District Court Judge Tanya Chutkan, who \u200dis presiding over the former president\u2019s case related to his speech on the day of the\u200d Capitol riot on Jan. 6, \u200d2021.<\/p>\n<p>\u201cThis is not about whether I like the\u200c language Mr. Trump uses,\u201d\u200c Judge Chutkan reportedly \u200d <a href=\"https:\/\/www.wsj.com\/us-news\/law\/judge-issues-limited-gag-order-on-trump-in-federal-election-interference-case-f7620ff3\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> when she handed down the order. \u201cThis is\u200d about language that \u200dpresents a danger to\u2062 the administration of justice.\u201d<\/p>\n<p>Chutkan,\u2063 despite being\u200b an activist judge with\u200b a\u200d <a href=\"https:\/\/thefederalist.com\/2023\/08\/15\/judge-tanya-chutkans-record-should-disqualify-her-from-presiding-over-trumps-j6-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">record<\/a> of unusually harsh sentences for pro-Trump demonstrators,\u200d <a href=\"https:\/\/thefederalist.com\/2023\/09\/28\/of-course-judge-chutkan-wont-recuse-herself-from-trumps-j6-case-she-has-a-narrative-to-prove\/\" target=\"_blank\" rel=\"noreferrer noopener\">refused<\/a> to recuse herself from the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-supreme-court-nominee-a-slam-dunk-for-democrats\/\" title=\"Biden\u2019s Supreme Court Nominee A Slam Dunk For Democrats\">politically charged case<\/a> in September. In\u200d their Wednesday filing, Trump\u2019s attorneys argued the gag order \u200cwas both unprecedented and unconstitutional.<\/p>\n<h2>1. The\u2064 Gag Order\u2064 Is\u200c Unprecedented<\/h2>\n<p>Trump\u2019s attorneys\u200d noted the former \u200bpresident\u200c made history as \u200dthe first presidential frontrunner to face a gag order heading into the next \u2062election.<\/p>\n<p>\u201cThe Supreme Court has \u2018never allowed the government\u200c to\u200c prohibit candidates\u200b from \u2062communicating \u200drelevant \u200cinformation to voters during an election,&#8217;\u201d they wrote, citing the 2002 Supreme Court case <em>Republican Party of Minnesota\u2064 v. White<\/em>. \u201cAccordingly,\u2064 no court has ever \u200dimposed a gag\u2062 order on the political \u200cspeech of a candidate for public \u200doffice, let alone the leading candidate for President of the United States \u2014 until now.\u201d<\/p>\n<figure><\/figure>\n<h2>2. The Gag Order Is Election Interference<\/h2>\n<p>With a more than <a href=\"https:\/\/www.realclearpolitics.com\/epolls\/2024\/president\/us\/2024_republican_presidential_nomination-7548.html\" target=\"_blank\" rel=\"noreferrer noopener\">44-point<\/a> lead in the RealClear aggregate of GOP primary presidential surveys, Trump has \u2064maintained overwhelming support over\u200b his Republican rivals throughout the entire race. Trump\u2019s chief opponent for a second term in the White House is President Joe Biden along with his weaponized Justice Department and Democrat prosecutors in \u2062state and local offices, who have targeted Trump with a combined <a href=\"https:\/\/www.nytimes.com\/interactive\/2023\/us\/trump-investigations-charges-indictments.html\" target=\"_blank\" rel=\"noreferrer noopener\">91<\/a> charges.<\/p>\n<p>In court,\u200c Trump\u2019s attorneys \u2062wrote Chutkan\u2019s gag order \u201crestricts President Trump from making public statements about\u2062 key aspects of his prosecution at the hands of \u2063the Administration he is seeking to replace \u2014 issues that are central to, and inextricably entwined with, the 2024 Presidential campaign.\u201d<\/p>\n<p>The Department of\u2063 Justice, which is run by a handpicked Biden\u200d nominee and has a history of running cover for the Biden family,\u200c has successfully muzzled the administration\u2019s top political opponent.<\/p>\n<h2>3. The Gag Order Violates The First Amendment<\/h2>\n<p>Trump\u2019s \u2063attorneys argued the gag order violated not only Trump\u2019s right to free speech, but also the public\u2019s.<\/p>\n<p>\u201cThe\u200d Gag Order violates President Trump\u2019s most\u200d fundamental First\u200d Amendment rights,\u201d\u200d they wrote. \u201cEven worse, it gives no \u2063consideration to the First\u200b Amendment rights of President \u2064Trump\u2019s \u2064audience, the American public, to receive and listen to his speech.\u201d<\/p>\n<figure>\n<p>\n      <span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">4. Gag order relies on\u2064 argument courts\u200d don&#8217;t allow: negative \u2064reactions to free speech. 5.
