Kennedy Tells Voters To Buy Handguns\">outdoor shooting range<\/a>,\u201d \u200bin 2018 with his wife Elise.<\/p>\n<p>By 2019, Wilson decided to tap into Flagstaff\u2019s booming tourist market by taking out space for a video advertisement that runs on a\u2063 60-second loop in \u2062the lagstaff Pulliam Airport\u2019s baggage\u2063 claim \u201cduring <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/climate-activists-pour-charcoal-in-trevi-fountain-turning-it-black\/\" title=\"Activists turn Trevi Fountain black with charcoal.\">peak tourist season<\/a>.\u201d<\/p>\n<p>\u201cWe have about \u20625 million\u2064 tourists a year that visit Flagstaff to \u200bgo to the Grand Canyon, and many of them come through the airport,\u201d Wilson explained. \u201cThis was running \u2064on the only video monitor in \u200cthe airport that has anything on it,\u2064 and it\u2019s right over\u2064 the baggage\u200b claim\u200d belt. Wilson told \u200dThe\u200c Federalist Timberline experienced an\u200b influx \u200bof interest \u200devery summer \u200dfrom people\u200c who encountered \u2062the\u200d airport ad.<\/p>\n<p>\u201cWe \u200dget a\u200c significant number of tourists because oftentimes, they are coming from places where they can\u2019t do\u200b anything like what we can experience\u200c here,\u201d Wilson\u200b said.<\/p>\n<p>Because the \u200dmarketing was so \u201ceffective at capturing that tourist \u200dmarket,\u201d Wilson renewed \u200bhis contract\u200b with the airport\u2062 every summer.<\/p>\n<p>When Wilson tried to\u200c purchase the advertising \u2064space in the baggage claim this year in April, the airport \u200bdenied it, citing \u2062a\u200b Flagstaff city ban on any ads \u2064that \u201crepresent, by language or graphics, violence, or antisocial behavior.\u201d<\/p>\n<h2 class=\"wp-block-heading\">Shooting From The \u200dHip<\/h2>\n<p>It \u2064was unclear who ultimately decided \u2062Wilson\u2019s ad, the same which he ran for the last four years, \u2062suddenly did \u2062\u201cnot align with our advertising \u2063guidelines.\u201d<\/p>\n<p>\u201cThe bottom line from what\u200b we can tell is that\u200c somebody at city hall or\u2063 somebody at \u200bthe\u200b airport just\u200d didn\u2019t want guns\u2063 being shown, didn\u2019t want people talking \u200dabout guns, advertising guns, or exercising their free \u200bspeech \u2064rights\u200d on \u200bthat subject,\u201d Goldwater\u200c Institue Staff Attorney John Thorpe told The Federalist.<\/p>\n<p>Wilson attempted to \u2063appeal the decision before\u200b a <a href=\"https:\/\/original.newsbreak.com\/@ryan-meeks-escape-to-arizona-1552161\/3177561008024-arizona-s-iconic-grand-canyon-national-park-celebrates-record-breaking-visitor-numbers\" target=\"_blank\" rel=\"noreferrer noopener\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-releases-list-of-president-trumps-accomplishments-and-it-is-historic\/\" title=\"White House Releases List of President Trump\u2019s Accomplishments \u2013  And It Is Historic!\">record-breaking number<\/a> of tourists<\/a> \u2064flooded the Flagstaff area \u2062this summer, but his requests were \u2064repeatedly brushed off.<\/p>\n<p>\u201cThey\u200b said,\u2063 \u2018We\u2019re gonna rewrite our entire policy, so you\u2019re just gonna have to wait until we\u2064 do that.\u2063 And\u2063 that won\u2019t go in front of the city council until September, so you\u2019re\u200d just out of luck for the\u2062 summer,\u2019\u201d Wilson said.<\/p>\n<p>Around \u200cthat same time, the Flagstaff city council \u2064began crafting a new\u2063 airport <a href=\"https:\/\/www.goldwaterinstitute.org\/flagstaff-az-censors-navy-veterans-gun-range-ad-goldwater-fights-back\/\" target=\"_blank\" rel=\"noreferrer noopener\">advertising \u2064policy<\/a> that \u200cbars businesses like Wilson\u2019s from using marketing that \u201cpromotes,\u200c solicits, \u200cor markets \u2026 weapons,\u2062 firearms, ammunition, or fireworks, or depicts such products, goods, or services.\u201d<\/p>\n<p>The policy does\u200b not\u200c mention\u200b Timberline by name, but, as Wilson <a href=\"https:\/\/flagstaffaz.new.swagit.com\/videos\/271412\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a> during a\u2063 Sept. 12 City \u200cCouncil working session, it is \u2063Flagstaff\u2019s \u200b\u201conly indoor shooting range.\u201d<\/p>\n<p>\u201cWe train not just your friends\u200c and \u200dyour neighbors \u200cbut also our\u200d <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mexican-capo-ovidio-guzman-extradited-to-us-in-win-on-fentanyl-war\/\" title=\"Mexican drug lord Ovidio Guzman extradited to US, a victory in the fight against fentanyl.\">law \u2064enforcement\u200b agencies<\/a>, \u200bboth local, state, and federal,\u201d Wilson noted during his \u2062prepared\u2064 remarks.<\/p>\n<p>Earlier in that same session, Flagstaff\u2019s Economic Vitality Director Heidi Hansen claimed that the city\u2019s advertising program should \u201cgenerate \u2062revenue while offering opportunities \u200dto promote\u2062 activities, to brand the\u200c business\u201d but should\u2064 provide \u2064a \u201cwelcoming and comfortable environment for our patrons.\u201d<\/p>\n<p>She said other cities, including Phoenix, had adopted similar advertising policies to the anti-gun one \u2062the council was considering. The Phoenix Sky Harbor Airport, however, <a href=\"https:\/\/www.youtube.com\/watch?v=Diuh0e_kMHQ\" target=\"_blank\" rel=\"noreferrer noopener\">confirmed to Arizona\u2019s \u200dFamily<\/a> that it does\u200b not prohibit advertising for guns.<\/p>\n<p>\u201cCouncil members made it very clear\u2063 \u2014 it\u2063 was all\u200c of \u200bthem \u2014 it made them uncomfortable \u200bwas their explanation, justification for not wanting to \u200brun it,\u201d\u2064 Wilson\u2062 said.<\/p>\n<p>Thorpe said\u2064 the city council\u2019s plan is \u201cunconstitutional under state\u200b and \u200dfederal free \u200dspeech doctrine\u201d and \u201cprobably due process as well.\u201d<\/p>\n<p>\u201cFortunately for Arizonans, the \u200bArizona \u200cConstitution\u2064 is even more protective \u200bof \u200dspeech than the federal constitution.\u200d We have a lot of case law saying that Arizona\u2019s constitutional free speech provision goes further than the federal provision. It\u2019s worded differently and makes \u200dclear that the drafters intended for it to protect even \u200cmore speech,\u201d Thorpe said.<\/p>\n<p>While\u200d there is little \u2064case law specifically discussing \u201chow free\u200b speech \u200dapplies the context of city officials targeting an \u200badvertiser for [a] municipal airport,\u201d Thorpe said the city\u2019s treatment\u2062 of Wilson is unconstitutional.<\/p>\n<p>\u201cOne thing \u2063that courts have been clear on is that cities can\u2019t engage in viewpoint\u200b discrimination. And\u2064 they have to apply \u200dtheir policies reasonably. It fails \u2062on both points here,\u201d Thorpe said.<\/p>\n<p>Flagstaff residents appear to agree.<\/p>\n<h2 class=\"wp-block-heading\">Biting The Bullet<\/h2>\n<p>While the\u2064 council slow-walked Wilson over \u2064the advertising controversy, he\u2064 received an outpouring of support from people\u2064 in the community who were appalled at the\u200c city\u2019s treatment of Timberline.<\/p>\n<p>Several \u2062of them <a href=\"https:\/\/flagstaffaz.new.swagit.com\/videos\/271412\" target=\"_blank\" rel=\"noreferrer noopener\">attested<\/a> during city council meetings that Timberline is a \u201clegitimate,\u201d \u201clicensed,\u201d taxpaying business that \u200cprovides the community with a \u201csafe place to shoot.\u201d<\/p>\n<p>During a Sept. 19 city council meeting, one Arizonan went\u200d so far as \u2062to call for the\u200d resignation of the\u200c members who \u2063rallied around the\u200d decision to reject Wilson\u2019s advertising\u200d application.<\/p>\n<p>\u201cWhichever one\u2063 of you tried to help violate the constitutional rights of the Timberline Sports owners have directly violated \u200dyour\u200d sworn\u2063 oath by attempting to deprive those folks of their rights under the First\u2064 and Second Amendment to both constitutions,\u201d \u200dSteve Carter, who announced himself as an Army\u200c veteran \u2062who was\u200c inducted into the Maricopa County Sheriff\u2019s office in 2010, <a href=\"https:\/\/flagstaffaz.new.swagit.com\/videos\/272057\" target=\"_blank\" rel=\"noreferrer noopener\">told\u200d the council<\/a> during\u200b a public participation segment.<\/p>\n<p>Carter called on council members who \u201csupported the action against \u2062Timberline\u201d to apologize and \u201ctake a piece of paper, write\u2064 out your resignation from the city council, and hand it to the city attorney.\u201d<\/p>\n<p>Wilson\u2063 said \u200cthat the city council also received more than \u2064\u201c100 emails opposing\u200c it\u201d and \u200bletters from \u201cthree members\u200d of the Arizona House of Representatives \u200dwho \u200bsaid on official letterhead,\u200c you will be violating state law if you\u200c enact this policy.\u201d<\/p>\n<p>\u201cThey \u2064chose\u2062 to \u2062move \u2064forward\u200b regardless,\u201d Wilson added.<\/p>\n<p>Goldwater Institute sent\u2062 a <a href=\"https:\/\/www.goldwaterinstitute.org\/wp-content\/uploads\/2023\/10\/Wilson-Demand-Letter.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a> to the Flagstaff city \u2064attorney threatening \u2063to take legal\u2063 action if the city\u200d refuses to confirm\u200d whether its \u201cnew advertising policy will not prevent \u200bMr. Wilson from<br \/>displaying the ads he previously ran for Timberline\u201d  and does not \u201cpromptly approve his<br \/>application \u200dto advertise at \u200cthe Airport.\u201d<\/p>\n<p>\u201cWhen you start out with the predetermined goal of making sure that your\u200c policy \u2064bans \u200bsomebody\u2019s speech. In order to do that and still maintain any kind of semblance of appearances, you end up banning a \u200clot of other speech as well,\u201d Thorpe said. \u201cWe don\u2019t know what the final draft\u2064 is going to \u2063contain but the language we\u2019ve seen so far would ban a whole lot of other\u2062 reasonable\u200b advertising.\u201d<\/p>\n<p>Thorpe said \u2062he\u2019s \u200din talks with the\u200d city but, so far, still \u2064 <a href=\"https:\/\/azdailysun.com\/news\/local\/govt-and-politics\/goldwater-institute-threatens-lawsuit-after-timberline-firearms-ad-denial-at-flagstaff-airport\/article_e629ae72-7361-11ee-bf5c-9b447afeacd2.html\" target=\"_blank\" rel=\"noreferrer noopener\">expects<\/a> \u200d the\u2064 council to decide \u200bon an edited version of the policy \u2062in\u200b mid-November.<\/p>\n<p>Even\u200c if the city moves forward with its \u200dnew \u2062policy, Wilson\u2063 confirmed that he \u2063won\u2019t back\u2063 down\u200c because he believes \u200delected officials\u200b should be held accountable.<\/p>\n<p>\u201cIt\u2019s \u200bso important because our local elected officials will eventually\u2064 become our \u2063state officials\u2064 and then, \u200ceventually,\u2063 our\u2064 national officials.
