That testimony would have been an explosive twist in \u200cthe House\u2019s investigation into the DOJ\u2019s obstruction of the Hunter Biden case \u2014 but for the fact that Weiss soon after \u2063contradicted\u200c himself, saying he had instead been <em>promised<\/em> special attorney\u2064 authority. That Weiss \u200bcan\u2019t keep his story straight is telling of a bigger scandal. <\/p>\n<p>On Tuesday, the Delaware U.S. attorney, who is doing double duty as special counsel, sat for an interview\u2063 with the \u2062House Judiciary Committee, a transcript of which The Federalist has reviewed. While much of the interview consisted of Weiss refusing to answer the\u200d House\u2019s \u2062questions under the guise of protecting an ongoing investigation, he did respond \u2064to questions about his charging \u200dauthority.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1520676243\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-d660e6ea00d35d0fa337f1efcd1be45c fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-d660e6ea00d35d0fa337f1efcd1be45c\"><\/div>\n<h2 class=\"wp-block-heading\">More Obfuscation<\/h2>\n<p>The House focused on \u200bwhether Weiss had sought what is called Section \u200c515 special attorney authority \u2062from the Department of Justice. Under Section 515, a U.S. attorney for one federal district may bring criminal proceedings in another district \u201cwhen specifically directed \u200cby the Attorney General.\u201d Thus, if Weiss had\u2064 been granted special attorney status under Section 515, he could have brought criminal charges against Hunter Biden in \u2063a California federal district court or in the District of Columbia, even though he was the U.S. attorney for Delaware.<\/p>\n<p>IRS whistleblower Gary Shapley previously testified to the House Ways and \u200cMeans Committee that during a meeting on Oct. 7, 2022, Weiss had told the team investigating Hunter Biden that he \u200dhad previously asked the DOJ for \u201cspecial counsel authority\u201d but\u2064 was told to follow the process. While on Tuesday Weiss testified that he had not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/david-weiss-gives-more-conflicting-testimony-about-his-authority-to-charge-hunter-biden\/\" title=\"David Weiss's testimony on his authority to charge Hunter Biden remains inconsistent.\">requested special counsel\u2064 authority prior<\/a> to seeking a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-stefanik-cawthorn-support-appointing-special-counsel-on-biden-family-china-ties\/\" title=\"Exclusive -- Stefanik, Cawthorn Support\u00a0Appointing Special Counsel on Biden Family China Ties\">special counsel appointment<\/a> in August of 2023, Weiss said that he had\u2062 asked \u200cthe DOJ about the possibility \u2064of obtaining \u201cspecial attorney\u201d authority under\u2064 Section 515.<\/p>\n<p>According to Weiss,\u200d in February of\u200b 2022, he reached out to\u2064 then-Principal Associate Deputy Attorney General John \u200bCarlin to \u200cask about obtaining Section 515. \u201cI would have reached out because we were looking \u2062to bring certain portions\u200b of our investigation to either D.C. or\u2063 L.A. at\u2062 that\u2062 time,\u201d Weiss explained. But rather \u200bthan grant Weiss Section 515 \u2063authority, Carlin told Weiss to follow the process, which entailed seeking the agreement of the Biden-appointed U.S. attorneys to \u200bpartner in a prosecution of the president\u2019s son. <\/p>\n<p>The D.C. U.S.\u200b attorney later refused \u2063to partner with Weiss, sending him to California to request\u200b that\u2064 the U.S. attorney there partner on the case. However, according to Weiss, before he spoke with\u2064 the\u2063 California U.S. attorney, he spoke again with Carlin in early May, telling the associate deputy AG that D.C. had decided against joining the investigation. <\/p>\n<div class=\"fdrlst__b89e9-66816b724cafa3385d2b98d80764fb86 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-66816b724cafa3385d2b98d80764fb86\"><\/div>\n<p>\u201c[M]y recollection,\u201d Weiss continued, was \u201cthat\u2063 John Carlin at that\u2062 time said, \u2018look, if you decide to proceed in D.C., you \u200chave the authority to do so, and you have the \u2063authority under 515,\u200d to bring \u2063whatever charges you deem appropriate.\u201d <\/p>\n<p>Now, had he stuck with that story, \u2063that would have been something \u2014 because \u2063for the last\u200c half-year or so, Weiss and\u200d Attorney General Merrick Garland have been playing the ridiculous lawyers\u2019 game: <em>It depends\u200d on what the meaning of \u201chave\u201d is.<\/em> But not long after claiming Carlin told him he had \u201cthe authority under 515,\u201d Weiss changed \u2063his story again, as this \u200dexchange shows:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p><strong>House:<\/strong> Okay. \u200bYou\u2019ve said in your letters and \u2064you reiterated again today that you were \u2062assured that you would be granted 515 authority if it proved necessary. At what \u200dpoint \u2064would you need to formally go through the process to obtain Section 515 authority?<\/p>\n<p><strong>Weiss:<\/strong> I\u2062 would execute on that authority at the\u2062 time we were ready to bring the charges, to file.<\/p>\n<p><strong>House:<\/strong> Okay. And, accordingly, if you were not ready to bring charges, you would\u2062 not formally go through the process to obtain \u200d515 authority. Is that correct?<\/p>\n<p><strong>Weiss:<\/strong> That\u2019s correct.<\/p>\n<\/blockquote>\n<p>So \u200cwe are back again to where we were\u2063 before, which is \u200cthat Weiss did <em>not<\/em> have \u200bthe authority to charge Hunter Biden in D.C. or California. That directly conflicts with what Garland told Sen. Chuck Grassley, R-Iowa, during a hearing on March 1, 2023, when the head of the DOJ expressly stated \u200dthat \u201cthe U.S. attorney in Delaware\u2063 has been advised \u2064that he has full authority \u2026 to bring cases in other \u200cjurisdictions if he feels it\u2019s necessary.\u201d<\/p>\n<p>\u201cHas full\u2062 authority\u201d is clearly not the \u2064same thing as \u201cwill be given full authority\u201d or \u201chas been assured he\u200d will be given full \u2062authority.\u201d <\/p>\n<div class=\"fdrlst__b89e9-58352303183a069aecaa1568d0e87d38 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-58352303183a069aecaa1568d0e87d38\"><\/div>\n<h2 class=\"wp-block-heading\">Why the Word\u200c Games?<\/h2>\n<p>The constantly\u200d changing storylines and knots in\u200d which Weiss and Garland are willing to tie themselves rather \u2063than admit the truth \u2014 that Weiss did not have ultimate charging authority in the Hunter Biden investigation \u2014 should make Americans pause to consider why. <\/p>\n<p>Why have we been playing some six months of word games? Why \u2062are Garland and Weiss sticking \u2064with the ridiculous claim that there are no inconsistencies in their explanations, when they could merely acknowledge the situation? \u200bNamely, Weiss didn\u2019t have the authority to charge Hunter Bidden in\u200d California or D.C., but \u200bhad assurances that he would be given that authority if he asked.<\/p>\n<p>There are two reasons\u200d Weiss and Garland \u2064refuse to acknowledge the obvious. First, it\u200c would require them to concede that they misled\u200b Congress and the American public about Weiss\u2019s independence. <\/p>\n<p>For months the attorney general assured the country that politics played no role in the Hunter Biden \u2063investigation because Weiss was\u2063 a Trump-appointed U.S. attorney with ultimate authority over the case. To now admit that \u2064wasn\u2019t quite accurate would be a concession that Garland misled both Congress and the\u200b public.<\/p>\n<p>Second, if Weiss were to concede he still \u2062needed to obtain authority to \u200ccharge Hunter Biden in California,\u200d he would be confirming whistleblower Gary Shapley\u2019s\u200b version\u2064 of the meeting on \u2062Oct. 7, 2022. According to Shapley\u2019s notes, Weiss said he did not have authority to charge Hunter Biden in California but \u201che would have to request permission to bring charges in CA from the Deputy Attorney General\/Attorney General.\u201d<\/p>\n<p>And if Shapley\u2019s version of the meeting is\u2063 accurate, it\u2019s likely the rest of the obstruction to which he testified is too. No wonder Weiss and Garland continue to play ridiculous\u2062 word games.<\/p>\n<div class=\"fdrlst__b89e9-470fd3e5756d46b88e25902c3575ea57 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-470fd3e5756d46b88e25902c3575ea57\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n<p> rnrn  <\/p>\n<h2>How can\u200d the American\u200d people have confidence in the fairness and impartiality of the investigation into Hunter Biden when the authority\u200c and jurisdiction \u200dof the prosecutor are being called into question<\/h2>\n<p><span>  Find themselves\u200b tangled suggest a \u200bdeliberate attempt to obfuscate the truth. It \u2064is clear that there is a reluctance to provide a straightforward answer regarding Weiss&#8217;s authority \u2064to charge Hunter Biden in \u2064D.C. \u2063or California.<\/p>\n<p>The contradictions surrounding Weiss&#8217;s testimony raise significant questions about the integrity and transparency of the Department \u2062of Justice. If the head of the DOJ, Merrick Garland, assured Sen.\u200c Chuck Grassley that Weiss had full authority to bring cases in other jurisdictions, why is Weiss now claiming that he only had \u200dthe authority\u2064 promised to him?<\/p>\n<p>The lack of consistency and clarity in Weiss&#8217;s statements undermines the \u200dpublic&#8217;s trust in the justice \u200bsystem.
