The situation, he said, was &#8220;complex.&#8221;<\/p>\n<p>&#8220;We at the Schell Center are \u2064trying very hard and earnestly to do what is \u2026 in some calculation, best for our responsibilities and our community,&#8221; Silk wrote. &#8220;That \u2062is more \u2064complex than people hurt so directly by last week&#8217;s atrocities in Israel might feel.&#8221;<\/p>\n<p>The need to appreciate\u200b the complexity of human rights\u200d atrocities\u2014and the idea \u200dthat those experiencing them secondhand can\u2019t see the larger picture\u2014seems \u2064to be a recent development. Last year, the Schell Center sponsored an <a href=\"https:\/\/law.yale.edu\/yls-today\/yale-law-school-events\/omar-shakir-human-rights-advocacy-israelpalestine-apartheid\" target=\"_blank\" rel=\"noopener\">event<\/a> on Israeli &#8220;apartheid&#8221; with Omar Shakir, a pro-Palestinian activist, as its \u200csole speaker. &#8220;There is consensus today in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/yale-law-students-for-hamas\/\" title=\"Yale Law Students for Hamas\">global human rights movement<\/a>, spanning the major Israeli, Palestinian and international organizations, that Israeli authorities are committing the crime against humanity of apartheid against millions of Palestinians,&#8221; materials advertising the event read.<\/p>\n<p>In fact, the relationship between Israel and the \u200bWest \u200bBank is considerably more &#8220;complex&#8221; than \u2063the Oct. 7 massacre, which has been condemned as\u2062 a war crime by \u200ball major human rights groups, <a href=\"https:\/\/www.hrw.org\/news\/2023\/10\/09\/israel\/palestine-devastating-civilian-toll-parties-flout-legal-obligations\" target=\"_blank\" rel=\"noopener\">including \u200bthose critical of Israel<\/a>. The Schell Center\u2019s willingness \u200bto address one issue but not the \u2062other \u200brankled some Jewish students, who slammed the double \u2063standard in an \u200d <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2023\/11\/Open-Letter-to-YLS-alumni.pdf\" target=\"_blank\" rel=\"noopener\">open letter<\/a> to alumni of Yale Law School.<\/p>\n<p>&#8220;What kind of \u2018Center for International Human\u200b Rights\u2019 would \u2062refuse to host an event condemning the largest pogrom since the Holocaust,&#8221; the students wrote on Oct. 20. &#8220;Does \u200dthe Schell Center not think that Israelis are entitled to human rights, too? Or is it perhaps because they were Jewish?&#8221;<\/p>\n<p>Only on Nov. 1\u2014more than three weeks after the pogrom and after Yale alumni began circulating a <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2023\/11\/Joint20Letter20to20Yale20Law20School.pdf.pdf\" target=\"_blank\" rel=\"noopener\">petition<\/a> that excoriated the law school\u2019s handling of anti-Semitism\u2014did the\u200c Schell Center reverse course and agree to sponsor programming about the attacks, according to two people with knowledge of the situation. It is not clear what form that \u2063programming will take or \u200dwhat \u2063experts it will feature, but Yale Law School chief of staff Debra Kroszner\u200b confirmed that an event was \u2063in the works.<\/p>\n<p>Silk did not respond to a request for comment.<\/p>\n<p>The quiescence goes beyond the Schell \u2064Center. Aside from a brief statement <a href=\"https:\/\/law.yale.edu\/yls-today\/news\/maintaining-our-community\" target=\"_blank\" rel=\"noopener\">condemning<\/a> Hamas\u2014which\u2063 did not include the words &#8220;anti-Semitism&#8221; or &#8220;Jewish&#8221;\u2014Yale Law School dean Heather Gerken has said nothing \u200cpublicly about\u200c the massacre. Nor has she addressed the torrent of terror apologia it elicited from the law school\u2019s own students, who \u200chave been much \u200bless equivocal than their mealy-mouthed leaders.<\/p>\n<p>Some students have blamed Israel for the attacks and singled out\u2064 their Jewish peers for ridicule on a student-wide listserv, according \u200bto posts reviewed by the <em>Free \u200bBeacon<\/em> and <em>The\u200c Free Press<\/em>. Others have endorsed terrorism while denying that Hamas or Hezbollah qualify as terror groups. And \u200dstill others promoted a rally\u2014held two days after the massacre\u2014that \u200bcelebrated &#8220;Palestinian resistance&#8221; to &#8220;colonial\u200b oppression.&#8221;<\/p>\n<p>&#8220;Breaking out of a prison,&#8221; \u200cposters for the\u2063 rally declared, &#8220;requires force.&#8221;<\/p>\n<p>The militancy has shocked\u200d Jewish alumni of Yale Law School, who say that the bloodthirsty rhetoric\u2014and the reluctance \u2063of administrators to address it\u2014indicate a festering moral rot.<\/p>\n<p>&#8220;They have legitimized\u2064 and provided a platform to students supporting violence against Jews and Israel\u2019s\u2062 destruction,&#8221; said Emily \u200cShire, a 2020 alumna of the law school. &#8220;Yale Law \u2063cannot sit idly by as some students\u200c openly endorse the\u200d worst \u200batrocity against Jews since the Holocaust.&#8221;<\/p>\n<p>Shlomo Klapper, a 2020 alumnus, argued that the school\u2019s passivity was not just a moral mistake but a \u200dpedagogical one. &#8220;Under no theory of law is killing innocents in the name of decolonization justified,&#8221; Klapper said. &#8220;It\u2019s a war crime. To have students\u2062 openly celebrate\u200d that and not to have the school correct that\u200c is a huge educational failure.&#8221;<\/p>\n<p>The Hamas-splaining began on Oct. 9 when Yale\u2019s chapter of the National Lawyers Guild, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/soros-doubles-funding-to-left-wing-legal-group-working-to-upend-supreme-court\/\" title=\"Soros doubles funding for Left-Wing Legal Group To Overthrow the Supreme Court\">left-wing legal group<\/a>, endorsed a <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2023\/11\/Gmail-Fwd_-NLG-Stands-In-Solidarity-With-Palestine.pdf\" target=\"_blank\" rel=\"noopener\">statement<\/a> affirming \u2064the right of Palestinians to resist &#8220;occupation by all available means.&#8221;\u200b The statement, which was\u2063 sent to the student-wide listserv by first-year law student \u2063Chisato Kimura, didn\u2019t just call for &#8220;armed struggle&#8221; against the &#8220;Settler Colonial State of Israel.&#8221; It said \u2064that Hamas should be delisted \u200bas a terrorist group.<\/p>\n<p>&#8220;We call for all Palestinian \u200cand Lebanese resistance organizations to be removed from the U.S. list of \u2018Foreign Terrorist Organizations\u2019\u200d and \u2018Specially Designated Global Terrorists,\u2019&#8221; the statement read. &#8220;These lists allow for the persecution, criminalization and economic coercion of people resisting apartheid, genocide and colonialism.&#8221;<\/p>\n<p>A student familiar with the guild\u2019s decision-making process said \u2062that its 15 members agreed to endorse the statement by a nearly unanimous vote, with \u2064just one member indicating opposition. Kimura, a\u200d <a href=\"https:\/\/law.yale.edu\/studying-law-yale\/alumni-student-profiles\/chisato-kimura-25\" target=\"_blank\" rel=\"noopener\">participant in the Schell Center\u2019s human \u200brights clinic<\/a>, is attending Yale on a full ride and says \u200bshe\u200b is &#8220;interested in becoming a human rights law professor.&#8221; Her \u200bscholarship, the Hurst Horizon program, is endowed\u2063 by philanthropist Robert Hurst, \u200ca former board chairman of the Jewish Museum in New \u2063York City, who did not respond to a request for comment.<\/p>\n<p>Kimura later issued a half-hearted non-apology and claimed that the statement had been misconstrued. The guild &#8220;is not,\u200c and I am not\u2063 condoning war crimes,&#8221; \u2062she wrote to the listserv on \u2062Oct. 10. &#8220;The opposite.&#8221; \u2062However, she\u2064 continued, Hamas\u2019s attacks were &#8220;a direct result\u200d of Israel\u2019s apartheid regime.&#8221;<\/p>\n<p>In the \u200bsame vein, Iesha Phillips, the lead editor of the <em>Yale Journal of Law &#038; Liberation<\/em>, <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2023\/11\/Gmail-Fwd_-Thewindow-Breaking-The-Sound-of-Silence.pdf\" target=\"_blank\" rel=\"noopener\">wrote<\/a> to the listserv on Oct. 9 that &#8220;expecting Palestinians to peacefully respond to \u2064unspeakable war crimes and \u2062illegal collective punishment they\u2019ve experienced at the hands of Israel is laughable.&#8221;<\/p>\n<p>&#8220;Too many lives have been lost over the\u200c past\u2063 few decades,&#8221; she added. &#8220;We shouldn&#8217;t only start\u2063 to care because it&#8217;s now affecting\u200b Jewish folks.&#8221;<\/p>\n<p>Phillips\u200d and Kimura did not respond to requests for\u2063 comment.<\/p>\n<p>Yale Law School has long been a breeding ground for influential policymakers, from former \u2063secretary of state Hillary Clinton\u200c to Biden national security adviser Jake Sullivan. Six sitting senators are also alumni.<\/p>\n<p>It\u2019s far from the only \u200belite incubator with a blind spot around Jews. A member\u2062 of the Harvard Law Review and others were captured on video\u2014<a href=\"https:\/\/freebeacon.com\/campus\/israeli-harvard-business-school-student-accosted-and-harassed-amid-gaza-die-in-on-campus\/\" target=\"_blank\" rel=\"noopener\">published over two weeks ago\u2064 by the <em>Free Beacon<\/em><\/a>\u2014accosting an Israeli Harvard Business School student. Harvard has yet to address the incident beyond a <a href=\"https:\/\/www.hbs.edu\/about\/leadership\/statements-and-speeches\/Pages\/our-values.aspx\" target=\"_blank\" rel=\"noopener\">statement<\/a> \u200b from Srikant Datar, the dean of the business school,\u2063 lamenting both &#8220;Islamophobia&#8221; and anti-Semitism. It \u200ddid, however, <a href=\"https:\/\/www.thecrimson.com\/article\/2023\/10\/25\/doxxing-task-force\/\" target=\"_blank\" rel=\"noopener\">create a taskforce<\/a> \u200d for the &#8220;doxxed students&#8221; who signed an <a href=\"https:\/\/www.thecrimson.com\/article\/2023\/10\/10\/psc-statement-backlash\/\" target=\"_blank\" rel=\"noopener\">open letter<\/a> blaming Israel for Hamas\u2019s atrocities.<\/p>\n<p>What kind of message, exactly, are these schools sending to\u200d future leaders, who have for weeks \u200cnow watched \u200dtheir classmates cheer terrorists and jeer Jews with no administrative pushback? Yale Law School\u2019s budding attorneys aced the LSAT, sure, but they were also\u200c admitted because they can read rooms and climb greasy\u200c poles.<\/p>\n<p>When, in so many other instances, every microaggression is policed, every alleged trauma met with concern, and every act of horror denounced with an official statement, what other \u200clesson \u200bwill they\u200c draw \u2064from the past month than that Jews matter less than other groups?<\/p>\n<p>&#8220;I\u2063 think some Jewish students feel deeply uncomfortable being at the \u200blaw\u2062 school right now,\u2062 knowing that their peers would likely condone \u2063and \u200dmaybe\u2063 even celebrate their \u200dmurder \u200cby terrorists,&#8221; said one Jewish law student,\u2063 who, like almost every other student interviewed for this story, requested anonymity. &#8220;And the law school\u2019s silence\u2014when it is so often quick to jump to a\u200b moment of moral clarity\u2014suggests that there \u200dis\u2063 something wrong with Yale\u200c Law School.&#8221;<\/p>\n<p>Consider the following parallel.<\/p>\n<p>When Yale Law student Trent\u2063 Colbert <a href=\"https:\/\/freebeacon.com\/campus\/a-yale-law-student-sent-a-lighthearted-email-inviting-classmates-to-his-trap-house-the-school-is-now-calling-him-to-account\/\" target=\"_blank\" rel=\"noopener\">invited classmates<\/a> to his \u2063&#8221;traphouse,&#8221; a term some claimed had racist associations with crack houses, in\u2063 2021, it\u200d took exactly 12 hours for\u200d administrators to process nine discrimination complaints, haul Colbert in\u200c for a meeting, and suggest his career was on the line if he didn\u2019t sign an apology they penned on his\u200d behalf. Gerken, the law\u2062 school\u2019s dean, also authorized a schoolwide message condemning Colbert\u2019s language.<\/p>\n<p>But when Jewish students appealed to Gerken almost two weeks after the Hamas attacks, describing the anti-Semitic vitriol in their inboxes, they got a rote reply \u2063from her deputy, Debra Kroszner, who directed them to student support services.<\/p>\n<p>&#8220;Dean Gerken \u200bwanted to ensure that you are\u200b connected with any support you might need in [the Office of Student Affairs],&#8221; Kroszner wrote. &#8220;I understand these are\u200c deeply challenging times and we appreciate\u200b you reaching out to share your concerns.&#8221;<\/p>\n<p>Another student said he received\u200b an almost identical note from Gerken herself.<\/p>\n<p>Kroszner told the <em>Free Beacon<\/em> and <em>The \u200bFree Press<\/em> that the law school had policies in place to &#8220;address complaints made \u2063by\u2062 members of this community&#8221; and that it did not tolerate &#8220;harassment \u2063or discrimination.&#8221;<\/p>\n<p>Alumni \u2063aren\u2019t taking Yale\u2019s word for it. Last Friday \u200dover\u2062 100 of them sent a <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2023\/11\/Joint20Letter20to20Yale20Law20School.pdf.pdf\" target=\"_blank\" rel=\"noopener\">petition<\/a> to Gerken that\u2064 asks Yale to report &#8220;student endorsements of terrorism to state bar committees on\u200c character and fitness,&#8221; \u2063and calls on the\u200b school to adopt a &#8220;zero-tolerance \u2063policy\u2063 toward \u2064antisemitic threats or harassment,&#8221; including\u200d toward \u2062students who express support for Israel.<\/p>\n<p>&#8220;The failure\u200b to make these and other \u2064changes swiftly\u2064 and substantially would \u2062be a betrayal of the law school\u2019s history and values, as well as of the\u200b Jewish community,&#8221; the petition says. &#8220;This climate\u2014and what the administration does or does not do\u2014will undoubtedly cause many alumni, of all religions and political views, to think hard about their continuing connection to Yale Law School.&#8221;<\/p>\n<p>Jewish law students say the silence\u2062 has been &#8220;crushing.&#8221;<\/p>\n<p>&#8220;The silence in the law\u2063 school from all \u2062those who \u200dproclaim the mantle of justice, human rights, and rule of law is deafening,&#8221; one student wrote to the listserv. &#8220;For a school filled with self-assured outrage at evils across\u2064 the globe, the absence of any response is\u200d crushing.&#8221;<\/p>\n<p>Jewish undergraduates, meanwhile, who have had their newspaper columns <a href=\"https:\/\/freebeacon.com\/campus\/i-said-hamas-raped-women-and-beheaded-men-the-yale-daily-news-issued-a-correction\/\" target=\"_blank\" rel=\"noopener\">stealth edited<\/a> to remove \u2064references to Hamas\u2019s atrocities, were <a href=\"https:\/\/www.wsj.com\/articles\/jewish-students-meet-hostility-at-yale-israel-hamas-violence-terrorism-anti-semitism-1d6f81da?mod=opinion_lead_pos10\" target=\"_blank\" rel=\"noopener\">locked out of an anti-Israel event<\/a> this week sponsored by several Yale academic \u2063departments, in which panelists declared that \u200cIsrael &#8220;cannot remain the state\u2064 of the Jewish people.&#8221; The students sent an email Wednesday morning demanding a meeting with Yale president Peter Salovey.<\/p>\n<p>At a <a href=\"https:\/\/www.youtube.com\/watch?bbeml=tp-SWlkD4IO3kGxmA7UddoBhw.jK6_q7VlpyEuTLhAJzW4vHg.rhQvMHl62-0uY8kT23Aw0VA.l6JxJMHn4YEmJruIJF7dazg&#038;v=QDo-rE59hbo&#038;feature=youtu.be\" target=\"_blank\" rel=\"noopener\">town hall \u200bmeeting<\/a> \u2064last week, Jason \u200dRubenstein, a rabbi \u200din the Yale Chaplain\u2019s Office, said the campus environment\u200c has never been worse for\u200b Jews.<\/p>\n<p>&#8220;It\u2019s a darker scene than we\u2019ve ever inhabited in my past five years at Yale,&#8221; he said.<\/p>\n<p> <\/p>\n<h2> \u2064 Why did James Silk hesitate to address the recent massacre conducted\u200d by Hamas?<\/h2>\n<p><span>  October 13, when an\u200c Israeli law \u2063student reached out to James Silk, a Yale \u2064Law\u200c School professor and \u2064co-director\u2062 of \u200bthe Schell Center, urging him to\u200d speak out against the recent\u2063 massacre and kidnapping conducted \u200cby Hamas. The student implored Silk to be a leader for human rights and not stay silent in the face of genocide. In response, Silk claimed \u2062that the situation was complex and the center was \u200bstill deciding whether to address the massacre.<\/p>\n<p>The delayed response and hesitation \u200cfrom\u2062 the Schell Center to condemn the massacre have raised concerns among Jewish students and alumni. They question \u2062the center&#8217;s commitment\u2064 to human\u2064 rights and \u2063whether Israelis are\u200d entitled to\u2063 the same human rights as others.
