The situation, he said, was &#8220;complex.&#8221;<\/p>\n<p>&#8220;We at the Schell Center\u200b are trying very hard and earnestly to do \u2064what is \u2026 in some calculation,\u200c best for\u2062 our responsibilities and our \u2062community,&#8221; Silk\u200d wrote. &#8220;That is \u200dmore\u200d complex\u200c than \u200bpeople hurt so directly by last week&#8217;s atrocities in Israel \u2063might feel.&#8221;<\/p>\n<p>The need to appreciate the complexity\u200d of human \u200brights atrocities\u2014and the idea \u200bthat those\u2063 experiencing them secondhand can\u2019t see the larger picture\u2014seems to be a recent development. Last year, the Schell Center sponsored\u200d an <a href=\"https:\/\/law.yale.edu\/yls-today\/yale-law-school-events\/omar-shakir-human-rights-advocacy-israelpalestine-apartheid\" target=\"_blank\" rel=\"noopener\">event<\/a> on Israeli &#8220;apartheid&#8221; with Omar Shakir, a pro-Palestinian activist, as its sole speaker. &#8220;There is consensus today in the global human \u2064rights\u2063 movement, spanning the major Israeli, Palestinian and international organizations, \u200cthat Israeli authorities \u2063are committing the crime against humanity of apartheid against millions of Palestinians,&#8221;\u200b materials advertising\u2063 the event read.<\/p>\n<p>In fact, the\u200c relationship between Israel and the West Bank is considerably\u2063 more &#8220;complex&#8221; than the Oct. 7 massacre, which has been condemned as a war crime by all major\u2063 human rights groups, <a href=\"https:\/\/www.hrw.org\/news\/2023\/10\/09\/israel\/palestine-devastating-civilian-toll-parties-flout-legal-obligations\" target=\"_blank\" rel=\"noopener\">including those critical of Israel<\/a>. The Schell Center\u2019s\u2064 willingness to address one issue but not the other rankled some \u2062Jewish students, who slammed the double standard\u2064 in an <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2023\/11\/Open-Letter-to-YLS-alumni.pdf\" target=\"_blank\" rel=\"noopener\">open letter<\/a> to alumni of Yale Law School.<\/p>\n<p>&#8220;What kind of \u2018Center for\u200b International Human Rights\u2019 would refuse to host \u200dan event condemning the\u200d largest\u200d pogrom since the Holocaust,&#8221; the\u2064 students wrote on Oct. 20. &#8220;Does\u200b the Schell Center not think that\u2064 Israelis are \u2062entitled \u2064to human rights, too? Or is \u200cit perhaps because they were Jewish?&#8221;<\/p>\n<p>Only on Nov. 1\u2014more than three weeks after the pogrom and\u200b after Yale alumni began circulating a <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2023\/11\/Joint20Letter20to20Yale20Law20School.pdf.pdf\" target=\"_blank\" rel=\"noopener\">petition<\/a> \u2062that excoriated the law school\u2019s handling of anti-Semitism\u2014did\u2062 the Schell Center reverse course and agree to sponsor programming\u200b about the\u2063 attacks,\u200c according to two people with knowledge of\u2063 the\u2063 situation. It \u2064is\u200d not \u200dclear what form that programming will take or\u200c what experts it will feature, but Yale Law School\u200b chief of staff \u200cDebra Kroszner confirmed that an event\u200d was in the works.<\/p>\n<p>Silk did not respond to a\u200d request for comment.<\/p>\n<p>The quiescence goes beyond the \u2064Schell Center. Aside from a brief statement \u2063 <a href=\"https:\/\/law.yale.edu\/yls-today\/news\/maintaining-our-community\" target=\"_blank\" rel=\"noopener\">condemning<\/a> Hamas\u2014which did not include the words &#8220;anti-Semitism&#8221; or &#8220;Jewish&#8221;\u2014Yale \u2064Law School dean Heather \u200dGerken has said nothing publicly about the massacre. Nor has she addressed the \u2064torrent\u200b of terror apologia it elicited from the law school\u2019s own students, who have been much less equivocal than their mealy-mouthed leaders.<\/p>\n<p>Some students\u200d have blamed Israel for the attacks\u2062 and singled out their Jewish peers for\u200d ridicule on a student-wide listserv,\u2063 according to posts reviewed by the <em>Free Beacon<\/em> and <em>The\u2062 Free Press<\/em>. Others have endorsed terrorism while denying\u200d that Hamas or Hezbollah\u2064 qualify \u2064as \u2063terror groups.\u2064 And still\u2063 others promoted a rally\u2014held two days after the massacre\u2014that celebrated &#8220;Palestinian resistance&#8221; to &#8220;colonial \u200doppression.&#8221;<\/p>\n<p>&#8220;Breaking out \u2063of a prison,&#8221; posters for the rally\u2063 declared, &#8220;requires force.&#8221;<\/p>\n<p>The militancy has shocked Jewish alumni of Yale Law School, who say that the bloodthirsty rhetoric\u2014and the\u2064 reluctance of administrators to address it\u2014indicate a festering moral rot.<\/p>\n<p>&#8220;They have legitimized \u2064and provided a platform to students supporting \u200cviolence against Jews and Israel\u2019s destruction,&#8221; said Emily Shire, \u2062a 2020 alumna of the law school. &#8220;Yale Law cannot sit idly by as some\u200d students openly\u200b endorse the\u200b worst atrocity against Jews since the \u200dHolocaust.&#8221;<\/p>\n<p>Shlomo Klapper, a 2020 alumnus, argued that the school\u2019s passivity was not just a moral mistake \u2064but a pedagogical\u2062 one. &#8220;Under no theory of law is killing \u200cinnocents in the name of decolonization justified,&#8221; \u2062Klapper said. &#8220;It\u2019s a war \u2064crime. To have students openly celebrate that and not to have the school \u2062correct \u200bthat is \u2062a huge educational\u200b failure.&#8221;<\/p>\n<p>The Hamas-splaining began on Oct. 9 when \u200cYale\u2019s chapter of the National Lawyers Guild, a \u2062<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/soros-doubles-funding-to-left-wing-legal-group-working-to-upend-supreme-court\/\" title=\"Soros doubles funding for Left-Wing Legal Group To Overthrow the Supreme Court\">left-wing legal group<\/a>, endorsed a <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2023\/11\/Gmail-Fwd_-NLG-Stands-In-Solidarity-With-Palestine.pdf\" target=\"_blank\" rel=\"noopener\">statement<\/a> affirming the right of Palestinians\u2064 to resist &#8220;occupation by\u200c all\u200c available means.&#8221; \u2063The statement, \u200bwhich was sent to the student-wide listserv by\u2064 first-year law student Chisato Kimura, didn\u2019t just call for &#8220;armed struggle&#8221; against the \u200b&#8221;Settler Colonial State \u2063of\u200c Israel.&#8221; It said that\u2063 Hamas should be delisted as a terrorist group.<\/p>\n<p>&#8220;We call\u2063 for all Palestinian and Lebanese resistance \u2064organizations to be removed\u2064 from the U.S. list of \u2018Foreign Terrorist Organizations\u2019 and \u2018Specially Designated Global Terrorists,\u2019&#8221; the statement \u2063read. &#8220;These lists \u200callow\u2064 for the persecution,\u200c criminalization and economic coercion of people resisting apartheid, genocide and colonialism.&#8221;<\/p>\n<p>A student familiar with the guild\u2019s \u2062<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/listen-elon-musk-presses-robinhood-ceo-about-gamestop-fiasco-restricted-trading\/\" title=\"LISTEN: Elon Musk Presses Robinhood CEO About GameStop Fiasco, Restricted Trading\">decision-making process<\/a> said that its 15\u200b members agreed to endorse the statement by a nearly unanimous vote, with just one member indicating opposition. Kimura, a <a href=\"https:\/\/law.yale.edu\/studying-law-yale\/alumni-student-profiles\/chisato-kimura-25\" target=\"_blank\" rel=\"noopener\">participant in the Schell Center\u2019s human rights clinic<\/a>, is attending Yale on a full ride and says she is\u200b &#8220;interested in becoming a human rights law professor.&#8221; Her scholarship, the\u2062 Hurst Horizon program, is endowed by philanthropist Robert Hurst,\u200d a former board chairman of the Jewish\u200b Museum in New York City, who did not respond to \u2062a request for comment.<\/p>\n<p>Kimura later issued a half-hearted non-apology and claimed that the statement had been \u200dmisconstrued. The\u2063 guild &#8220;is not, and I am not condoning war\u200b crimes,&#8221; she wrote to the listserv on Oct. 10. \u200b&#8221;The opposite.&#8221; However, she continued, Hamas\u2019s\u200d attacks were &#8220;a direct result of Israel\u2019s apartheid regime.&#8221;<\/p>\n<p>In the same vein, Iesha\u200c Phillips, the lead\u200c editor of the <em>Yale Journal of Law &#038; Liberation<\/em>,\u200c <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2023\/11\/Gmail-Fwd_-Thewindow-Breaking-The-Sound-of-Silence.pdf\" target=\"_blank\" rel=\"noopener\">wrote<\/a> to the listserv on Oct. 9 that &#8220;expecting \u200dPalestinians to peacefully respond to unspeakable war\u200c crimes \u2064and illegal collective punishment they\u2019ve experienced at the hands of Israel is\u2064 laughable.&#8221;<\/p>\n<p>&#8220;Too many lives\u2062 have been lost over the\u200d past few decades,&#8221; she added. &#8220;We shouldn&#8217;t\u2062 only\u200c start to care because it&#8217;s now affecting Jewish folks.&#8221;<\/p>\n<p>Phillips and Kimura did not respond to requests for comment.<\/p>\n<p>Yale Law School has long been a breeding ground for influential policymakers, from former secretary of state \u200cHillary Clinton \u200bto Biden national security \u200dadviser Jake Sullivan. Six sitting senators are also alumni.<\/p>\n<p>It\u2019s far from the \u200conly elite incubator with a blind spot around Jews.\u200c A member of the Harvard Law Review and others were \u200bcaptured on video\u2014<a href=\"https:\/\/freebeacon.com\/campus\/israeli-harvard-business-school-student-accosted-and-harassed-amid-gaza-die-in-on-campus\/\" target=\"_blank\" rel=\"noopener\">published over two weeks ago by the <em>Free Beacon<\/em><\/a>\u2014accosting an Israeli Harvard Business School student. Harvard has yet to \u2064address the incident beyond a <a href=\"https:\/\/www.hbs.edu\/about\/leadership\/statements-and-speeches\/Pages\/our-values.aspx\" target=\"_blank\" rel=\"noopener\">statement<\/a> from Srikant Datar, the dean of the \u200bbusiness school, lamenting both &#8220;Islamophobia&#8221; and anti-Semitism.\u200b It did, however, <a href=\"https:\/\/www.thecrimson.com\/article\/2023\/10\/25\/doxxing-task-force\/\" target=\"_blank\" rel=\"noopener\">create a\u200c taskforce<\/a> for the &#8220;doxxed \u200cstudents&#8221; who signed an <a href=\"https:\/\/www.thecrimson.com\/article\/2023\/10\/10\/psc-statement-backlash\/\" target=\"_blank\" rel=\"noopener\">open \u200dletter<\/a> blaming \u200cIsrael for Hamas\u2019s atrocities.<\/p>\n<p>What kind of\u2063 message, exactly, are these\u200d schools sending to\u2063 future leaders, who\u2063 have for weeks now watched their\u200d classmates cheer terrorists and jeer Jews\u2062 with \u200cno administrative pushback? Yale \u200dLaw School\u2019s budding attorneys aced the LSAT, sure, but they were also\u200d admitted because\u2064 they can read rooms and climb greasy poles.<\/p>\n<p>When, in so many \u2062other instances, every microaggression is policed, every alleged trauma met with concern,\u200b and every act of \u200chorror denounced with an official statement, what other lesson\u2064 will they \u2063draw from \u200cthe past month than that Jews \u2062matter less than other groups?<\/p>\n<p>&#8220;I think some Jewish students feel deeply \u200cuncomfortable being at the \u200blaw school right \u2062now, knowing that \u200ctheir peers would likely condone\u200b and maybe even celebrate their murder by terrorists,&#8221; said one Jewish law student, who, \u200dlike\u2063 almost every other student interviewed for this story, requested anonymity. &#8220;And the law school\u2019s silence\u2014when it is so often quick to jump to a moment of moral clarity\u2014suggests \u200cthat\u200d there is something wrong with Yale Law School.&#8221;<\/p>\n<p>Consider the following parallel.<\/p>\n<p>When \u200cYale Law student Trent Colbert <a href=\"https:\/\/freebeacon.com\/campus\/a-yale-law-student-sent-a-lighthearted-email-inviting-classmates-to-his-trap-house-the-school-is-now-calling-him-to-account\/\" target=\"_blank\" rel=\"noopener\">invited classmates<\/a> to his &#8220;traphouse,&#8221; a term some claimed had racist associations with crack houses, in 2021, it took exactly 12 hours for \u2063administrators to \u200cprocess\u200b nine discrimination complaints, haul Colbert in\u200c for a meeting, and suggest\u2063 his career was on \u2062the line if \u2062he didn\u2019t sign an\u2064 apology they \u200cpenned on his behalf.\u200b Gerken, the law school\u2019s dean,\u200c also authorized a schoolwide message\u2062 condemning Colbert\u2019s language.<\/p>\n<p>But when Jewish students appealed to Gerken almost two weeks after \u2063the\u2064 Hamas attacks,\u2064 describing the \u200danti-Semitic vitriol in\u200d their \u200cinboxes, they got a rote reply from her deputy, Debra Kroszner,\u2062 who directed them to student \u2063support services.<\/p>\n<p>&#8220;Dean Gerken wanted to ensure that \u200cyou are\u2063 connected with any support you might\u2062 need\u200d in \u2063 [the Office of Student Affairs],&#8221; Kroszner wrote. &#8220;I understand these are \u200cdeeply challenging times\u2063 and\u2063 we appreciate you \u2063reaching\u200d out to share your \u2062concerns.&#8221;<\/p>\n<p>Another student said he received an almost identical note from Gerken herself.<\/p>\n<p>Kroszner told the <em>Free\u200d Beacon<\/em> and <em>The Free Press<\/em> that the law school had policies in place to\u2063 &#8220;address \u200bcomplaints made\u2064 by members of this community&#8221; and that it did not tolerate &#8220;harassment or \u2064discrimination.&#8221;<\/p>\n<p>Alumni aren\u2019t\u2063 taking Yale\u2019s word for it. Last Friday over\u200b 100 of them sent a <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2023\/11\/Joint20Letter20to20Yale20Law20School.pdf.pdf\" target=\"_blank\" rel=\"noopener\">petition<\/a> to Gerken that asks Yale to report &#8220;student endorsements of terrorism to state bar committees on character \u2064and \u2063fitness,&#8221; and calls on the school\u200b to adopt \u200ba &#8220;zero-tolerance policy toward antisemitic threats or harassment,&#8221;\u2063 including toward students who express support for Israel.<\/p>\n<p>&#8220;The failure \u200bto make these \u2063and other changes swiftly and substantially would be a \u2062betrayal of the law school\u2019s history and values, \u200das well \u2064as of\u200b the \u2062Jewish community,&#8221; the petition says. &#8220;This climate\u2014and what the administration does or\u2062 does not do\u2014will \u2062undoubtedly cause many \u200calumni, \u2062of all religions and political views, to think hard about their \u200bcontinuing connection to\u200b Yale Law School.&#8221;<\/p>\n<p>Jewish law\u2064 students say the silence has been &#8220;crushing.&#8221;<\/p>\n<p>&#8220;The \u2064silence in the law school from\u200b all\u2062 those who proclaim the mantle of justice, human rights, and \u2062rule \u2062of law is deafening,&#8221; one student wrote to the listserv. &#8220;For a school filled with \u2062self-assured outrage at evils across the globe, the absence of any response is crushing.&#8221;<\/p>\n<p>Jewish undergraduates, meanwhile, who have had \u200ctheir newspaper \u200dcolumns\u200b <a href=\"https:\/\/freebeacon.com\/campus\/i-said-hamas-raped-women-and-beheaded-men-the-yale-daily-news-issued-a-correction\/\" target=\"_blank\" rel=\"noopener\">stealth edited<\/a> to remove \u200dreferences to Hamas\u2019s atrocities, \u2063were <a href=\"https:\/\/www.wsj.com\/articles\/jewish-students-meet-hostility-at-yale-israel-hamas-violence-terrorism-anti-semitism-1d6f81da?mod=opinion_lead_pos10\" target=\"_blank\" rel=\"noopener\">locked out of an anti-Israel event<\/a> this week sponsored by several Yale\u200b academic departments, in \u2063which \u200cpanelists declared that Israel \u2064&#8221;cannot remain \u2063the\u2062 state of the Jewish people.&#8221; The students sent \u200dan email\u200c Wednesday morning demanding\u200c a meeting with Yale president Peter Salovey.<\/p>\n<p>At a <a href=\"https:\/\/www.youtube.com\/watch?bbeml=tp-SWlkD4IO3kGxmA7UddoBhw.jK6_q7VlpyEuTLhAJzW4vHg.rhQvMHl62-0uY8kT23Aw0VA.l6JxJMHn4YEmJruIJF7dazg&#038;v=QDo-rE59hbo&#038;feature=youtu.be\" target=\"_blank\" rel=\"noopener\">town hall meeting<\/a> last week, Jason Rubenstein, a rabbi \u200bin the Yale Chaplain\u2019s\u200d Office, said \u2063the\u200c campus environment has\u2064 never been worse for Jews.<\/p>\n<p>&#8220;It\u2019s a darker scene than we\u2019ve ever inhabited in my past five\u2064 years at Yale,&#8221; he said.<\/p>\n<p> <\/p>\n<h2> Why did\u2064 the center remain silent for six days following\u200b the massacre, and what impact did this silence have on the affected Israeli law student and their plea for the center to speak out against the \u200cgenocide<\/h2>\n<p><span>  The Washington Free Beacon and the Free \u2063Press\u200d collaborate\u200d to bring attention to a concerning issue \u2064at \u200dYale Law School\u2019s Schell \u2063Center for \u2064International Human Rights. The center, which aims\u2064 to promote human rights \u200cglobally, has failed to address the recent atrocities committed by Hamas against Israelis. Despite its\u200d commitment to shedding light on\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/just-like-the-good-old-days-joe-biden-invades-syria-with-convoy-of-us-troops-and-choppers-on-first-full-day-as-president\/\" title=\"Just Like the Good Old Days: Joe Biden Invades Syria with Convoy of US Troops and Choppers on First Full Day as President\">human rights abuses<\/a>, the center remained silent for six days\u200b following\u2064 the massacre.<\/p>\n<p>One Israeli law student, whose family was directly affected by the events, pleaded with the center to speak out against the genocide.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Washington Free Beacon proudly co-publishes this piece with the Free Press.
