During his \u2062first year at \u200cthe helm of the company now\u2063 known\u200c as \u201cX,\u201d Musk \u2063has\u200b taken several positive steps in line with his initial commitments \u200dto restore free speech on \u200cthe platform.<\/p>\n<p>No doubt, there\u2019s much work to do \u200b\u2014 including a much-needed elimination and rethink of Musk\u2019s \u201cfreedom of speech, not\u200b reach\u201d governing philosophy, which \u2062we\u2019ll explore below. But\u200c it\u2019s fitting to start with a few\u2064 major \u200dhighlights from Musk\u2019s first year.<\/p>\n<\/blockquote>\n<h2>Highlight 1: Exposing Government Pressure to Censor Content<\/h2>\n<p>For starters, Musk\u2019s decision to \u200crelease hundreds of thousands of emails between \u2064Twitter employees and officials in the federal \u200bgovernment via\u2062 the \u201cTwitter Files\u201d has had \u2062perhaps \u200bthe most \u2064profound effect on restoring\u200c the public\u2019s \u2062trust.<\/p>\n<p>Tabbing\u200d independent journalists like Matt Taibbi, Bari Weiss,\u2063 and Michael Shellenberger as recipients of the email trove, Musk took the gamble that by doing so, \u200bhe would expose some of the worst examples \u2062of the government\u2019s pressure\u200b on\u2062 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ga-poll-watcher-it-expert-non-trump-supporter-affidavit-sudden-surge-of-20000-mail-in-votes-for-biden-in-early-hours-on-nov\/\" title=\"GA Poll Watcher, IT Expert, Non-Trump Supporter Affidavit: Sudden Surge of 20,000 Mail-In-Votes For Biden In Early Hours On Nov\">social media companies<\/a> to censor. Musk\u2019s gamble\u200b paid \u200boff. \u200bBig time.<\/p>\n<blockquote>\n<p>Since the first round of reporting went live in \u2064early December 2022, the American public has been privy to online censorship attempts originating from the Biden administration White House, FBI, Department of Health and Human Services, the CDC, the surgeon general,\u200b the State Department\u2019s Global \u200cEngagement Center, and more.<\/p>\n<p>For years, the Biden administration\u200b has \u2062pressured Silicon\u2063 Valley companies to silence views \u2062that conflict with the government\u2019s approved talking points \u200con issues as far-ranging as climate change,\u2064 abortion, \u200deconomic policy, the \u2063sexes, and Covid-19 policy.<\/p>\n<p>In one\u200c instance leading up to the 2020\u200d presidential election, an email shows Twitter (now X) executives moving to censor speech based on\u2064 a single flag from Homeland Security. In another, an FBI official sent Twitter a \u200dlong list\u2062 of \u200cnames suspected of \u201cmisinformation\u201d\u200d \u2014 resulting in their immediate suspension.<\/p>\n<p>While troubling enough, the censorship went beyond the ill-defined category of \u201cmisinformation.\u201d\u2064 In one email chain, for \u200dexample, Facebook assures a \u2063White House official that \u2064it was also suppressing \u201coften-true content\u201d that conflicted with the government\u2019s position.<\/p>\n<\/blockquote>\n<p>Information divulged through \u200cthe \u201cTwitter Files\u201d is prominently featured\u2062 in a case, <em>Murthy v. Missouri<\/em>, now taken \u2062up by the U.S. Supreme Court. A ruling \u200bin that \u200dcase\u2064 could\u2064 protect against future\u2064 attempts by government entities \u2064to\u200b indirectly violate First Amendment freedoms by\u2062 pressuring \u200cprivate \u200ccompanies to censor in ways the government cannot.<\/p>\n<p>Even \u2064more recently, a report by the House Select Committee on the Weaponization \u2063of the Federal Government shed more light on\u2064 the\u2063 government\u2019s coordination \u2064with Twitter\u2064 and other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/facebook-bans-gop-account-allows-inflammatory-dnc-ads\/\" title=\"Facebook bans GOP account, allows inflammatory DNC ads\">social media giants<\/a> to censor the\u2064 speech of conservatives, including The \u2062Federalist\u2019s Mollie \u2064Hemingway and Sean Davis.<\/p>\n<h2>Highlight 2: Dissolving the Orwellian \u2018Trust and \u2063Safety Council\u2019<\/h2>\n<p>While accompanied \u200bby considerably less fanfare\u200d than the \u201cTwitter Files,\u201d Musk\u2019s dissolving of the company\u2019s so-called\u200c \u201cTrust and Safety Council\u201d \u200din mid-December also marked a crucial step toward restoring free speech on the platform.<\/p>\n<p>Introduced in \u20632016,\u200b the council was the company\u2019s purported attempt to \u201cstrike the right\u2064 balance between fighting\u2064 abuse and speaking \u200dtruth to power.\u201d In\u2062 reality, the group comprised around 100 \u2062organizations that over the years included highly \u200dpartisan\u200c groups like the highly discredited Southern Poverty Law Center, \u2064GLAAD,\u2062 and \u2064the\u200c Anti-Defamation League, and\u2062 it \u2064wielded\u200b unchecked authority to throttle accounts and\u200b tweets \u2014 which it regularly used to silence political opponents.<\/p>\n<p>As\u200d Taibbi \u2062reported, company employees, including the council\u2019s head,\u200c Yoel Roth, were acting in lock-step with \u200cfederal agencies \u200bincluding the \u2063FBI,\u200d Department of Homeland\u200d Security, and Department\u2062 of National Intelligence.<\/p>\n<p>Simply by pulling\u200c the plug on the \u200ccouncil, Musk made significant progress in distancing\u200d his company from its \u2063well-earned reputation as a venue policed by far-left ideologues.<\/p>\n<h2>Highlight 3: Rolling Back \u2063\u2018Misgendering\u2019 Policy<\/h2>\n<p>Pre-Elon\u2064 gatekeepers posed a big enough impediment to free speech. \u2062Yet at the heart of the\u200b platform\u2019s censorship\u2062 woes is a\u200c raft of problematic policies meant to enforce far-left\u200c orthodoxy on \u2062a \u200bhost of \u200bconsequential issues.<\/p>\n<p>Perhaps\u2062 best-known (and most \u200cfrequently weaponized) among these policies has been the so-called \u201cmisgendering\u201d policy, which\u2064 punished account holders who refused to toe the line on gender ideology \u2014 especially when referring to well-known public \u2062figures who identify as\u2063 the opposite sex. Implemented in\u200d 2018, the\u2064 policy was used to censor and suspend insufficiently compliant accounts such as the Babylon Bee,\u2064 which\u2064 satirically tabbed federal official Rachel Levine as its \u201cMan of the Year\u201d in March of 2022.<\/p>\n<p>The Bee\u2019s suspension seems to have been\u2062 the last straw for Musk. Already the majority\u200c shareholder at the time, since-revealed private messages involving Musk suggest that the incident motivated him in \u200clarge part to make an offer to buy the company less than a\u200c month later.<\/p>\n<p>Musk \u2063leveraged his\u200b authority\u2062 in \u200dNovember 2022 to lift the Bee\u2019s\u200c suspension, before eliminating \u200bthe \u201cmisgendering\u201d policy\u2063 in\u200c April 2023, restoring the ability of users to weigh in on\u200b perhaps the \u2062liveliest issue in today\u2019s public discourse.<\/p>\n<h2>Highlight 4: Canceling Ideological Cancelations<\/h2>\n<p>The Bee was just one of countless accounts restored by Musk during his first year. Just a \u2062month into his tenure, Musk indicated in a series of tweets \u200dthe imminent \u200dreinstatement of\u200c accounts closed under\u2064 the previous regime \u2014 with the exception of accounts that had \u201cbroken the law or engaged in egregious spam.\u201d<\/p>\n<p>Previously canceled \u2062accounts included elected Republicans in \u2062the\u200c federal government, along with conservatives such as Jordan \u200cB. Peterson. And \u200cwhile restoring\u2062 those\u2063 accounts would have been a \u200cvictory for free speech in and of itself, Musk has gone much further.\u200b Reacting this \u2064June to employees\u2019 attempt to cancel \u200bthe Daily Wire\u2019s streaming of \u201cWhat is a Woman?\u201d Musk not only allowed the documentary to go live \u200don\u200b the platform, but he shared it with his millions of followers \u2063along\u2062 with the \u2062message, \u201cEvery parent should watch this.\u201d<\/p>\n<p>Musk\u2019s decision to override his employees\u2019 censorious instincts has helped ferret out\u200b Silicon Valley silencers at the company.\u200d It \u2064also built trust\u2064 among free-speech advocates who had been \u2064skeptical of\u200c Musk after his initial jailbreak failed to reinstate \u2064accounts like Federalist Senior Editor John Daniel Davidson\u2019s \u2014\u2064 whose account had remained blocked until late \u200bMarch.<\/p>\n<p>More recently, Musk promised\u2062 to fund legal support to those\u2062 who face discrimination\u2062 by employers for posts on X. That\u2019s a hefty promise, but Musk\u2019s track record suggests it\u2019s one he likely intends to keep.<\/p>\n<h2>Opportunity \u20641: Expanding the Offer to Cover Cancellation Expenses<\/h2>\n<p>To mark the first anniversary\u200d of Musk\u2019s purchase, my colleagues at ADF International spearheaded an open letter inviting Musk\u2063 to consider \u2064covering\u2062 the \u200ccosts of X users targeted by government\u200d entities\u2064 for their posts on the platform.<\/p>\n<p>Signed by a \u2062long list that includes\u200b Babylon Bee CEO\u2063 Seth\u2062 Dillon, Rod Dreher, \u2064R.R. Reno, journalist Andy Ngo, and former ambassador \u2063for religious \u200cfreedom Sam\u2062 Brownback, the letter calls attention to an \u200balarming international trend where governments are punishing X users for\u200c their speech on the platform.<\/p>\n<p>Most prominent on that list \u2014 if for no other reason than the\u2063 lengthy nature of her state-imposed ordeal \u2014 is longstanding \u2062Finnish parliamentarian and grandmother P\u00e4ivi R\u00e4s\u00e4nen, who is awaiting a verdict from\u200b a Helsinki\u2064 court after being criminally charged for \u2062a 2019 \u2063post that included a Bible \u2064verse responding to her\u2062 church\u2019s sponsorship of an LGBT pride event.<\/p>\n<p>P\u00e4ivi\u2019s situation is paralleled in Mexico,\u2064 where two public figures, Rodrigo Iv\u00e1n\u2063 Cort\u00e9s and Gabriel Quadri, \u2064have been\u200b convicted of \u201cgender-based political violence\u201d and placed on an offenders\u2019 register for Twitter posts expressing\u2062 their views on the \u2063sexes. Both have been ordered to\u2064 publish a court-written apology on X\u200d every day for\u2064 30 days, three \u2064times a \u2062day, in what the open \u2064letter labels \u201ca form \u200bof\u200b public humiliation.\u201d<\/p>\n<p>While these cases proceed through their respective court \u200csystems, European\u200d Union\u200c lawmakers are pushing to make \u200d\u201chate\u2063 speech\u201d a crime on the same legal level as human trafficking and terrorism.<\/p>\n<p>The letter\u200d sums \u2062it up well: \u201cIf X is to be a free marketplace of ideas, everyone \u2063must be able to peacefully debate the issues of our time without fear of government punishment.\u201d<\/p>\n<h2>Opportunity 2: Clarifying Content Moderation Policies<\/h2>\n<p>As I wrote when \u2062Musk \u200bfirst made his bid to purchase \u2062the platform, \u2062X\u2019s unclear terms of use set the table for the \u2064very censorship he seemingly opposes. Musk\u2019s elimination of \u2064the \u201cmisgendering\u201d policy\u2062 was a \u2062major move toward free speech, and it should serve as his blueprint forward as he continues his efforts to \u200dmake X a \u200blegitimate free-speech platform.<\/p>\n<p>In particular, Musk should \u2064eliminate X\u2019s \u201chateful \u200dconduct\u201d\u2062 policy, which still permits\u200b employees to censor\u200b political and\u2063 religious views they disagree with in the same way as the now defunct \u201cmisgendering\u201d policy did. Under cover of this policy in March 2023, X employees \u2062temporarily \u2064locked \u200dout the aforementioned Davis for reporting on the so-called \u201cTrans Day \u200dof\u2063 Vengeance\u201d\u200c that was planned \u2064to take place just days after the deadly shooting by a trans-identified assailant at Covenant Christian School \u2064in Nashville.<\/p>\n<p>To Musk\u2019s credit, his\u2064 company reinstated Davis\u2019 account,\u200b at which point the platform also lifted Davidson\u2019s \u200cyear-long suspension.<\/p>\n<p>Finally, while a marked improvement on the\u2062 prior\u2064 policies, X\u2019s \u201cFreedom\u2063 of Speech, Not Reach\u201d enforcement philosophy still allows for viewpoint-based censorship. Publicly \u200bintroduced by Musk in\u2063 November \u20642022, the policy adds the step of notifying\u200d users when their posts are throttled or censored. As Musk explains in his tweet, \u201c[n]egative\/hate tweets will be \u2062max \u200cdeboosted \u200d&#038;\u2064 demonetized, so no ads or other revenue to Twitter. You won\u2019t find the tweet unless you specifically seek it out, which is no different from rest of Internet.\u201d<\/p>\n<p>There\u2019s a\u2064 word for this:\u200b \u201cshadowbanning.\u201d The \u2062ability to speak but not be heard\u200b is self-defeating, and that\u2019s \u200cone primary censorship\u200d tactic Twitter deployed against conservative\u2062 voices in the years leading \u2064up to Musk\u2019s \u200bpurchase. Even Musk\u2019s \u200ctweet announcing the policy gives \u2063the game away. \u200cRelying \u2063on the unspecified terminology of \u201chate\u201d \u2014 and even \u201cnegative\u201d \u2014 lends itself to the very same censorship philosophy that has long plagued the company.<\/p>\n<p>A true genius, Musk possesses a remarkable\u2063 ability to reconsider his positions and adjust his thinking. Further, Musk\u2019s actions in the year since he sent that tweet show an upward trajectory \u2063in his embrace of robust discourse free from ideological\u200c throttling. Now\u2063 is the time to ditch these wrongheaded \u2064policies for good.<\/p>\n<div class=\"fdrlst__b89e9-bb8b858f905b0d054fc1a276e0632250 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-bb8b858f905b0d054fc1a276e0632250\"><\/div>\n<hr class=\"wp-block-separator\">\n<\/div>\n<p> <\/p>\n<h2> What\u200b challenges does Musk\u200b face in striking a\u2062 balance between freedom of speech and\u2063 curbing the reach and\u2064 impact of misinformation on the platform<\/h2>\n<p><span>  \u200dArized by political bias\u2062 and censorship. This move signaled a departure from the company&#8217;s \u200cprevious stance\u200b and represented a commitment to upholding \u2062the principles of\u2062 free speech and open\u200d dialogue.<\/p>\n<h2>Highlight 3: Implementing Transparent Content Moderation Policies<\/h2>\n<p>Recognizing the need\u2062 for more transparency and consistent guidelines, Musk introduced a \u200bseries of reforms to the platform&#8217;s \u200bcontent moderation policies. These reforms aimed \u2063to address concerns\u200d about arbitrary \u2063and biased decision-making, as well\u200b as the lack of clarity in the process.<\/p>\n<p>One significant change\u2063 was the establishment of \u200can independent \u2064oversight board. \u2062This\u2064 board, consisting of individuals with \u200cdiverse backgrounds and perspectives, is responsible for reviewing content moderation decisions and ensuring that they align with the\u200c platform&#8217;s stated policies \u200band principles. The recent surge in misinformation, particularly regarding the COVID-19 \u2064pandemic, has highlighted the \u2064need for platforms \u2063to\u200c take\u2062 more responsibility in \u200dmitigating the spread of harmful \u2063content.<\/p>\n<p>Musk should consider striking a\u2064 balance between freedom\u200d of speech and the \u200cplatform&#8217;s\u2064 responsibility to\u2064 curb the reach and impact of misinformation. This may involve \u2063developing more proactive measures to fact-check and label misleading \u2064content, as well as exploring ways to promote accurate and reliable information.<\/p>\n<p>Furthermore, Musk \u2064should continue \u2063to engage in dialogue with stakeholders, \u2064including users, experts, and\u200b policymakers,\u2064 to ensure that the platform&#8217;s content\u2064 moderation policies align with societal\u200b expectations and evolving norms.<\/p>\n<h2>Conclusion<\/h2>\n<p>In his \u200cfirst year as\u2062 the leader of the world&#8217;s most influential social media\u200d platform, Elon\u200b Musk has taken significant steps towards restoring free speech and promoting transparency.
