proof-of-florida-college-book-ban-claimed-by-california-governor\" target=\"_blank\" rel=\"noopener\">tweeted<\/a> in April\u2063 that the New College in Florida is banning books, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrats-seek-to-force-big-tech-to-police-content-more-tightly-in-section-230-reform-bill\/\" title=\"Democrats Seek to Force Big Tech to Police Content More Tightly in Section 230 Reform Bill\">stifling free speech<\/a>, bullying students, and frightening professors\u2014but his office did not respond to press requests to name a\u200d single book the college had &#8220;banned.&#8221;<\/p>\n<\/div>\n<p> <\/p>\n<h2> \u200d How does the New Republic article contribute \u200cto the misunderstanding of the Murfreesboro ordinance, and\u2062 what\u200c sources does\u2062 it rely \u200bon for \u200dits claims<\/h2>\n<p><span>  California Governor Gavin Newsom recently made\u200c false claims on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-new-acting-attorney-general-jeff-rosen-recently-wrote-an-essay-on-foreign-influence-in-us-elections-this-tells-us-a-little-about-his-knowledge-of-whats-going-on-today\/\" title=\"The New Acting Attorney General Jeff Rosen Recently Wrote an Essay on Foreign Influence in US Elections \u2013 This Tells Us A Little About His Knowledge of What\u2019s Going On Today\">social media platform<\/a> X, formerly known as Twitter, accusing a small town\u2062 in Tennessee of banning &#8220;being gay in public.&#8221; \u200cNewsom shared a link to a New Republic article that \u2064claims \u200bthe \u2064city council \u2064of Murfreesboro, Tennessee, \u2064passed an\u2062 ordinance prohibiting homosexuality\u200b in public spaces to ban certain library \u2062books.<\/p>\n<p>However,\u2064 Murfreesboro&#8217;s ordinance actually establishes decency standards for public spaces, \u200bwhich include prohibiting indecent\u2064 exposure,\u2063 lewd\u200b behavior, nudity, sexual \u200cconduct, and \u2062indecent materials and events. While\u200c the ordinance was initially \u200bused to remove explicit children&#8217;s books\u2064 from the public library, it does not\u200c specifically \u2062mention \u2064homosexuality. The ordinance cross-references a statute about sexual \u200dconduct that \u200dused to \u2062include\u200b homosexuality until\u2062 October.
