J.B. Pritzker earlier\u200c this year, prohibits the buying, selling, \u200dand owning of certain semiautomatic guns, including the popular AR-15s. However, this <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/divided-federal-court-upholds-illinois-ban-on-assault-weapons\/\" title=\"Federal Court Upholds Illinois Ban on 'Assault Weapons'\">controversial move immediately faced legal challenges<\/a> from groups and individuals who claimed it was illegal.<\/p>\n<div class=\"my-5\">\n<p>According to U.S.\u200c Circuit Judge Diane Wood, who\u200c wrote \u2063for the 2\u20131 majority,\u200b the plaintiffs must prove that\u2062 the banned weapons are commonly \u2063used for self-defense and not\u2063 primarily \u2064designed for military purposes. Judge Wood referred to a 2008 U.S. Supreme Court decision that stated\u200c the Second Amendment only protects weapons that are not typically possessed by law-abiding citizens for lawful purposes.<\/p>\n<\/p><\/div>\n<p>Under a 2022 Supreme Court ruling, courts must assess \u200dwhether laws\u2064 fall within the \u2063scope of the Second Amendment. However, Judge Wood found their arguments &#8220;unconvincing.&#8221; She did acknowledge that the\u200b M16\u2062 can be fully automatic, unlike the AR-15 without modification.<\/p>\n<p>Joining\u200b Judge Wood\u200b in the \u2062majority\u2063 was U.S. Circuit Judge \u2064Frank\u200b Easterbrook, an\u2064 appointee of former President Ronald \u200bReagan.<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>The ruling came as a response \u200bto six consolidated lawsuits challenging the law, with\u2063 plaintiffs including Law \u2062Weapons, Inc., a gun store in Naperville, and Javier Herrera, an emergency room doctor in Chicago.<\/p>\n<p>In \u2062previous\u2062 lower court \u200brulings, some judges sided with\u2063 the plaintiffs, finding the law violated the Second Amendment based on the 2022\u200b Supreme Court \u200cdecision. However, \u2062others believed the law aligned with historical U.S. firearm restrictions.<\/p>\n<div class=\"my-5\">\n<p>In August, the\u2064 divided \u2064Illinois Supreme Court <a href=\"https:\/\/www.theepochtimes.com\/us\/illinois-supreme-court-upholds-states-assault-weapons-ban-5459612\" target=\"_blank\" rel=\"noopener\">upheld<\/a> the law, stating it \u2063did not violate the Illinois Constitution.<\/p>\n<\/p><\/div>\n<div class=\"my-5\">\n<p>The law, known as the Protect Illinois Communities Act, prohibits the \u2063purchase, sale, and ownership of semiautomatic rifles and pistols meeting specific conditions, including\u200d those with magazines capable of holding more than 10 \u200drounds. The\u200d only \u2063exceptions are for &#8220;trained professionals,&#8221; such as law enforcement officers, and individuals who owned the firearms before the law&#8217;s effective date in January 2024.<\/p>\n<h2>Dissent<\/h2>\n<p>U.S. District Judge Michael \u200cBrennan, an appointee of former President Donald Trump, <a href=\"https:\/\/www.documentcloud.org\/documents\/24119941-us-appeals-court-dissent-on-illinois-gun-law\" target=\"_blank\" rel=\"noopener\">expressed dissent<\/a>. He argued that the banned firearms fall under the category of &#8220;arms&#8221; protected by the Second Amendment.<\/p>\n<p>Judge Brennan emphasized that the Supreme Court has emphasized the protection of guns\u2064 &#8220;in common use at \u2064the time.&#8221; He stated that the banned weapons include \u200dmany of the most commonly-owned semiautomatic handguns, shotguns, rifles,\u200c and\u2062 magazines.<\/p>\n<p>According to Judge Brennan, Illinois officials must demonstrate that the\u2062 ban aligns with past regulations. However, the appeals court&#8217;s decision now allows the law to be enforced while the litigation continues.<\/p>\n<\/p><\/div>\n<p>The majority ruling also rejected the argument that the law places an undue burden on the Second Amendment right to self-defense. Judge Wood\u2063 emphasized that the ban does not prevent citizens from accessing other types of firearms for self-defense purposes.
