Therefore, liberal groups have \u2062been attempting, unsuccessfully, to remove Republicans\u2062 who opposed certifying the 2020 election, particularly Trump, from the ballot.<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/minnesota-supreme-court-hands-trump-win-tosses-14th-amendment-case\/\" target=\"_blank\" rel=\"noopener\">Their \u2064efforts \u200chave <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admin-asks-supreme-court-to-cancel-asylum-border-wall-arguments\/\" title=\"Biden Admin Asks Supreme Court to Cancel Asylum, Border Wall Arguments\">consistently failed<\/a><\/a>.<\/p>\n<p>For example, the Minnesota Supreme Court recently rejected a challenge\u2063 to remove Trump from the ballot. Similar attempts have \u2062been made to remove individual representatives from the \u200cballot, such as <a href=\"https:\/\/www.westernjournal.com\/judge-rules-favor-marjorie-taylor-greene-re-election-battle\/\" target=\"_blank\" rel=\"noopener\">Rep. Marjorie Taylor\u200b Greene<\/a> \u2064 of Georgia and former <a href=\"https:\/\/www.westernjournal.com\/gop-rep-madison-cawthorn-celebrates-huge-victory-judge-strikes-legal-challenge-re-election-bid\/\" target=\"_blank\" rel=\"noopener\">Rep. Madison Cawthorn<\/a> of North Carolina (although Cawthorn faced consequences \u2062from his own \u200dparty).<\/p>\n<p>While the 14th Amendment has been \u2064the subject of much legal interpretation, \u2064it has primarily been associated with the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-kraken-released-attorney-sidney-powell-files-104-page-bombshell-complaint-of-massive-fraud-in-georgia-election-update-michigan-too\/\" title=\"BREAKING: KRAKEN RELEASED! Disqualifying Democrats from office for expressing doubts about\u200b the\u200d outcomes of previous \u2064elections, such as in 2000, 2004, \u200cand 2016, was never considered\u2063 an option.<\/p>\n<p>However, after the Capitol incursion on January\u200d 6,\u200b 2021, some\u200d on the left began treating that event as worse than 9\/11 or Pearl Harbor, and the &#8220;insurrection&#8221; clause suddenly gained significance.<\/p>\n<p>Despite this, \u200bliberal groups have yet to achieve a major\u200c court \u2062victory and are unlikely to do\u200c so in the near future.<\/p>\n<p>In the\u200c Michigan case, Judge James Redford of the Michigan\u200c Court of Claims ruled that Congress should \u2062address this as a &#8220;political question&#8221; that is beyond the\u2064 jurisdiction of the judiciary.<\/p>\n<p>Redford argued that removing Trump from the ballot\u2063 would unconstitutionally transfer the decision \u200bto exclude him from &#8220;a body made\u2064 up of elected representatives\u2063 of\u2063 the people of every state in \u200cthe nation&#8221;\u200d to a single judicial officer. \u2064He emphasized that \u200dno matter\u2063 how well-intentioned and fair the judge may be, they cannot represent the qualities of \u2063every citizen of the nation.<\/p>\n<p>In other words, Congress should be responsible for making such decisions.<\/p>\n<p>A similar \u200dcase is pending in Colorado, and the results are\u200b expected by the end of the week. However, it would be \u200bsurprising if the outcome \u2063differed from previous rulings.<\/p>\n<p>Considering \u200dthat\u200c the 14th Amendment has only\u2063 been applied twice since 1919 and never to a major\u2062 candidate like\u200d Trump, this use\u200b of the law is unprecedented and unrelated \u200dto its original intent.<\/p>\n<p>According to Trump\u200b campaign spokesman Steven Cheung, &#8220;Each and every one of these ridiculous cases have lost because they are all un-Constitutional left-wing fantasies orchestrated by monied allies of the \u2063Biden \u2064campaign seeking to turn the \u200belection\u200c over to the courts and \u2062deny the American \u2064people the \u200bright\u200d to\u200d choose \u2063their next\u200c president.&#8221;<\/p>\n<p>The group that lost the Michigan lawsuit \u200bplans to file an\u200b immediate appeal and hopes \u2063to involve the <a href=\"https:\/\/www.westernjournal.com\/can-governments-spy-citizens-using-drones-michigan-supreme-court-set-decide-landmark-case\/\" target=\"_blank\" rel=\"noopener\">state Supreme Court<\/a>, arguing that the judge adopted a discredited theory regarding \u200dCongress&#8217; role \u200cin \u2064the insurrection clause.<\/p>\n<p>Michigan is a \u200ccrucial state\u2063 in the 2024 \u2063election, and Trump \u2064may have a slim chance in Colorado \u2063and Minnesota. Therefore, conservatives should remain concerned\u2063 about these legal actions.
