Yet Weiss also acknowledged it would be a \u201cproblem\u201d \u2062if someone had warned Joe Biden\u2019s transition team of FBI agents\u2019 impending plan\u2062 to \u200cinterview the \u2062president-elect\u2019s son, as whistleblowers say occurred. Weiss just didn\u2019t\u200c bother to ask anyone about the leak or any other concerns \u200dof political favoritism, \u200cshowing the \u2064federal \u200cprosecutor has opted\u200c for willful blindness over oversight of the Hunter Biden criminal probe \u2014 even after his appointment\u2062 as special counsel.<\/p>\n<\/blockquote>\n<p>On Tuesday, Weiss sat for an interview before the House Judiciary Committee. A transcript of Weiss\u2019s testimony, which \u200dThe \u2064Federalist has \u2062reviewed, shows the special counsel faced several questions about claims \u2063that political favoritism \u2063infected the Hunter Biden\u200b investigation.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-2005219434\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-45ef84a55d8cf7aff58992ab89743afc fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-45ef84a55d8cf7aff58992ab89743afc\"><\/div>\n<p>But even before the questioning began, in \u200ca\u2063 brief\u2063 opening statement, Weiss declared that \u201cpolitical considerations played no part in our decisionmaking.\u201d Rather, the Delaware U.S. attorney, doing double duty as special counsel, assured the committee that \u2063\u201cthroughout this investigation, career prosecutors on my team and I have <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/andrew-cuomo-personally-edited-report-that-undercounted-covid-19-nursing-home-deaths-and-downplayed-impact-of-his-march-25-directive\/\" title=\"Andrew Cuomo Personally Edited Report That Undercounted COVID-19 Nursing Home Deaths And Downplayed Impact Of His March 25 Directive\">made decisions based<\/a> on the facts and the law.\u201d<\/p>\n<p>Weiss \u200drepeated that\u2062 mantra several times \u200bduring \u200dquestioning about specific steps his team took \u2014 or didn\u2019t take \u2014 \u2062in the Hunter Biden investigation. \u201cAgain, I\u2019m \u200bnot going to comment \u200bon any aspect of the investigation or a prosecution, and from my perspective, the prosecutors who participated in this case followed the law and the facts. That was the motivation.\u201d<\/p>\n<p>Of course that was\u200c Weiss\u2019s \u201cperspective\u201d because, even after the IRS whistleblowers\u2062 provided concrete examples of the politicization of the Hunter\u2063 Biden\u200c investigation, the \u2063U.S. attorney buried his head in the sand rather than inquire about the veracity of\u200d the claims. The totality of Weiss\u2019s\u200c testimony confirms this reality, but it \u2062is best exemplified in\u200c an \u200cexchange about the warning given to President-elect Joe Biden\u2019s\u2062 transition team \u200cthat agents intended to interview Hunter Biden.<\/p>\n<p>IRS whistleblower Gary \u200bShapley had previously testified that the day before \u2062their Dec. 8, 2020 \u201cday of action,\u201d when\u200d agents planned to interview a host of relevant witnesses, he learned \u200csomeone had tipped\u2063 off Joe Biden\u2019s transition team\u2063 of the plans\u2063 to interview \u200bHunter Biden and another 10-plus witnesses. \u201cThis essentially tipped off a\u2062 group of people very\u2064 close to President Biden and Hunter Biden and gave this\u2064 group an opportunity to obstruct the approach on the witnesses,\u201d Shapley <a href=\"https:\/\/waysandmeans.house.gov\/wp-content\/uploads\/2023\/06\/Whistleblower-1-Transcript_Redacted.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> the House Ways and Means Committee.<\/p>\n<div class=\"fdrlst__b89e9-10e0051ab3a1c997403cf5f5d0280444 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-10e0051ab3a1c997403cf5f5d0280444\"><\/div>\n<h2 class=\"wp-block-heading\">A Concerning\u2062 Connection<\/h2>\n<p>However, additional\u2062 questioning soon reviewed\u200c a concerning connection between the Delaware U.S. attorney\u2019s office and the Biden \u200dtransition team,\u2063 in \u200dthe person of Alexander Mackler, whom Weiss \u2064acknowledged had been\u200c one of his assistant U.S. attorneys from 2016 through about\u200d mid-2019. According to the committee\u2019s questioning, Mackler had at one \u2063point\u200d served as Joe Biden\u2019s press secretary, had been Beau Biden\u2019s campaign manager during his reelection campaign, and\u200c from \u20622014-2016 served as deputy counsel to then-Vice President \u2064Biden. While Weiss testified he knew Mackler had worked \u2064for Biden, he said he didn\u2019t know\u2064 many of those specifics. However,\u200d Weiss acknowledged learning that Mackler had\u2062 been named to \u2064Biden\u2019s transition team, although he said he couldn\u2019t remember when or how he had \u2062learned of that fact.<\/p>\n<p>The\u2062 House Judiciary Committee then \u200cpushed Weiss on whether he or anyone else from his office had any communications with Mackler while he was working with the transition \u2062team. While Weiss stated he was \u201cvery confident\u201d he \u201chad no conversations\u201d with \u200cMackler\u2064 about the\u2062 latter\u2019s work \u2062on the transition team or about the Hunter Biden case, Weiss said he had \u201cno idea whether anyone else has\u200b spoken \u2064to Alex Mackler period or\u2062 about the case.\u201d<\/p>\n<p>Weiss further testified that he was actually unaware of whether\u2062 the transition team \u200chad been tipped off, as IRS whistleblowers claimed. \u200cBut if so, Weiss confirmed it would be \u201ca concern\u201d and \u201ca problem\u201d and that\u200c \u201cit shouldn\u2019t happen.\u201d Yet when pushed on what he \u200bwould do to address\u200c the problem if he \u201cfound out\u2064 that something \u2063like that did occur,\u201d Weiss refused to answer \u2062the question, saying it was \u201ca hypothetical\u201d that he would not \u201cspeculate on\u201d\u2064 other than \u200csaying that \u201cas a general matter, it\u2019s problematic.\u201d<\/p>\n<div class=\"fdrlst__b89e9-6491afe969625939f0f5338f18b805ca fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-6491afe969625939f0f5338f18b805ca\"><\/div>\n<h2 class=\"wp-block-heading\">Willful Blindness<\/h2>\n<p>On first blush,\u2062 Weiss\u2019s nonanswers about the tip-off \u200bto the transition team seem like inconsequential, unhelpful responses \u200cthat merely lead to a dead end. But Weiss\u2019s acknowledged ignorance is explosive news: The man\u2064 that Attorney General Merrick Garland named as special counsel to supposedly ensure independence in the investigation and prosecution of the president\u2019s\u2064 son failed to inquire of\u200d his team about whether someone had leaked to the transition team details about the impending questioning of Hunter Biden. \u2063In fact, according to Weiss, he didn\u2019t even bother to confirm the tip-off had occurred \u2014 much less seek to determine who\u2063 bore responsibility for the\u2064 leak \u2014\u2062 even though he knew that a former Delaware assistant U.S. attorney served on the Biden transition team.<\/p>\n<p>Weiss\u2019s failure in this regard was not an aberration. Rather, \u200bthroughout his House Judiciary\u2063 Committee testimony last week, Weiss confirmed he has\u200d ignored the whistleblowers\u2019 claims of politicization. For instance, when asked whether \u201cany of the attorneys on your team, \u2064whether \u200dit\u2019s a\u2063 Special Counsel team or \u200bbefore the\u200d Special Counsel team was stood up, have any ties which you would consider close to the Biden family,\u201d\u200c Weiss said\u200d he doesn\u2019t \u201cdelve into those kinds of things,\u201d but\u200c that he is \u201cunaware of any such thing.\u201d<\/p>\n<p>Weiss\u2019s failure to inquire about his staff\u2019s \u2064relationship\u200c with the Biden family \u2063may have made sense initially, but given the\u200c two\u200c whistleblowers\u2019 detailed \u200callegations\u200d of \u200dpolitical favoritism, not asking some basic questions to ensure an unbiased \u2064staff is inexcusable.<\/p>\n<p>Weiss\u2019s failures extend much further, however, with his Tuesday testimony confirming he has not reviewed his staff\u2019s handling of the investigation in light\u2063 of the whistleblowers\u2019 testimony that there were \u201cpolitically-motivated decisions made in the Hunter Biden case.\u201d Specifically, while Weiss acknowledged the whistleblowers\u2019 claims, \u200dhis responses \u2062to questions show \u200dhe disregarded the\u2062 claims without any inquiry. For instance, when asked, \u201cIf an \u200binvestigator or prosecutor makes what \u2062is believed to be \u200ba politically-motivated statement or decision, how is that\u200b reviewed in your office?\u201d Weiss responded that he was \u201cnot aware\u2064 of such \u200ca situation.\u201d<\/p>\n<p>The\u200b House committee pushed the special counsel \u200bmore \u2063on\u200d this point, asking: \u201cFor example, on\u200c the Hunter Biden case,\u2063 if one of your assistant United\u200d States attorneys was exhibiting favoritism \u200btowards\u200b the \u200cBiden family or towards Hunter Biden, and that was brought \u200bto your attention, what\u200b would be \u200bthe\u2062 process to sort that out?\u201d<\/p>\n<p>\u201cMy office has no process or protocol for\u2064 dealing with something like \u2064that. It\u2019s not something we have engaged in, participated in, \u2063or that I have experienced,\u201d \u2063Weiss countered. Weiss held firm under additional questioning, stating \u2063he was \u201cnot aware \u2064of\u200c any such reviews.\u201d<\/p>\n<p>\u201cI\u2019ve told you. I have no such process.\u2062 We haven\u2019t \u200cexperienced it in our office,\u201d Weiss insisted.<\/p>\n<h2 class=\"wp-block-heading\">Head \u200din the\u200d Sand<\/h2>\n<p>This testimony establishes\u200d that Weiss \u2063has done nothing to\u2063 review his\u2062 team\u2019s handling of\u2064 the Hunter Biden investigation for possible\u200d political bias, notwithstanding the whistleblowers\u2019 detailed claims\u2063 of such favoritism. No wonder \u200cthen\u200d that Weiss can say he \u200dhas confidence in his prosecutors and believes they acted \u2063\u201cin a professional and unbiased manner without partisan or \u200cpolitical\u200d considerations.\u201d<\/p>\n<p>Ironically, if \u2064this were \u2064a\u2063 criminal case\u200d in which federal prosecutors needed to establish the defendant\u2019s knowledge\u200d of \u2063some sort of \u201cshady dealings,\u201d \u2063the \u2062U.S. attorney\u2019s office would seek what is collegially called the \u201costrich instruction.\u201d The\u2062 \u201costrich instruction\u201d informs the \u200bjury that a deliberate effort \u201cto avoid guilty knowledge is \u2062all the \u2064guilty knowledge the law requires,\u201d and that a defendant who\u200b knows or strongly\u2064 suspects \u201che is involved in shady dealings\u201d cannot \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-denies-clinton-attorney-micheal-sussmanns-movement-to-dismiss-costs-for-alleged-lies-to-the-fbi\/\" title=\"Judge Denies Clinton Attorney Micheal Sussmann\u2019s Movement To Dismiss COSTS FOR Alleged Lies To The FBI\">avoid criminal liability<\/a> by \u2062making sure\u200c \u201che does not \u200dacquire full or exact knowledge of \u2063the\u200d nature and extent of those dealings.\u201d<\/p>\n<p>While there is no suggestion that Weiss\u200d is a co-conspirator in some\u200d criminal enterprise, \u2064he \u2062is \u200csimilarly burying\u200b his head in the sand \u200dwhen it comes to the politicization of the\u200c Biden investigation exposed\u200c by the IRS whistleblowers and congressional\u200c oversight committees. Thus, his\u2062 assurances that \u201cpolitical\u200d considerations \u2063played no part in\u2064 our decisionmaking\u201d are meaningless.<\/p>\n<div class=\"fdrlst__b89e9-bf4a9f03c6741deb17a24fd0dbfbc739 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-bf4a9f03c6741deb17a24fd0dbfbc739\"><\/div>\n<hr class=\"wp-block-separator\">\n<\/div>\n<p> <\/p>\n<h2> Why did Weiss fail to address the\u200b issue\u2063 of leaked information about the FBI&#8217;s intention to interview Hunter Biden \u200cand what does it reveal\u200c about his diligence and \u200bcommitment to addressing potential wrongdoing<\/h2>\n<p><span>  T\u200b 2021. Mackler then joined the Biden \u200bcampaign and eventually became the director of the Biden-Harris Transition Project. This connection raised\u200b questions about\u200c whether\u2064 there was any improper communication between\u2064 the U.S. attorney&#8217;s office and the Biden transition \u2063team.<\/p>\n<p>During the questioning, Weiss\u200d admitted that\u200d he \u200cdid not inquire \u2062about this potential conflict of interest. He \u200dstated that he was not aware of Mackler&#8217;s\u200c role in the transition team until after the transition\u2063 was completed. This \u200black of awareness \u200dand oversight is concerning, especially considering\u2063 the allegations of \u2063political favoritism in the Hunter Biden investigation.<\/p>\n<p>Furthermore, Weiss also\u2064 failed to address the issue of the leaked information about the FBI&#8217;s\u2064 intention to interview\u2063 Hunter Biden.
