CREW, \u200dwhich\u2064 <a href=\"https:\/\/www.influencewatch.org\/non-profit\/citizens-for-responsibility-and-ethics-in-washington\/\" target=\"_blank\" rel=\"noreferrer noopener\">received<\/a> funding from George Soros\u2019 Open Society Foundations, has a history\u2063 of frivolous lawsuits targeting\u2063 Donald Trump.<\/p>\n<p>The left-wing organization exists\u2063 to abuse the legal \u200csystem to harm\u200d Republicans, and they might \u2062get lucky this time with their Hail Mary attempt to take out Trump. The judge \u200dpresiding over their case is Sarah Wallace, \u2063a\u2062 Democrat donor who was appointed just last year \u2063by Democrat \u200cColorado Gov. Jared Polis.<\/p>\n<p>CREW\u2019s lawsuit wants \u200bWallace to\u2062 order Democrat \u200cColorado Secretary of \u200cState Jena Griswold \u2014 who\u2019s pretending to be neutral \u2014 to\u2062 remove \u2063Trump from the state\u2019s ballot next year. The lawsuit argues Trump is guilty\u2064 of \u201cinsurrection\u201d\u2064 and\u2063 is \u2064ineligible \u2062due\u200b to the 14th Amendment\u2019s Disqualification Clause used to \u2063chase out of office Confederate insurrectionists who \u200dfought\u200c against the \u200bUnion in \u200cthe Civil War. The \u2063precedent set by this case could be used by liberal \u200dactivists\u2064 to force Trump off of the ballot in key states such as Michigan, Pennsylvania, and Arizona.<\/p>\n<p>CREW\u2019s legal theory is wrong for several reasons. For\u200c starters, \u200bit\u2019s not clear that\u2062 section 3 of the 14th Amendment\u200d even\u200c applies \u200bto the president. As Andrew McCarthy \u2064wrote \u200cin \u2062 <a href=\"https:\/\/www.nationalreview.com\/corner\/one-more-thing-on-section-3-of-the-14th-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">National Review<\/a>, this section \u201crefers to electors of the president and \u200cvice president, not the president and vice president themselves. Plainly, if it had been \u2063the purpose of\u200d the \u200bamendment\u2019s framers to include \u2063the president and vice president, they\u2019d have said so \u2014 they wouldn\u2019t have left it at electors.\u201d<\/p>\n<div class=\"fdrlst__b89e9-548185e59119ac37b9a3661333e43cf4 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-548185e59119ac37b9a3661333e43cf4\"><\/div>\n<p>Furthermore, \u2062if it\u200d did apply to presidents, President Trump has not been federally criminally convicted \u2062of, let alone charged for, insurrection, so he couldn\u2019t be disqualified\u2062 for committing the offense. The \u200dcontrolling 1869\u2064 case law is\u200b clear: if \u2063Democrats want to disqualify their political opponent from holding office under the post-Civil War 14th\u200b Amendment\u2019s Disqualification Clause, a\u2064 federal\u2063 prosecutor must win a \u200dcriminal conviction, with evidence beyond a reasonable doubt and a unanimous federal jury, under the federal criminal insurrection statute \u200bCongress passed\u200c in 1870 to give the 14th Amendment\u2019s Disqualification Clause its\u2062 effect. Fiats by partisan state election officials \u2062or judges, like newly\u2064 appointed Democrat Denver District Judge\u200c Sarah Wallace, simply don\u2019t constitutionally \u200bcut it.<\/p>\n<p>Former <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-ag-nominee-wont-commit-to-keeping-durham-as-special-counsel\/\" title=\"Biden\u2019s AG nominee won\u2019t commit to keeping Durham as special counsel\">federal appellate judge<\/a> on the Denver-based 10th Circuit and current Stanford \u2064Law professor Michael\u2064 McConnell, who is no fan of Donald Trump, <a href=\"https:\/\/reason.com\/volokh\/2023\/08\/12\/prof-michael-mcconnell-responding-about-the-fourteenth-amendment-insurrection-and-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> \u200c earlier this year:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIt is significant that the Department of Justice has prosecuted hundreds of \u200dpersons for their involvement in the January 6 incursion at the Capitol, but has \u2063not charged anyone, including Trump, with insurrection under this \u200cor any other statute. It is\u200d not obvious that\u2064 partisan officials in \u200bstate\u200c governments, without specific authorization or checks and balances, should apply broad\u2062 and uncertain definitions\u2063 to \u200ddecide who can run for office\u2063 in a republic, when responsible officials\u200b with clear statutory and constitutional authority have not done so.\u201d<\/p>\n<\/blockquote>\n<p>Despite \u200dall this, CREW has found their biased, freshly appointed Democrat Denver District judge who \u200dcan ignore the\u200d U.S. Constitution, \u2063the\u200d controlling federal criminal \u200bstatute, the controlling\u2064 case law, and sound\u200b legal reasoning and simply \u2062rule in \u2063their\u200b favor \u2064in order to punish their shared political enemy.\u2064 Wallace has made\u200d several donations to \u2063Democrats over the years, but there is one \u2063 <a href=\"https:\/\/www.fec.gov\/data\/receipts\/individual-contributions\/?contributor_name=Sarah+Wallace+&#038;contributor_state=CO\" target=\"_blank\" rel=\"noreferrer noopener\">donation<\/a> in particular that puts \u200dher impartiality into question. Wallace gave \u2062$100 last year \u2014 two months after the Democrat Colorado governor named her \u200cas a state trial judge but before she\u200c assumed office \u2014 to a \u200cgroup\u200b called the \u200cColorado Turnout \u2064Project, which \u2062 <a href=\"https:\/\/www.coloradoturnout.org\/our-story\/\" target=\"_blank\" rel=\"noreferrer noopener\">says<\/a> \u200bit was created in response to Jan. 6.<\/p>\n<p>It\u2019s not the amount\u2062 that matters so much as it\u200b is a clear indication \u2064she supports their goals. Their stated mission is to\u2064 stop \u201cviolent insurrectionists\u201d by voting out\u200c \u201cpariahs like Representative [Lauren] Boebert,\u201d and, one \u2062can imagine, stopping\u200d Trump from even coming\u200c close to the presidency in 2024 by any means necessary, including this lawfare.<\/p>\n<div class=\"fdrlst__b89e9-e52f5191f896c3360630703381ce8ab5 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-e52f5191f896c3360630703381ce8ab5\"><\/div>\n<p>The Jan. 6 riot is at the heart of\u200d this lawsuit. CREW is citing \u200cthe\u200d Jan. 6 report, \u200cand \u2062their first witness was a Capitol \u2063Police officer who also\u2064 testified during the Jan.\u200c 6 committee\u2064 hearings. This donation means that\u200d Wallace more than likely agrees with the leftist narrative that is at the core \u200bof this case. Yet, she won\u2019t recuse.<\/p>\n<p>\u201cI do not\u2062 dispute that on [Oct. 15, 2022], prior \u2062to taking\u2062 the \u2064bench, I apparently made a\u2064 $100 contribution to the Colorado Turnout Project. That \u200dbeing \u2064said, prior to yesterday,\u200c I was not cognizant of this organization or its mission,\u201d\u200b Judge Wallace <a href=\"https:\/\/www.washingtonexaminer.com\/opinion\/trump-judge-says-she-cant-remember-actblue-contribution\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> from the bench. \u201cI can\u200c assure all of the litigants that\u200b prior \u2062to the start of \u2062this litigation and to this day, I have \u200dformed\u200c no opinion whether the events of Jan. 6 \u200cconstituted an insurrection.\u201d<\/p>\n<p>That\u2019s hard to believe, and \u200bit\u2019s also not the standard for recusal. Wallace\u200b is \u2062subjectively saying she won\u2019t\u200c be biased, but the public \u200cobjectively will think she is biased. Wallace should have recused herself. \u2063It will already be \u200bdamaging\u200d if a judge\u200b forces a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-files-motion-to-stay-federal-gag-order-judge-chutkan-relents-temporarily\/\" title=\"Trump seeks to delay federal gag order, Judge Chutkan grants temporary relief.\">leading\u200c presidential candidate<\/a>\u2063 off of the ballot. It \u2063will be even more\u200c damaging if the public thinks \u200cit\u2019s a politically motivated \u200ddecision. This is a clear \u2064reversible\u200b error, \u2062on this recusal issue alone.<\/p>\n<p>Unfortunately, Republicans stopped winning \u200dstatewide\u2063 elections \u200din Colorado after the state legalized weed, got \u2062invaded by New \u200bYorkers and\u200d Californians, and\u200b went \u2062to all-mail ballots \u2014 so the\u2063 Colorado Supreme Court is stacked with leftists.
