This move comes in response to President Joe Biden&#8217;s Justice Department and the manufacturer \u2064of the widely used abortion drug mifepristone seeking to reverse \u200da lower court ruling that could restrict access to the drug.<\/p>\n<blockquote>\n<p>&#8220;Unelected federal bureaucrats do not have the statutory authority\u200b to approve the shipment of these dangerous \u200cchemical abortion drugs in the mail,&#8221; said Bailey.<\/p>\n<\/blockquote>\n<p>Bailey, along with Idaho \u2062and Kansas, is calling on a Texas federal district court to combine their complaint with an existing lawsuit brought by doctors across the country, known as Alliance for Hippocratic Medicine v. FDA. The goal is to strengthen their case \u200dagainst\u2063 the FDA&#8217;s approval of these drugs.<\/p>\n<h3>The Impact of Mifepristone<\/h3>\n<p>Mifepristone is an abortion drug that works \u2063by blocking a pregnant woman&#8217;s progesterone receptors, halting fetal development in \u200dthe womb. \u200bIt is often followed by the administration of misoprostol, another chemical abortifacient, to induce uterine\u200c contractions and expel the pregnancy. This combination or the use of misoprostol alone accounts for over half of all abortions.<\/p>\n<p>The lawsuit filed by the three states seeks to \u200bjoin forces with the conservative legal\u2064 firm Alliance Defending Freedom \u200d(ADF), which has a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/san-francisco-poop-testing-startup-charged-with-fraud-likened-to-theranos\/\" title=\"San Francisco Poop-Testing Startup Charged With Fraud, Likened To Theranos\">strong track record<\/a> of landmark cases at the Supreme Court. ADF was involved in the recent\u2063 Dobbs v. Jackson Women&#8217;s Health \u2062Organization case, which challenged decades of abortion precedent under Roe v. Wade.<\/p>\n<p>While mifepristone remains available, the U.S. Court of Appeals for the 5th Circuit \u200bhas suggested that\u200b restrictions should be imposed on its use. However, these restrictions will \u200cnot be enforced until all legal challenges are resolved, thanks to a Supreme Court order issued \u200din April.<\/p>\n<p>The 5th Circuit has rejected the argument that the drug should be removed from the\u2064 market, but it did find fault with the FDA&#8217;s changes in 2016 and 2021 that expanded access to the pills, deeming them arbitrary and \u2064capricious.<\/p>\n<p>ADF senior counsel Erin Hawley expressed her \u2062support for the \u200bthree states intervening in the \u2064case, stating, \u200b&#8221;It is encouraging \u2064to see \u200cMissouri, along with\u200b Kansas and Idaho, \u200cintervene in this important case \u2063to protect the health and well-being of women and \u2063girls.&#8221;<\/p>\n<p>Missouri&#8217;s complaint specifically \u200cseeks \u200ban injunction against \u2062the rollback of safety precautions in 2016, the approval of generic mifepristone in 2019, and the policies allowing these drugs to be sent by mail\u200c in 2021 and 2023.<\/p>\n<p>Bailey filed the complaint in the U.S. District Court for \u2064the Northern District of Texas, where a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/missouri-attorney-general-seeks-to-merge-lawsuits-against-fdas-approval-of-abortion-pill-by-mail\/\" title=\"Missouri AG aims to consolidate lawsuits against FDA's mail abortion pill approval.\">judge initially expressed concerns<\/a> about the FDA&#8217;s 2000 approval of the drug.
