Cody Wisniewski, a lawyer for the\u2063 Firearms Policy Coalition \u2063Action Foundation, expressed his satisfaction with\u2063 the decision.<\/p>\n<p>The rule in question redefined the legal definitions of &#8220;firearm,&#8221; &#8220;frame,&#8221; and &#8220;receiver&#8221; as \u200doutlined in the\u2063 Gun Control Act of 1968. However, \u2062Judge Kurt Engelhardt, who \u2062authored the decision, argued that the power to create laws lies solely with the legislative branch \u200cand that the ATF had overstepped its \u2064authority.<\/p>\n<p>Judge Engelhardt further criticized the ATF for attempting to take on the\u2063 role of Congress in shaping gun control\u2062 policies. He emphasized that \u2064an executive agency should not have the \u2064power \u200bto \u2064criminalize conduct\u2062 without the input of the people subject to its penalties.<\/p>\n<p>In a concurring opinion, Judge Andrew Oldham criticized the ATF&#8217;s attempt to replace clear\u2063 rules with \u200da \u2064vague and uncertain balancing test. He\u2062 argued\u2063 that law-abiding Americans rely on regulatory certainty to comply\u2062 with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-agrees-to-take-up-challenge-to-trump-era-bump-stock-ban\/\" title=\"Supreme Court to review Trump's bump stock ban.\">federal gun\u200d laws<\/a> and that the\u200b ATF&#8217;s rule \u2062undermines this certainty.<\/p>\n<p>Despite the court&#8217;s ruling, \u2063the ATF rule is expected to remain in effect\u2063 for the time being.
