Lisa McClain \u2062(R-MI), the chairwoman\u200b of the Oversight Committee&#8217;s Subcommittee on Health Care and Financial \u200cServices, along with House Education and Workforce Committee\u2064 Chairwoman Virginia Foxx (R-NC), sent a letter to Cardona on Thursday informing the secretary that the committees are investigating &#8220;whether any external organizations played an outsized \u2064role in the development\u2063 of the proposed \u2063regulations.&#8221;<\/p>\n<p>The Biden administration&#8217;s regulations, which were proposed in June 2022, drastically overhaul the department&#8217;s \u200ccurrent rule, which was implemented\u2062 by the Trump administration and then-Secretary Betsy DeVos. The Trump-era rules established a number of new\u200c requirements aimed at <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gun-rights-groups-explain-the-problems-with-gun-control-bill-that-14-gop-senators-caved-on\/\" title=\"Gun Rights Groups Explain The Problems With Gun Control Bill That 14 GOP Senators Caved On\">protecting due process<\/a> in Title IX hearings at colleges.<\/p>\n<p>Title IX, first passed \u200cin 1972, prohibits discrimination on the basis of sex at educational\u2064 institutions that receive federal \u2063funding. The law has largely been credited for the explosion\u200c of interest\u200c in women&#8217;s sports but also governs how institutions must respond to cases of sexual harassment or assault \u200bthat \u2064occur on campus.<\/p>\n<p>The \u200cnew regulations, which \u2062have\u2062 yet to be finalized, would eliminate a number \u2064of those\u2062 due process requirements, including a right to a\u2063 live hearing with\u2063 cross-examination. \u2063The regulations would also change the definition of &#8220;sex&#8221; in Title IX to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/christian-college-takes-biden-to-court-over-trans-mandate\/\" title=\"Christian College Takes Biden to Court Over Trans Mandate\">include gender identity<\/a> as a \u200dprotected class in nondiscrimination law.<\/p>\n<p>In their letter, the \u200clawmakers told Cardona that the\u200c proposed regulations, &#8220;if finalized, will\u200d only serve \u200cto harm the women that Title IX was \u200ddesigned to protect.&#8221;<\/p>\n<p>&#8220;The Committees are \u200dconcerned that your \u200defforts to gut due process protections for accused and accusing students, redefine &#8216;sex discrimination&#8217; to include &#8216;gender identity,&#8217; and otherwise abandon established regulations protecting \u2062women and girls are improperly motivated and destructive to American students,&#8221; they wrote. \u2064&#8221;According to the Department, the proposed rewrite of the Title IX regulations is necessary to provide &#8216;greater clarity regarding\u200c the scope of sex discrimination.&#8217; Rather than providing clarity, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-republicans-press-miguel-cardona-on-the-influence-of-outside-groups-on-title-ix-rule\/\" title=\"House Republicans press Miguel Cardona on the influence of outside groups on Title IX rule\">proposed regulations weaken\u2064 essential protections<\/a> for students that had been secured\u2063 by Secretary Betsy DeVos and\u2062 the\u200d Trump administration.&#8221;<\/p>\n<p>The letter requests \u2063that the department turn over any communications between the department&#8217;s \u200csenior staff and outside organizations regarding Title IX and the proposed rule for the committee&#8217;s oversight of the Department of Education.<\/p>\n<p>Foxx, in a statement to the Washington Examiner, accused the Biden administration of touting equality while &#8220;simultaneously dismantling Title IX and replacing it with a\u2063 framework that diminishes opportunities\u200b for girls and women in America.&#8221;<\/p>\n<p>&#8220;As\u2062 a mother and grandmother, I will\u2064 not stand idly by as this administration thumbs its nose to\u200c biology\u200d and erases the achievements of women,&#8221; Foxx said. &#8220;Our joint investigation into this \u2063radical\u2062 policy is\u200b an important step in holding President Biden accountable and reaffirming to women that they are\u200c not alone in this fight.\u201d<\/p>\n<p>McClain likewise\u200c told\u200d the Washington Examiner that the Biden administration was &#8220;putting\u2062 women\u2019s rights at risk by\u200d dismantling Title IX.&#8221;<\/p>\n<p>&#8220;As \u2062Congress seeks to bring transparency to how new regulations will wipe out female-only\u2062 sports, Secretary Cardona has refused to answer our questions,&#8221;\u2062 McClain\u2064 said. &#8220;It\u2019s time we get \u200banswers. They also \u2062seek\u200c any documents or records related \u2062to external influence, including records of any meetings, phone calls, emails, or other forms of communication between department officials and \u200bexternal entities.<\/p>\n<p>The letter also\u200d urges Cardona to \u2064allow \u200dthe committees to interview any department\u200d staff or contractors \u2063who were involved in the drafting of the proposed\u2062 regulations. The lawmakers\u200d emphasize the need for transparency and accountability in the\u200c rulemaking process, stating that &#8220;the \u2064American people deserve\u200c to know who\u2064 is influencing the regulations that impact their rights and freedoms.&#8221;<\/p>\n<p>Conservative lawmakers and \u2062advocacy groups have long been critical of the Biden\u200d administration&#8217;s approach to\u200b Title IX regulations, claiming that the proposed changes would undermine due process rights for accused students and disregard the \u2063rights of women. They argue that the elimination of live hearings and \u200ccross-examination could prevent accused \u2064students from\u2064 effectively defending themselves and could lead to unfair disciplinary actions.<\/p>\n<p>On the other hand, advocates for survivors of sexual assault and harassment have \u200cvoiced \u2062support for the Biden administration&#8217;s proposed regulations, arguing that the current system often fails to adequately address\u200c cases \u200dof\u200b gender-based\u2062 violence on college campuses. \u2062They believe that the new regulations would provide a more inclusive\u2063 and supportive \u200cenvironment for survivors, especially those from marginalized \u2063communities.<\/p>\n<p>The investigation into outside influence on the \u200bTitle IX regulations comes as the Biden administration faces increasing pressure to make changes to the\u200d proposed\u2063 rules.\u200c Republican lawmakers have introduced legislation to block the regulations, \u2062and advocacy groups on \u2064both sides of\u200c the issue have been actively lobbying for their preferred outcomes.<\/p>\n<p>Cardona has not yet publicly\u2063 responded to the letter from Rep.
