otherwise lawful gun owners.<\/p>\n<p>The\u2062 rule promulgated by President\u2064 Joe Biden\u2019s Bureau of Alcohol, Tobacco, Firearms and Explosives\u200c redefined\u200c pistol braces as short-barreled rifles, \u2062bringing them under the purview of the National Firearms Act and subjecting \u2062them \u200dto significant\u2064 federal regulation.<\/p>\n<p>U.S. District Judge Matthew \u200bKacsmaryk blocked enforcement of \u200cthat rule with his injunction, which\u200b was \u200bsigned Wednesday.<\/p>\n<p>Under the wording \u200bof <a href=\"https:\/\/www.atf.gov\/rules-and-regulations\/factoring-criteria-firearms-attached-stabilizing-braces\" target=\"_blank\" rel=\"noopener\">the rule<\/a>,\u2064 issued by the <a href=\"https:\/\/www.westernjournal.com\/bidens-atf-creating-sneaky-backdoor-gun-owners-proposal-will-soon-finalized-enacted\/\" target=\"_blank\" rel=\"noopener\">ATF<\/a> on January 13 \u2064with an effective date of January 31, owners of pistol braces had several choices:<\/p>\n<ol>\n<li>Register the pistol as a short-barreled rifle \u200cbefore a \u2062May 31 deadline (the ATF waived the $200 tax normally \u200bassociated \u2062with\u2062 such registrations)<\/li>\n<li>Remove the \u2063short barrel\u200d and\u2062 attach a 16-inch or longer rifled barrel\u200d to the firearm<\/li>\n<li>Permanently remove and dispose of,\u2062 or \u200balter, the \u2018stabilizing brace\u2019 such that it cannot be reattached<\/li>\n<li>Turn the firearm into \u2063your local ATF office<\/li>\n<li>Destroy the firearm in its entirety<\/li>\n<\/ol>\n<p>Failure to comply could result in up to 10 years in prison as\u200d well as a \u200bfine up $10,000.<\/p>\n<p>According to \u200c <a href=\"https:\/\/thetexan.news\/issues\/second-amendment\/pistol-brace-regulation-blocked-in-nationwide-injunction-from-amarillo-federal-judge\/article_79dee5e6-7f4d-11ee-ae8e-e775c3ba76e1.html\" target=\"_blank\" rel=\"noopener\">The\u200c Texan<\/a>, \u2062Kacsmaryk issued the order in a lawsuit filed by\u2063 three\u200b plaintiffs who sued the <a href=\"https:\/\/www.westernjournal.com\/matt-gaetz-accuses-atf-violating-federal-law-intimidating-congressional-witnesses\/\" target=\"_blank\" rel=\"noopener\">ATF<\/a> in \u200bthe federal District \u2063Court for the \u2063Northern District of Texas.<\/p>\n<p>Two of the plaintiffs argued\u2062 they used the pistol braces for better control of their firearms after having been injured while <a href=\"https:\/\/www.westernjournal.com\/carrie-underwood-raises-420000-veterans-first-responders\/\" target=\"_blank\" rel=\"noopener\">serving in the military<\/a>.<\/p>\n<p>Under the\u200d NFA, rifles with barrels shorter than\u200b 16 require potential owners \u2062to jump through significant hoops prior to\u2064 purchase, including an \u201c<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dems-fire-back-at-white-house-for-out-of-touch-marijuana-use-policy\/\" title=\"Dems Fire Back At White House For \u2018Out Of Touch\u2019 Marijuana Use Policy\">extensive background check<\/a>,\u201d \u2063payment \u2064of a $200 tax and a wait time of up to 12 months.<\/p>\n<p>Pistols without braces attached are not subject to the \u200bNFA, which addresses firearms that \u201cCongress has found to be inherently dangerous and generally\u200b lacking usefulness, \u2064except \u200bfor violent and criminal purposes,\u201d Kacsmaryk\u2019s order stated,\u200c acknowledging the ATF\u2019s\u2062 legitimate role in enhancing public \u200dsafety.<\/p>\n<p>\u201cPublic safety concerns must be \u2064addressed \u200cin ways that\u200b are lawful,\u201d the judge wrote. \u201cThis rule is not.\u201d<\/p>\n<p>\u201cThis new <a
