The case \u200dwas filed by voters who want <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/stacey-abrams-voting-rights-pac-helped-group-that-pushed-voter-fraud-conspiracy-theories\/\" title=\"Stacey Abrams\u2019 Voting Rights PAC Helped Group That Pushed Voter Fraud Conspiracy Theories\">hand-marked paper ballots<\/a> to replace the \u200bexisting system of machines sold to the state by Dominion Voting Systems. The lawsuit\u200d began three years\u200b before the allegations over Dominion\u2019s machines that became part \u200bof\u200c the contentious aftermath of the 2020 presidential election.<\/p>\n<p>On Nov. 10, U.S.\u2062 District\u2062 Judge Amy\u2063 Totenberg issued\u200d a ruling rejecting the state\u2019s position that no trial was \u2062necessary.\u2062 The ruling called for the state and \u200bits critics to try to \u200cresolve their differences without a trial.<\/p>\n<blockquote>\n<p>\u201cThe Court\u2063 cannot \u2062wave a \u2064magic wand in this case to address\u2064 the varied \u200bchallenges to our democracy and \u2064election system in recent years, including those \u200cpresented\u200d in this case,\u201d she wrote.<\/p>\n<p>\u201cBut reasonable, \u2063timely\u200d discussion and compromise in this case, coupled with prompt,\u200b informed legislative action, might certainly make a difference that benefits the parties and the public,\u201d she wrote.<\/p>\n<\/blockquote>\n<p>But that seems\u200c unlikely.<\/p>\n<p>\u201cThe court\u2019s order makes it clear\u200b that Georgia\u2019s status quo is far too\u200b risky, and that these concerning issues merit a trial. \u200bWe\u200c look forward to prevailing \u2064at trial as we demonstrate why touchscreen BMDs (ballot-marking devices) cannot be used \u2064safely,\u201d said Marilyn Marks, executive director for the Coalition for Good Governance, one plaintiff suing the state, according to the Atlanta Journal-Constitution.<\/p>\n<p>David Cross, an\u2063 attorney for\u200b some plaintiffs, said the court ruling noted \u201ca long story \u2062of \u200cincompetence, \u2063conflicting\u2064 claims, and \u2064misinformation.\u201d<\/p>\n<h3>Should Dominion voting machines be \u2062removed \u200cfrom use?<\/h3>\n<ul>\n<li>Yes<\/li>\n<li>No<\/li>\n<\/ul>\n<p>Completing this poll entitles you to The Western\u2063 Journal\u200d news \u200bupdates free of charge via email. You\u200b also\u200d agree to our <a href=\"https:\/\/www.westernjournal.com\/about\/privacy-policy\/\">Privacy Policy<\/a> and <a href=\"https:\/\/www.westernjournal.com\/about\/terms-service\/\">Terms of Use<\/a>.<\/p>\n<p>Deputy\u2062 Secretary \u2063of State Jordan Fuchs seemed disinclined for a chat.<\/p>\n<p>\u201cWe don\u2019t negotiate with election\u2064 deniers,\u201d Fuchs said. \u201cIf they have an idea that wouldn\u2019t take Georgia\u2062 back to the\u200b days of hanging chads and stuffed ballot boxes, they should offer it.\u201d<\/p>\n<p>Amid the\u200d 135 pages\u200b of her ruling, Totenberg \u2064pushed back against labeling the plaintiffs.<\/p>\n<p>\u201cThe Court notes that\u2063 the record evidence does not suggest that \u2064the Plaintiffs are conspiracy\u2064 theorists of any variety. \u200cIndeed, some of the nation\u2019s leading cybersecurity experts and computer scientists\u2062 have \u2062provided testimony and affidavits on\u200d behalf of Plaintiffs\u2019 case in the long \u2062course of this litigation,\u201d she wrote.<\/p>\n<p>One \u2063report was \u200bfiled by Alex Halderman,\u200c a computer science professor at the University of\u2064 Michigan.\u2064 His report, produced in 2021,\u200d said Georgia\u2019s \u2064system \u201csuffers from critical vulnerabilities that can be exploited to subvert all of its security mechanisms,\u201d\u200d according to \u2063the Atlanta Journal-Constitution.<\/p>\n<p>Halderman said anyone with physical access to a \u200cvoting machine \u2063had the capability\u200b to alter votes on the machine, and that \u2062someone who accessed the election\u200c management system could do more than change \u200cone machine.<\/p>\n<p>According\u2062 to the Associated Press,\u2063 the state has said it will not install a \u2062software\u200c update that \u2063could address the issues\u200b raised by Halderman.<\/p>\n<p>Gabriel Sterling, chief operating \u2062officer in the Secretary \u200bof State\u2019s office has mocked Halderman\u2019s conclusions as \u201chypothetical scenarios\u200c that \u200dcan\u2019t work.\u201d<\/p>\n<p>But \u200dthose pushing for change\u2063 say\u200c just going to trial shows there \u200bis a problem.<\/p>\n<p>\u201cWe\u200b look forward to presenting our full \u2064evidence at trial and\u200b obtaining critical relief for Georgia voters,\u201d Cross said. \u201cBut we \u200chope this decision\u2064 will be\u2063 a much-needed wakeup \u2062call\u200c for the Secretary and \u2064SEB, and finally spur them to \u200cwork with us on a negotiated resolution that secures \u2064the \u2064right to vote\u200b in Georgia.\u201d<\/p>\n<hr>\n<div class=\"author_subscription_pitch\">\n<p><em><b>A \u2063Note from Our Deputy \u200cManaging Editor:<\/b><\/em><\/p>\n<p><em><span style=\"font-weight: 400\">I walked \u200binto the office one morning and noticed \u2062something strange.
